Au d\u00e9c\u00e8s de son p\u00e8re, elle devient propri\u00e9taire du logement en indivision avec sa m\u00e8re\u2026 mais aussi avec son fr\u00e8re&nbsp;! Et ce dernier r\u00e9clame une hausse de loyer\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">L\u2019objet du litige<\/h3>\n\n\n\n<p>\u2026 puisque le montant vers\u00e9 par sa s\u0153ur s\u2019av\u00e8re nettement inf\u00e9rieur \u00e0 la valeur locative du bien. Or, rappelle-t-il, tout indivisaire qui utilise l\u2019immeuble indivis de mani\u00e8re privative est redevable d\u2019une indemnit\u00e9 d\u2019occupation \u00e0 l\u2019\u00e9gard des autres indivisaires. Ce qui est le cas de sa s\u0153ur ici, selon lui\u2026 \u00ab&nbsp;Justement non&nbsp;\u00bb, r\u00e9torque celle-ci qui rappelle que le bail verbal conclu avec ses parents lui donne la qualit\u00e9 de locataire du bien\u2026 Ce qui change tout\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Le verdict<\/h3>\n\n\n\n<p>Ce que confirme le juge&nbsp;: l\u2019h\u00e9riti\u00e8re, qui loue le bien, n\u2019est redevable que du montant du loyer fix\u00e9 dans le cadre du bail.
