C\u2019est l\u2019histoire d\u2019une ex-\u00e9pouse qui rappelle la diff\u00e9rence entre un \u00ab revenu \u00bb et une \u00ab allocation \u00bb\u2026<\/h3>\n\n\n\n

Suite \u00e0 son divorce, une ex-\u00e9pouse obtient le versement d\u2019une prestation compensatoire destin\u00e9e \u00e0 corriger les disparit\u00e9s de vie entre les ex-\u00e9poux dues \u00e0 la rupture des liens du mariage. Elle d\u00e9cide cependant d\u2019en contester le montant, ind\u00fbment limit\u00e9 selon elle en raison des allocations familiales qu\u2019elle per\u00e7oit\u2026<\/p>\n\n\n\n

L\u2019objet du litige<\/h3>\n\n\n\n

\u2026Or, ces allocations sont destin\u00e9es aux seuls enfants du couple. D\u00e8s lors, s\u2019il est bien pr\u00e9vu que la prestation compensatoire soit limit\u00e9e en fonction des ressources de l\u2019\u00e9poux qui en b\u00e9n\u00e9ficie, il ne faut pas tenir compte des allocations familiales qu\u2019il per\u00e7oit pour appr\u00e9cier le niveau de ses ressources\u2026 puisqu\u2019elles ne sont pas destin\u00e9es \u00e0 lui procurer un revenu !<\/p>\n\n\n\n

Le verdict<\/h3>\n\n\n\n

Ce que confirme le juge : parce que les allocations familiales sont pour partie destin\u00e9es aux seuls enfants du couple, elles ne doivent pas \u00eatre prises en compte dans l\u2019appr\u00e9ciation des ressources de l\u2019ex-\u00e9pouse. Et ne peuvent donc pas limiter le montant de la prestation compensatoire qu\u2019elle doit donc percevoir\u2026<\/p>\n\n\n\n
