{"id":22091,"date":"2021-12-10T14:21:00","date_gmt":"2021-12-10T13:21:00","guid":{"rendered":"https:\/\/avoloi.eu\/blog\/?p=22091"},"modified":"2021-12-10T14:21:00","modified_gmt":"2021-12-10T13:21:00","slug":"taxes-logements-vacants","status":"publish","type":"post","link":"https:\/\/avoloi.fr\/blog\/taxes-logements-vacants\/","title":{"rendered":"Taxes sur les logements vacants : les dates limites de paiement pour 2021"},"content":{"rendered":"<p>Les contribuables impos\u00e9s \u00e0 la taxe annuelle sur les <a href=\"https:\/\/avoloi.eu\/blog\/louer-logement-vide\/\">logements<\/a> vacants ou \u00e0 la taxe d&rsquo;habitation sur les logements vacants sont tenus de s\u2019acquitter de leur imp\u00f4t pour <strong>le 15 d\u00e9cembre 2021<\/strong>, s\u2019ils utilisent un mode de paiement non d\u00e9mat\u00e9rialis\u00e9, ou <strong>le 20 d\u00e9cembre 2021<\/strong> si le r\u00e8glement est effectu\u00e9 par t\u00e9l\u00e9paiement. La vacance du bien immobilier d\u00e9clenche l\u2019avis d\u2019imposition d\u2019une mani\u00e8re automatique, n\u00e9anmoins certaines situations peuvent conduire le contribuable \u00e0 r\u00e9clamer le d\u00e9gr\u00e8vement de cette taxe.<\/p>\n<h2><strong>Deux taxes sur les logements vacants pour un m\u00eame objectif<\/strong><\/h2>\n<p>La <strong>taxe sur les logements vacants (TLV)<\/strong> et la <strong>taxe d&rsquo;habitation sur les logements vacants (THLV)<\/strong> visent \u00e0 r\u00e9guler le march\u00e9 <a href=\"https:\/\/avoloi.eu\/blog\/vente-immobiliere-clause-suspensive\/\">immobilier<\/a> en limitant le nombre de biens habitables rest\u00e9s inoccup\u00e9s dans les secteurs o\u00f9 les logements disponibles \u00e0 la vente ou \u00e0 la location font d\u00e9faut. La taxation de ces biens immobiliers tient, en cons\u00e9quence, tant \u00e0 leur situation g\u00e9ographique qu\u2019\u00e0 la dur\u00e9e de <a href=\"https:\/\/avoloi.eu\/blog\/vacances-conseils-arnaques\/\">vacance<\/a> du logement.<\/p>\n<h3><strong>Taxe sur les logements vacants (TLV)<\/strong><\/h3>\n<p>La taxe annuelle sur les logements vacants, institu\u00e9e par l\u2019article 232 du Code g\u00e9n\u00e9ral des imp\u00f4ts, s\u2019applique uniquement aux biens immobiliers situ\u00e9s dans <strong>une agglom\u00e9ration de plus de 50&nbsp;000 habitants<\/strong> et dans <strong>une commune marqu\u00e9e par un important d\u00e9s\u00e9quilibre<\/strong> entre l\u2019offre et la demande de logements. La liste de ces communes est dress\u00e9e par le d\u00e9cret n\u00b02013-392 du 10 mai 2013.<\/p>\n<p>Par ailleurs, pour \u00eatre soumis \u00e0 la taxe, le bien doit \u00eatre <strong>inoccup\u00e9 depuis 1&nbsp;an au moins<\/strong> au 1er&nbsp;janvier de l\u2019ann\u00e9e d\u2019imposition, soit au 1er&nbsp;janvier&nbsp;2021 pour la TLV 2021.<\/p>\n<p>Le logement concern\u00e9 est alors impos\u00e9 \u00e0 hauteur de <strong>12,5&nbsp;%<\/strong> de sa valeur locative s\u2019il s\u2019agit de la 1\u00e8re ann\u00e9e d\u2019imposition \u00e0 la TLV ou \u00e0 hauteur de <strong>25 %<\/strong> de sa valeur locative \u00e0 compter de la deuxi\u00e8me ann\u00e9e d\u2019imposition. Le montant de la taxe inclut, en outre, des frais de gestion.<\/p>\n<h3><strong>Taxe d&rsquo;habitation sur les logements vacants (THLV)<\/strong><\/h3>\n<p>En dehors des zones tendues fix\u00e9es par d\u00e9cret pour l\u2019application de la taxe annuelle sur les logements vacants, les biens immobiliers inoccup\u00e9s peuvent \u00eatre assujettis \u00e0 la <strong>taxe d&rsquo;habitation sur les logements vacants<\/strong> sur d\u00e9cision de la commune ou de l\u2019\u00e9tablissement public de coop\u00e9ration intercommunale (EPCI) prise dans le cadre de l\u2019article 1407 bis du Code g\u00e9n\u00e9ral des imp\u00f4ts.<\/p>\n<p>Pour \u00eatre \u00e9ligible \u00e0 la THLV, le logement doit \u00eatre <strong>inoccup\u00e9 depuis plus de 2 ans<\/strong> au 1er&nbsp;janvier de l\u2019ann\u00e9e d\u2019imposition, soit au minimum du 1er&nbsp;janvier&nbsp;2019 au 1er&nbsp;janvier&nbsp;2021 pour la THLV 2021.<\/p>\n<p>Le bien immobilier soumis \u00e0 la taxe d&rsquo;habitation sur les logements vacants se voit alors appliquer un taux identique \u00e0 celui de la taxe d&rsquo;habitation de la commune dans laquelle il est situ\u00e9, major\u00e9 d\u2019un \u00e9ventuel taux intercommunal ainsi que des frais de gestion.<\/p>\n<h2><strong>Conditions d\u2019application des taxes sur les logements vacants<\/strong><\/h2>\n<p>La taxe annuelle sur les logements vacants ou taxe d&rsquo;habitation sur les logements vacants s\u2019impose aux <strong>propri\u00e9taires<\/strong> ou aux <strong>usufruitiers<\/strong> d\u2019un logement <strong>\u00e0 usage d\u2019habitation non meubl\u00e9<\/strong>.<\/p>\n<p>Les <strong>r\u00e9sidences secondaires meubl\u00e9es<\/strong> assujetties au paiement de la taxe d&rsquo;habitation sont, de fait, exclues du champ d\u2019application des taxes sur les logements vacants.<\/p>\n<p>L\u2019avis d\u2019imposition \u00e0 la TLV ou THLV est adress\u00e9 au contribuable par les services fiscaux de mani\u00e8re automatique. Pourtant, certaines situations permettent d\u2019\u00e9chapper \u00e0 ces taxes.<\/p>\n<p>Ainsi, un logement ne peut \u00eatre estim\u00e9 vacant s\u2019il a \u00e9t\u00e9 lou\u00e9 ou habit\u00e9, y compris de fa\u00e7on temporaire, d\u00e8s lors que <strong>la p\u00e9riode d\u2019occupation<\/strong> constat\u00e9e au cours de l\u2019ann\u00e9e civile qui pr\u00e9c\u00e8de l\u2019ann\u00e9e d\u2019imposition est <strong>sup\u00e9rieure \u00e0 90 jours cons\u00e9cutifs<\/strong>.<\/p>\n<p>De m\u00eame, pour \u00eatre soumis \u00e0 l\u2019une des taxes sur les logements vacants, le bien concern\u00e9 doit correspondre \u00e0 <strong>un logement habitable<\/strong> disposant, par cons\u00e9quent, des \u00e9quipements n\u00e9cessaires pour assurer un confort minimum adapt\u00e9 \u00e0 son occupation, \u00e0 savoir l\u2019eau courante, une installation \u00e9lectrique et un \u00e9quipement sanitaire. Un logement ne peut donc \u00eatre consid\u00e9r\u00e9 comme habitable si la remise en \u00e9tat du bien n\u00e9cessite des travaux de r\u00e9fection ou d\u2019installation d\u2019\u00e9l\u00e9ments d\u2019une importance telle que <strong>le montant de ces travaux exc\u00e8de 25 % de la valeur du logement<\/strong>.<\/p>\n<p>Enfin, la taxe sur les logements vacants ou la taxe d&rsquo;habitation sur les logements vacants peut \u00e9galement \u00eatre remise en cause par le propri\u00e9taire ou usufruitier d\u2019un logement inoccup\u00e9 lorsque <strong>la situation de vacance du bien est ind\u00e9pendante de sa volont\u00e9<\/strong>.
