Un particulier confie un tableau \u00e0 une soci\u00e9t\u00e9. Il signe un contrat de d\u00e9p\u00f4t pr\u00e9voyant qu\u2019elle est tenue de l\u2019indemniser en cas de perte du tableau, sauf dans le cas o\u00f9 ce dernier fait l\u2019objet d\u2019une proc\u00e9dure de saisie judiciaire. Ce qui finit (malheureusement) par arriver\u2026<\/p>\n\n\n\n
\u2026Quelques ann\u00e9es apr\u00e8s cette saisie, puis la vente du tableau, la soci\u00e9t\u00e9 fait part de la situation au particulier. \u00ab Bien trop tard \u00bb, estime celui-ci, puisqu\u2019en tardant \u00e0 l\u2019informer de cette saisie judiciaire, la soci\u00e9t\u00e9 l\u2019a priv\u00e9, selon lui, de la possibilit\u00e9 de s\u2019y opposer, ce qui m\u00e9rite le versement d\u2019une indemnisation \u2026 \u00ab Non ! \u00bb, r\u00e9torque la soci\u00e9t\u00e9 : elle ne doit l\u2019indemniser que s\u2019il prouve que ses \u00e9ventuels recours contre la saisie et la vente du tableau auraient abouti. Ce qui n\u2019est (manifestement) pas le cas ici\u2026<\/p>\n\n\n\n
\u2026Ce que constate aussi le juge : pour obtenir l\u2019indemnisation r\u00e9clam\u00e9e, le particulier aurait d\u00fb prouver qu\u2019il aurait pu faire \u00e9chec \u00e0 la saisie et \u00e0 la vente du tableau. Ce qu\u2019il n\u2019\u00e9tablit pas ici\u2026<\/p>\n\n\n\n
