C\u2019est l\u2019histoire d\u2019une maison, de 3 fr\u00e8res et s\u0153urs\u2026 et d\u2019une taxe d\u2019habitation\u2026<\/h3>\n\n\n\n

Au d\u00e9c\u00e8s de leur m\u00e8re, 3 fr\u00e8res et s\u0153urs se retrouvent propri\u00e9taires \u00ab indivisaires \u00bb de sa maison. Mais \u00e0 la r\u00e9ception de la taxe d\u2019habitation due pour celle-ci, 2 d\u2019entre eux refusent de la payer\u2026<\/p>\n\n\n\n

L\u2019objet du litige<\/h3>\n\n\n\n

\u00ab Logique \u00bb, estiment-ils puisque seul leur 3 e fr\u00e8re occupe la maison. Ce qui le rend, selon eux, seul responsable du paiement de cette taxe\u2026 \u00ab Faux ! \u00bb, r\u00e9torque l\u2019int\u00e9ress\u00e9 qui rappelle que son occupation privative de la maison est d\u00e9j\u00e0 compens\u00e9e par le paiement d\u2019une indemnit\u00e9 sp\u00e9cifique et qu\u2019elle n\u2019a donc rien \u00e0 voir avec le paiement de la taxe d\u2019habitation, qui doit, selon lui, \u00eatre r\u00e9gl\u00e9e par tous les propri\u00e9taires du bien.<\/p>\n\n\n\n

Le verdict<\/h3>\n\n\n\n

Ce que confirme le juge qui rappelle que le paiement de la taxe d\u2019habitation permet de conserver la maison en l\u2019\u00e9tat. Parce qu\u2019elle constitue donc une d\u00e9pense faite dans l\u2019int\u00e9r\u00eat de tous, elle doit \u00eatre prise en charge par tous les propri\u00e9taires indivisaires, proportionnellement \u00e0 leurs droits dans l\u2019indivision. Tous les fr\u00e8res et s\u0153urs doivent donc s\u2019en acquitter\u2026<\/p>\n\n\n\n
