Malgr\u00e9 leur demande, le voisin ne fait rien&nbsp;: m\u00e9contents, ils d\u00e9cident de saisir le juge afin de le contraindre \u00e0 \u00e9laguer cette haie\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">L\u2019objet du litige<\/h3>\n\n\n\n<p>\u00ab&nbsp;Demande irrecevable&nbsp;\u00bb, selon le voisin&nbsp;: la parcelle en question n\u2019est pas d\u00e9tenue par 2, mais par 3 copropri\u00e9taires&nbsp;; or, le 3 e copropri\u00e9taire ne s\u2019est pas joint \u00e0 la demande, ce qui constitue pourtant une obligation sauf \u00e0 prouver que la parcelle est menac\u00e9e par un p\u00e9ril quelconque. Ce qui n\u2019est pas le cas ici&nbsp;! \u00ab&nbsp;Faux&nbsp;\u00bb, r\u00e9torquent les 2 copropri\u00e9taires qui s\u2019estiment parfaitement l\u00e9gitimes \u00e0 demander, seuls, l\u2019\u00e9lagage de la haie\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Le verdict<\/h3>\n\n\n\n<p>A raison, tranche le juge qui rappelle que l\u2019action en \u00e9lagage forc\u00e9, qui vise \u00e0 pr\u00e9server la parcelle d\u00e9tenue en indivision, peut \u00eatre exerc\u00e9e par 1 seul copropri\u00e9taire ou 2 d\u2019entre eux seulement sans le consentement du 3 e .
