La date butoir pour adapter le document aux nouvelles dispositions est initialement fix\u00e9e au 24 novembre 2021. Quelles seraient, pass\u00e9 le d\u00e9lai l\u00e9gal, les incidences sur les droits des copropri\u00e9taires en cas de non-respect de cette obligation&nbsp;?<\/p>\n<h2><strong>Les copropri\u00e9t\u00e9s concern\u00e9es par la mise en conformit\u00e9<\/strong><\/h2>\n<p>Le r\u00e8glement de copropri\u00e9t\u00e9 d\u00e9finit les r\u00e8gles de vie au sein de la <a href=\"https:\/\/avoloi.eu\/blog\/coproprietes-assemblees-dematerialisees-et-report-de-dates\/\">copropri\u00e9t\u00e9<\/a>. Y figurent ainsi les droits et obligations des copropri\u00e9taires en lien avec l\u2019usage des parties communes et privatives de l\u2019immeuble.<\/p>\n<p>En obligeant l\u2019inscription des parties communes particuli\u00e8res et des lots transitoires dans le r\u00e8glement de copropri\u00e9t\u00e9, la loi ELAN offre la possibilit\u00e9 aux copropri\u00e9taires de <strong>r\u00e9gulariser l\u2019existence de droits et obligations cr\u00e9\u00e9s de fait<\/strong> au sein de la copropri\u00e9t\u00e9.<\/p>\n<p>Trois cas de figure consacr\u00e9s par la jurisprudence sont principalement vis\u00e9s&nbsp;:<\/p>\n<ul>\n<li>les <strong>parties communes sp\u00e9ciales<\/strong>;<\/li>\n<li>les <strong>parties communes \u00e0 droit de jouissance privative&nbsp;<\/strong>;<\/li>\n<li>et les <strong>lots transitoires<\/strong>.<\/li>\n<\/ul>\n<p>Les copropri\u00e9taires d\u2019immeubles sans parties communes particuli\u00e8res ou sans lots transitoires ne sont donc naturellement pas concern\u00e9s par l\u2019exigence de mise en conformit\u00e9 du r\u00e8glement de copropri\u00e9t\u00e9 de la loi ELAN.<\/p>\n<h2><strong>Le d\u00e9faut de mise en conformit\u00e9 et ses cons\u00e9quences sur les droits des copropri\u00e9taires<\/strong><\/h2>\n<p>Quelle que soit la situation des copropri\u00e9taires, les r\u00e9percussions sur leurs droits en l\u2019absence de mise en conformit\u00e9 du r\u00e8glement de copropri\u00e9t\u00e9 dans le d\u00e9lai imparti par la loi ELAN sont cons\u00e9quentes.<\/p>\n<h3><strong>La non-inscription des parties communes sp\u00e9ciales ou des charges aff\u00e9rentes dans le r\u00e8glement de copropri\u00e9t\u00e9<\/strong><\/h3>\n<p>La particularit\u00e9 des <strong>parties communes sp\u00e9ciales<\/strong> d\u2019un b\u00e2timent est que leur acc\u00e8s est r\u00e9serv\u00e9 aux seuls copropri\u00e9taires d\u00e9tenteurs d\u2019une quote-part de ces parties communes.<\/p>\n<p>La loi ELAN impose au r\u00e8glement de copropri\u00e9t\u00e9 non seulement d\u2019<strong>identifier les parties communes sp\u00e9ciales<\/strong>, mais \u00e9galement de <strong>pr\u00e9ciser les charges sp\u00e9ciales aff\u00e9rentes<\/strong> \u00e0 ces parties. D\u00e8s lors, en l\u2019absence de mention dans le r\u00e8glement de copropri\u00e9t\u00e9 de l\u2019un de ces deux \u00e9l\u00e9ments, les parties communes sp\u00e9ciales <strong>perdront leur existence<\/strong>.<\/p>\n<p>Les charges li\u00e9es aux parties communes sp\u00e9ciales seront alors <strong>support\u00e9es par l\u2019ensemble des copropri\u00e9taires<\/strong> m\u00eame s\u2019ils ne peuvent b\u00e9n\u00e9ficier d\u2019un acc\u00e8s \u00e0 ces lieux. La disparition des parties communes sp\u00e9ciales a pour autre cons\u00e9quence de <strong>donner \u00e0 tous les copropri\u00e9taires la possibilit\u00e9 de prendre part au vote<\/strong> sur les d\u00e9cisions d\u2019assembl\u00e9e g\u00e9n\u00e9rale relatives \u00e0 la gestion de ces parties, et non plus seulement aux copropri\u00e9taires qui en b\u00e9n\u00e9ficient.<\/p>\n<h3><strong>L\u2019absence des droits de jouissance privative dans le r\u00e8glement de copropri\u00e9t\u00e9<\/strong><\/h3>\n<p>Les <strong>parties communes \u00e0 jouissance privative<\/strong> constituent la propri\u00e9t\u00e9 indivise de tous les copropri\u00e9taires. Attach\u00e9es \u00e0 un lot de copropri\u00e9t\u00e9, elles sont pour autant r\u00e9serv\u00e9es \u00e0 l\u2019usage exclusif d\u2019un ou plusieurs copropri\u00e9taires de fa\u00e7on temporaire ou permanente.<\/p>\n<p>Les droits de jouissance privative sont g\u00e9n\u00e9ralement octroy\u00e9s par un vote \u00e0 l\u2019assembl\u00e9e g\u00e9n\u00e9rale ou mentionn\u00e9s dans l\u2019\u00e9tat descriptif de division. D\u00e9sormais, ces droits doivent \u00eatre inscrits dans le r\u00e8glement de copropri\u00e9t\u00e9. \u00c0 d\u00e9faut d\u2019une telle mention, ils seront <strong>d\u00e9pourvus de toute existence l\u00e9gale<\/strong>.<\/p>\n<p>Ainsi d\u00e9poss\u00e9d\u00e9s de leurs droits de jouissance privative sur les parties communes, les copropri\u00e9taires concern\u00e9s ne pourront plus, d\u00e8s lors, les transmettre aux futurs acqu\u00e9reurs de leurs lots.<\/p>\n<h3><strong>L\u2019insuffisance de d\u00e9finition du lot transitoire dans le r\u00e8glement de copropri\u00e9t\u00e9<\/strong><\/h3>\n<p>Dans le cadre d\u2019un programme de construction par tranches successives, le lot transitoire correspond \u00e0 un terrain \u00e0 b\u00e2tir. Il est toutefois, compos\u00e9 d\u2019une partie privative et d\u2019une quote-part des parties communes.<\/p>\n<p>La loi ELAN oblige \u00e0 mentionner et \u00e0 <strong>d\u00e9finir de mani\u00e8re pr\u00e9cise<\/strong> dans le r\u00e8glement de copropri\u00e9t\u00e9 <strong>la cr\u00e9ation des lots transitoires<\/strong> ainsi que <strong>les droits \u00e0 construire<\/strong> de leurs titulaires.<\/p>\n<p>En cas d\u2019insuffisance de mention dans le r\u00e8glement de copropri\u00e9t\u00e9 \u00e0 la date requise, le titulaire d\u2019un lot transitoire devra solliciter pour la r\u00e9alisation de son projet une autorisation du syndicat <strong>\u00e0 une majorit\u00e9 plus forte<\/strong> que celle pr\u00e9vue dans le cadre de la mise en conformit\u00e9 du r\u00e8glement. Il prendrait alors le risque d\u2019un refus de l\u2019assembl\u00e9e et renoncerait, dans l\u2019attente, \u00e0 ses droits de copropri\u00e9taire.<\/p>\n<h2><strong>Le retard dans la mise en conformit\u00e9 du r\u00e8glement de copropri\u00e9t\u00e9 et ses implications<\/strong><\/h2>\n<p>La mise en conformit\u00e9 du r\u00e8glement de copropri\u00e9t\u00e9 permet aux copropri\u00e9taires de conserver les droits qui leur ont \u00e9t\u00e9 accord\u00e9s au sein de la copropri\u00e9t\u00e9. Tout retard dans cette mise en conformit\u00e9 serait donc de nature \u00e0 <strong>remettre en question ces droits<\/strong> ce qui <strong>perturberait les r\u00e8gles de la copropri\u00e9t\u00e9<\/strong> en mati\u00e8re d\u2019entretien, de paiement des charges et de mise en jeu des responsabilit\u00e9s.<\/p>\n<p>Pour faciliter l\u2019adaptation du r\u00e8glement de copropri\u00e9t\u00e9 aux nouvelles dispositions de la loi ELAN, les d\u00e9cisions relatives \u00e0 ces modifications sont adopt\u00e9es \u00e0 la majorit\u00e9 des voix des copropri\u00e9taires pr\u00e9sents ou repr\u00e9sent\u00e9s. En revanche, pass\u00e9 le d\u00e9lai pr\u00e9vu par la loi, toute modification du r\u00e8glement de copropri\u00e9t\u00e9 relative \u00e0 ces questions exigera <strong>une majorit\u00e9 bien plus \u00e9lev\u00e9e <\/strong>pour son adoption.
