Un litige survient alors entre sa veuve et l\u2019ONIAM, l\u2019organisme charg\u00e9 d\u2019indemniser les victimes d\u2019un accident m\u00e9dical\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"> L\u2019objet du litige <\/h3>\n\n\n\n<p>Pour fixer le montant de l\u2019indemnit\u00e9 vers\u00e9e \u00e0 la veuve en r\u00e9paration de son pr\u00e9judice, l\u2019ONIAM a tenu compte des revenus encaiss\u00e9s par le d\u00e9funt avant son d\u00e9c\u00e8s, \u00e0 l&rsquo;\u00e2ge de 59 ans. \u00ab\u00a0Sans prendre en compte les revenus qu\u2019il aurait pu percevoir \u00e0 compter de son d\u00e9part \u00e0 la retraite\u00a0\u00bb, r\u00e9torque la veuve, pour qui ces revenus auraient d\u00fb faire partie du calcul \u00e9tabli par l\u2019ONIAM. Ce qui n\u2019a (injustement) pas \u00e9t\u00e9 le cas\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"> Le verdict <\/h3>\n\n\n\n<p>Ce dont est \u00e9galement convaincu le juge\u00a0: le pr\u00e9judice de la veuve doit \u00eatre \u00e9valu\u00e9 en tenant compte des revenus acquis par celui-ci avant son d\u00e9c\u00e8s, mais \u00e9galement de ceux qu\u2019il aurait pu percevoir \u00e0 compter de son d\u00e9part \u00e0 la retraite.
