Suite au prononc\u00e9 du divorce, l\u2019ex-\u00e9poux continue d\u2019occuper, seul, un bien d\u00e9tenu en indivision par le couple et se voit donc contraint de r\u00e9gler la taxe d\u2019habitation pour ce logement\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">L\u2019objet du litige<\/h3>\n\n\n\n<p>Montant dont il r\u00e9clame le remboursement partiel \u00e0 son ex-\u00e9pouse puisque, selon lui, le r\u00e8glement de la taxe d\u2019habitation d\u2019un immeuble indivis est une d\u00e9pense visant \u00e0 en assurer la conservation, qui doit donc \u00eatre support\u00e9e par tous les co\u00efndivisaires. \u00ab&nbsp;Faux&nbsp;\u00bb, r\u00e9torque l\u2019ex-\u00e9pouse pour qui le paiement de cette taxe incombe \u00e0 la seule personne qui occupe le logement. Occupation privative d\u00e9j\u00e0 compens\u00e9e par le paiement d\u2019une indemnit\u00e9 pr\u00e9vue dans le cadre du divorce, souligne l\u2019ex-\u00e9poux qui maintient donc sa demande de remboursement\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Le verdict<\/h3>\n\n\n\n<p>\u00ab&nbsp;Et \u00e0 raison&nbsp;\u00bb, pour le juge&nbsp;: parce que le paiement de la taxe d\u2019habitation d\u2019un immeuble d\u00e9tenu en indivision permet d\u2019en assurer la conservation, c\u2019est une d\u00e9pense commune \u00e0 tous les propri\u00e9taires indivis du bien.
