M\u00eame lorsque le recours \u00e0 un tel dispositif est l\u00e9gitime, les salari\u00e9s disposent de droits fondamentaux pour lutter contre les mesures de contr\u00f4le excessives.<\/p>\n<h2><strong>Quand la vid\u00e9osurveillance sur le lieu de travail est-elle autoris\u00e9e&nbsp;?<\/strong><\/h2>\n<p>L\u2019employeur b\u00e9n\u00e9ficie, du fait de son pouvoir de direction, d\u2019un <strong>droit de contr\u00f4le et de surveillance<\/strong> sur l&rsquo;activit\u00e9 de ses salari\u00e9s pendant leurs heures de travail. L\u2019exercice de ce droit est toutefois encadr\u00e9, de mani\u00e8re stricte, par des principes essentiels.<\/p>\n<h3><strong>La protection de la vie priv\u00e9e du salari\u00e9 (article 9 du Code civil)<\/strong><\/h3>\n<p>Lors de la mise en place du dispositif de t\u00e9l\u00e9surveillance, l\u2019employeur doit garantir aux salari\u00e9s le <strong>respect de leur vie priv\u00e9e<\/strong>, pendant et en dehors de leur temps de <a href=\"https:\/\/avoloi.eu\/blog\/travailler-le-dimanche-le-salarie-peut-il-refuser\/\">travail<\/a>, m\u00eame \u00e0 l\u2019int\u00e9rieur de l\u2019entreprise.<\/p>\n<h3><strong>La proportionnalit\u00e9 et la justification des mesures de contr\u00f4le (article L1121-1 du Code du travail)<\/strong><\/h3>\n<p>Le fait d\u2019\u00e9quiper un lieu de cam\u00e9ras de surveillance impacte n\u00e9cessairement les droits des personnes de m\u00eame que les libert\u00e9s individuelles et collectives. Pour \u00eatre <strong>licites<\/strong>, les <strong>restrictions apport\u00e9es par la vid\u00e9osurveillance<\/strong> aux libert\u00e9s et droits fondamentaux des salari\u00e9s doivent \u00eatre&nbsp;:<\/p>\n<ul>\n<li>\u00ab&nbsp;<strong><em>justifi\u00e9es<\/em><\/strong><em> par la nature de la t\u00e2che \u00e0 accomplir<\/em>&nbsp;\u00bb. L\u2019installation d\u2019un syst\u00e8me de vid\u00e9osurveillance des salari\u00e9s sur leur lieu de travail doit donc poursuivre un objectif l\u00e9gitime qui peut notamment \u00eatre motiv\u00e9 par la s\u00e9curit\u00e9 des personnes ou des biens, ou encore la lutte contre la concurrence d\u00e9loyale ou le vol&nbsp;;<\/li>\n<li>\u00ab&nbsp;<strong><em>proportionn\u00e9es<\/em><\/strong><em> au but recherch\u00e9<\/em>&nbsp;\u00bb. Le caract\u00e8re proportionn\u00e9 de la mesure de surveillance repose potentiellement sur le nombre de cam\u00e9ras plac\u00e9es dans le local, leur orientation, leur dur\u00e9e de fonctionnement et la pr\u00e9sence ou non d\u2019un \u00e9quipement audio.<\/li>\n<\/ul>\n<h2><strong>Quelles sont les limites concr\u00e8tes \u00e0 la t\u00e9l\u00e9surveillance ?<\/strong><\/h2>\n<p>La t\u00e9l\u00e9surveillance, justifi\u00e9e et proportionn\u00e9e, est consid\u00e9r\u00e9e comme un moyen de contr\u00f4le l\u00e9gitime au sein de l\u2019entreprise. L\u2019employeur est alors libre de filmer les voies d\u2019acc\u00e8s au b\u00e2timent, les entr\u00e9es, sorties et issues de secours de <a href=\"https:\/\/avoloi.eu\/blog\/travaux-destination-immeuble\/\">l\u2019immeuble<\/a>, ainsi que les zones d\u00e9di\u00e9es \u00e0 l\u2019entrep\u00f4t des marchandises ou des biens de valeur. En revanche, il est admis que les salles de pause ou de repos des salari\u00e9s, les sanitaires et les locaux syndicaux ne peuvent faire l\u2019objet d\u2019une vid\u00e9osurveillance.<\/p>\n<p>M\u00eame lorsque sa pr\u00e9sence est justifi\u00e9e, la surveillance exerc\u00e9e par l\u2019employeur par le biais de cam\u00e9ras ne doit \u00eatre <strong>ni g\u00e9n\u00e9rale ni permanente<\/strong>. La Commission nationale de l\u2019informatique et des libert\u00e9s (CNIL) pr\u00e9cise en ce sens que, sauf situations exceptionnelles, aucune cam\u00e9ra ne peut viser directement un salari\u00e9 sur son poste de travail. Pour ces m\u00eames raisons, il n\u2019est pas permis \u00e0 un employeur d\u2019imposer aux salari\u00e9s en t\u00e9l\u00e9travail une activation permanente de leur cam\u00e9ra.<\/p>\n<p>La surveillance globale d\u2019un local salari\u00e9 ou du passage des employ\u00e9s \u00e0 la pointeuse peut ainsi se r\u00e9v\u00e9ler litigieuse. R\u00e9cemment, dans un arr\u00eat du 23 juin 2021, la Cour de cassation a remis en cause le caract\u00e8re proportionn\u00e9 d\u2019une mesure de contr\u00f4le qui s\u2019exer\u00e7ait de mani\u00e8re constante par vid\u00e9osurveillance sur un salari\u00e9 seul en poste en cuisine.<\/p>\n<h2><strong>Quelles sont les obligations de l\u2019employeur lors de la mise en place d\u2019une vid\u00e9osurveillance&nbsp;?<\/strong><\/h2>\n<p>Dans un premier temps, l\u2019employeur a l\u2019obligation <strong>d\u2019informer et de consulter les repr\u00e9sentants du personnel<\/strong> sur tout projet d\u2019am\u00e9nagement d\u2019une surveillance de l\u2019entreprise par cam\u00e9ras.<\/p>\n<p>Si le lieu plac\u00e9 sous vid\u00e9osurveillance <strong>n\u2019est pas ouvert au public<\/strong> (tel des locaux r\u00e9serv\u00e9s au personnel) aucune d\u00e9marche particuli\u00e8re n\u2019est exig\u00e9e aupr\u00e8s de la CNIL. Dans le cas contraire, une autorisation pr\u00e9alable \u00e0 la mise en place du dispositif doit \u00eatre requise aupr\u00e8s du pr\u00e9fet du d\u00e9partement ou du pr\u00e9fet de police \u00e0 Paris.<\/p>\n<p>Le responsable ou le <strong>d\u00e9l\u00e9gu\u00e9 \u00e0 la protection des donn\u00e9es<\/strong> (DPO) collabore ensuite au processus de mise en place de la t\u00e9l\u00e9surveillance.<\/p>\n<p>Enfin, l\u2019existence de la t\u00e9l\u00e9surveillance, en tant que syst\u00e8me de contr\u00f4le sp\u00e9cifique, doit \u00eatre port\u00e9e <strong>\u00e0 la connaissance des salari\u00e9s<\/strong>. Cette information est r\u00e9alis\u00e9e au moyen d\u2019un affichage permanent dans les lieux soumis \u00e0 la surveillance. Chaque salari\u00e9 doit, en outre, \u00eatre averti de l\u2019installation du syst\u00e8me \u00e0 titre individuel \u00e0 moins que les cam\u00e9ras ne soient plac\u00e9es dans un endroit non fr\u00e9quent\u00e9 par les employ\u00e9s.<\/p>\n<h2><strong>Comment les images des cam\u00e9ras sont-elles exploit\u00e9es&nbsp;?<\/strong><\/h2>\n<p>Les images enregistr\u00e9es sont visionnables uniquement par l\u2019employeur, ou toute autre personne qu\u2019il a habilit\u00e9e \u00e0 cet effet, en veillant au respect du traitement des donn\u00e9es personnelles et de la vie priv\u00e9e des salari\u00e9s. La consultation \u00e0 distance de ces images n\u2019est autoris\u00e9e qu\u2019au moyen d\u2019un acc\u00e8s s\u00e9curis\u00e9.<\/p>\n<p>L\u2019employeur fixe la dur\u00e9e de conservation de ces images qui est, en moyenne, d\u2019un mois maximum. Toutefois, lorsqu\u2019elles pr\u00e9sentent un int\u00e9r\u00eat dans le cadre d\u2019une v\u00e9rification suite \u00e0 un incident, les images peuvent \u00eatre extraites de l\u2019enregistrement pour \u00eatre conserv\u00e9es plus longtemps.
