Cette garantie s\u2019\u00e9tend en effet au vendeur particulier d\u2019un bien immobilier r\u00e9cent ou ayant subi d\u2019importants travaux d\u2019agrandissement ou de r\u00e9novation d\u00e8s lors qu\u2019il en est le ma\u00eetre d\u2019ouvrage. C\u2019est le principe que vient de rappeler la Cour de cassation dans un arr\u00eat du 1er&nbsp;avril&nbsp;2021.<\/p>\n<h2><strong>Qu\u2019est-ce que la responsabilit\u00e9 d\u00e9cennale du vendeur particulier&nbsp;?<\/strong><\/h2>\n<p>Il est courant d\u2019\u00e9voquer la responsabilit\u00e9 d\u00e9cennale des <a href=\"https:\/\/avoloi.eu\/blog\/retard-construction-penalites\/\">constructeurs<\/a> professionnels qui interviennent \u00e0 l\u2019occasion de la construction d\u2019un ouvrage ou de travaux de r\u00e9novation de grande ampleur. Des risques de mise en jeu de la responsabilit\u00e9 du propri\u00e9taire particulier en cas de revente d\u2019un bien immobilier r\u00e9cent ou r\u00e9nov\u00e9, bien que moins connus, existent pourtant au titre de cette m\u00eame garantie.<\/p>\n<h3><strong>La notion de garantie d\u00e9cennale<\/strong><\/h3>\n<p>La garantie d\u00e9cennale est d\u00e9finie \u00e0 <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006443502\/\" target=\"_blank\" rel=\"noopener\">l\u2019article 1792 du Code civil<\/a>. Elle a pour but d\u2019engager <strong>la responsabilit\u00e9 du constructeur d\u2019un ouvrage<\/strong> lorsque des d\u00e9sordres sont constat\u00e9s, apr\u00e8s ach\u00e8vement des travaux, dans la r\u00e9alisation de l\u2019ouvrage en question.<\/p>\n<p>Ce r\u00e9gime sp\u00e9cial de garantie concerne aussi bien les constructions neuves que les travaux importants de r\u00e9novation, qu\u2019ils aient \u00e9t\u00e9 r\u00e9alis\u00e9s par le propri\u00e9taire lui-m\u00eame ou par l\u2019interm\u00e9diaire de professionnels.<\/p>\n<p>La responsabilit\u00e9 d\u00e9cennale est donc destin\u00e9e \u00e0 s\u2019appliquer en pr\u00e9sence de vices suffisamment graves, soit pour remettre en cause <strong>la solidit\u00e9 de l\u2019ouvrage<\/strong>, soit pour rendre celui-ci <strong>impropre \u00e0 sa destination<\/strong> en affectant un \u00e9l\u00e9ment constitutif du b\u00e2timent (tel que ses fondations, ses murs ou sa toiture) ou l\u2019un de ses \u00e9l\u00e9ments d\u2019\u00e9quipement (huisserie des fen\u00eatres, chaudi\u00e8re, etc.).<\/p>\n<h3><strong>Le sort de la garantie d\u00e9cennale en cas de revente du bien immobilier<\/strong><\/h3>\n<p>La responsabilit\u00e9 d\u00e9cennale du constructeur peut \u00eatre engag\u00e9e dans un d\u00e9lai de 10 ans suivant la r\u00e9ception des travaux. En cas de vente du bien <a href=\"https:\/\/avoloi.eu\/blog\/vente-immobiliere-clause-suspensive\/\">immobilier<\/a>, le nouvel acqu\u00e9reur peut b\u00e9n\u00e9ficier des garanties d\u00e9cennales encore en cours au moment de la transaction.<\/p>\n<p>Le <strong>transfert de ces garanties<\/strong> s\u2019op\u00e8re de fa\u00e7on automatique au profit des propri\u00e9taires successifs de l\u2019immeuble jusqu\u2019\u00e0 expiration de leur d\u00e9lai.<\/p>\n<p>En g\u00e9n\u00e9ral, la responsabilit\u00e9 d\u00e9cennale incombe aux constructeurs professionnels participant aux travaux de construction ou d\u2019am\u00e9lioration du b\u00e2timent.<\/p>\n<p>Toutefois, pour une meilleure protection de l\u2019acqu\u00e9reur, l\u2019article 1792-1 2\u00b0 du Code civil consid\u00e8re <strong>le vendeur particulier du bien immobilier<\/strong> comme le constructeur de l\u2019ouvrage s\u2019il a effectu\u00e9 lui-m\u00eame ou fait effectuer les travaux. La r\u00e9paration des d\u00e9sordres constat\u00e9s apr\u00e8s la vente peut alors \u00eatre r\u00e9clam\u00e9e aupr\u00e8s du pr\u00e9c\u00e9dent propri\u00e9taire.<\/p>\n<h2><strong>Comment s\u00e9curiser la vente d\u2019un bien immobilier soumis \u00e0 la garantie d\u00e9cennale&nbsp;?<\/strong><\/h2>\n<p>En sa qualit\u00e9 de ma\u00eetre d\u2019ouvrage, le vendeur particulier est tenu \u00e0 la garantie d\u00e9cennale \u00e0 l\u2019\u00e9gard de l\u2019acqu\u00e9reur en raison de la revente de son bien immobilier. Le non-respect de cette obligation peut entra\u00eener l\u2019annulation de la vente.<\/p>\n<h3><strong>La mise en jeu de la garantie d\u00e9cennale<\/strong><\/h3>\n<p>Dans le cadre d\u2019un projet de vente d\u2019un bien encore couvert par la garantie d\u00e9cennale, le vendeur particulier qui a construit ou fait construire tout ou partie de l\u2019immeuble mis \u00e0 la vente a l\u2019obligation de souscrire <strong>une assurance dommages-ouvrage<\/strong>. Cette assurance, \u00e9galement souscrite au profit des futurs acqu\u00e9reurs, permet de les pr\u00e9munir en cas de d\u00e9faut dans la construction contre tout risque d\u2019insolvabilit\u00e9 du vendeur pour le temps restant \u00e0 courir de la garantie l\u00e9gale.<\/p>\n<p>Les r\u00e9f\u00e9rences du <a href=\"https:\/\/avoloi.eu\/blog\/souscrire-assurance-distance\/\">contrat d\u2019assurance<\/a> sont port\u00e9es \u00e0 la connaissance de l\u2019acqu\u00e9reur dans l\u2019acte de vente. Ainsi, le nouveau propri\u00e9taire qui constate un vice de nature d\u00e9cennale adresse une d\u00e9claration de sinistre \u00e0 la compagnie d\u2019assurance afin d\u2019obtenir rapidement l\u2019indemnisation correspondant au montant des r\u00e9parations. Il appartient \u00e0 l\u2019assureur de rechercher ensuite le ou les constructeurs responsables du vice.<\/p>\n<h3><strong>Une garantie d\u2019ordre public<\/strong><\/h3>\n<p>Le r\u00e9gime de la responsabilit\u00e9 d\u00e9cennale est d\u2019ordre public. Aucune clause de l\u2019acte de vente ne peut donc organiser la suppression ou la limitation de la garantie l\u00e9gale au d\u00e9triment de l\u2019acheteur. Dans le cas contraire, la clause serait consid\u00e9r\u00e9e comme <strong>non \u00e9crite<\/strong>.<\/p>\n<p>De m\u00eame, le consentement du futur propri\u00e9taire \u00e0 acqu\u00e9rir le bien en d\u00e9pit de la mention d\u2019un dysfonctionnement qui rendrait l\u2019ouvrage impropre \u00e0 son usage dans l\u2019acte notari\u00e9 ne peut le priver d\u2019une possible mise en jeu de la responsabilit\u00e9 d\u00e9cennale du constructeur.<\/p>\n<p>Pourtant, du fait de son co\u00fbt relativement important, nombre de vendeurs particuliers renoncent \u00e0 la souscription du contrat d\u2019assurance et s\u2019exposent \u00e0 de lourds risques financiers, notamment en cas de liquidation de <a href=\"https:\/\/avoloi.eu\/blog\/reglementation-click-collect\/\">l\u2019entreprise<\/a> mandat\u00e9e pour la r\u00e9alisation des travaux. Le nouveau propri\u00e9taire peut en effet engager la responsabilit\u00e9 du vendeur, ma\u00eetre de l\u2019ouvrage, en vue d\u2019obtenir la r\u00e9paration de son pr\u00e9judice.
