La demande ne peut \u00eatre faite que sous certaines conditions et la proc\u00e9dure est tr\u00e8s encadr\u00e9e. Si malgr\u00e9 le respect des formalit\u00e9s, le locataire refuse de partir du logement au terme du d\u00e9lai pr\u00e9vu, des solutions existent.<\/p>\n<h2><strong>Dans quelles situations un propri\u00e9taire peut-il donner cong\u00e9 ?<\/strong><\/h2>\n<p>Un propri\u00e9taire ne peut pas donner cong\u00e9 d\u00e8s qu&rsquo;il le souhaite. Cette proc\u00e9dure est <a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F929\" target=\"_blank\" rel=\"noopener\">tr\u00e8s encadr\u00e9e par la loi<\/a>. Seules trois raisons permettent de demander le d\u00e9part d&rsquo;un locataire.<\/p>\n<h3><strong>La vente du logement<\/strong><\/h3>\n<p>Si le propri\u00e9taire souhaite vendre son logement, il peut donner cong\u00e9 au locataire. Toutefois, cette lettre de cong\u00e9 vaut aussi comme offre de vente. Le locataire b\u00e9n\u00e9ficie d\u2019un droit de pr\u00e9emption pour devenir propri\u00e9taire du logement dans ce cas.<\/p>\n<h3><strong>La reprise personnelle du logement<\/strong><\/h3>\n<p>Si le propri\u00e9taire d\u00e9cide de reprendre le logement pour en faire sa r\u00e9sidence principale, il peut donner cong\u00e9 au locataire actuel. C&rsquo;est \u00e9galement le cas s&rsquo;il souhaite qu&rsquo;un parent proche reprenne le <a href=\"https:\/\/avoloi.eu\/blog\/tag\/logement\/\">logement<\/a> pour en faire sa r\u00e9sidence principale. Un parent proche ne peut \u00eatre qu&rsquo;un \u00e9poux, partenaire de PACS, concubin depuis au moins un an, ascendant ou descendant du propri\u00e9taire.<\/p>\n<h3><strong>Un motif l\u00e9gitime et s\u00e9rieux<\/strong><\/h3>\n<p>Le motif l\u00e9gitime et s\u00e9rieux n&rsquo;est pas strictement encadr\u00e9 par la l\u00e9gislation. Toutefois, tout manquement du locataire \u00e0 ses obligations est consid\u00e9r\u00e9 comme une raison valable de donner cong\u00e9. C&rsquo;est le cas si le loyer n&rsquo;est pas pay\u00e9 ou que les retards de r\u00e8glement sont r\u00e9p\u00e9titifs. Des nuisances de voisinage av\u00e9r\u00e9es peuvent aussi \u00eatre un motif suffisant.<\/p>\n<h2><strong>Peut-on donner cong\u00e9 \u00e0 tous les types de locataires ?<\/strong><\/h2>\n<p>Il est possible de donner un cong\u00e9 \u00e0 la majorit\u00e9 des locataires mais certains d&rsquo;entre eux sont prot\u00e9g\u00e9s par la loi. Des formalit\u00e9s suppl\u00e9mentaires doivent \u00eatre respect\u00e9es pour entrer dans le cadre l\u00e9gal. La loi qui r\u00e9glemente les baux d&rsquo;habitation en location nue pr\u00e9cise qu&rsquo;on ne peut donner cong\u00e9 \u00e0 des <a href=\"https:\/\/avoloi.eu\/blog\/tag\/locataire\/\">locataires<\/a> \u00e2g\u00e9s de plus de 65 ans et aux personnes dont les ressources sont inf\u00e9rieures \u00e0 une fois et demie le montant annuel du SMIC.<\/p>\n<p>Toutefois, des exceptions \u00e0 cette r\u00e8gle existent. Pour donner cong\u00e9 \u00e0 ces locataires, le propri\u00e9taire doit leur proposer une solution de logement aux caract\u00e9ristiques similaires et non loin de l&rsquo;habitation qu&rsquo;ils occupent.<\/p>\n<h2><strong>Quelle est la proc\u00e9dure \u00e0 respecter pour donner cong\u00e9 au locataire ?<\/strong><\/h2>\n<p>Quelle que soit la raison pour laquelle le propri\u00e9taire donne cong\u00e9, il doit respecter des formalit\u00e9s strictes. L&rsquo;envoi d&rsquo;une demande de cong\u00e9 doit respecter les conditions suivantes :<\/p>\n<ul>\n<li>la lettre doit contenir le motif du cong\u00e9 et les \u00e9l\u00e9ments annexes sp\u00e9cifiques \u00e0 chaque raison ;<\/li>\n<li>la lettre doit \u00eatre envoy\u00e9e en recommand\u00e9 avec accus\u00e9 de r\u00e9ception ou par acte d&rsquo;huissier ;<\/li>\n<li>elle doit \u00eatre envoy\u00e9e au moins six mois avant la date de la fin du bail ;<\/li>\n<li>une lettre doit \u00eatre adress\u00e9e \u00e0 chacun des signataires du bail ;<\/li>\n<li>la lettre a \u00e9t\u00e9 envoy\u00e9e \u00e0 un locataire prot\u00e9g\u00e9.<\/li>\n<\/ul>\n<p>Si l&rsquo;une de ces conditions n&rsquo;est pas respect\u00e9e, le locataire peut refuser de quitter le logement et contester la proc\u00e9dure.<\/p>\n<h2><strong>Que faire si le locataire refuse de partir ?<\/strong><\/h2>\n<p>Si malgr\u00e9 le respect de toutes les proc\u00e9dures, le locataire refuse de quitter le logement, il est consid\u00e9r\u00e9 comme un \u00ab\u00a0occupant sans droit ni titre\u00a0\u00bb. Pour r\u00e9gulariser la situation, le propri\u00e9taire doit saisir le tribunal d&rsquo;instance dont d\u00e9pend la ville o\u00f9 se situe l&rsquo;habitation. A la fin de la proc\u00e9dure, le juge d\u00e9cidera de la validit\u00e9 du cong\u00e9. Si ce dernier est consid\u00e9r\u00e9 valide, il proc\u00e9dera \u00e0 l&rsquo;expulsion.<\/p>\n<p>Le recours \u00e0 un avocat n&rsquo;est pas n\u00e9cessaire au tribunal d&rsquo;instance. Toutefois, face \u00e0 la complexit\u00e9 des r\u00e9glementations li\u00e9es au droit immobilier, un avocat sp\u00e9cialis\u00e9 peut se montrer tr\u00e8s utile pour acc\u00e9l\u00e9rer la proc\u00e9dure.<\/p>\n<h3><strong>Quelles sont les sanctions possibles ?<\/strong><\/h3>\n<p>Les sanctions d\u00e9pendent des conclusions du juge au tribunal d&rsquo;instance. Si le cong\u00e9 est d\u00e9clar\u00e9 nul et non avenu au terme de la proc\u00e9dure, le locataire conserve le droit d&rsquo;occuper le logement jusqu&rsquo;au terme du bail ou de sa reconduction.<\/p>\n<p>Si les formalit\u00e9s ont \u00e9t\u00e9 respect\u00e9es par le propri\u00e9taire, l&rsquo;expulsion est prononc\u00e9e. En cas de loyers impay\u00e9s, le juge peut ordonner le paiement d&rsquo;une indemnit\u00e9 \u00e9quivalente aux mois de loyers non honor\u00e9s. Le bailleur a \u00e9galement le droit de demander des dommages et int\u00e9r\u00eats.<\/p>\n<h3><strong>Comment se d\u00e9roule la proc\u00e9dure d&rsquo;expulsion ?<\/strong><\/h3>\n<p>Une fois le jugement prononc\u00e9, le propri\u00e9taire doit envoyer une notification par voie d&rsquo;huissier. Le locataire dispose d&rsquo;un d\u00e9lai d&rsquo;un mois pour faire appel, ce qui suspend l&rsquo;ex\u00e9cution de la d\u00e9cision. Si aucun recours n&rsquo;a \u00e9t\u00e9 demand\u00e9, le jugement est d\u00e9finitif et un huissier envoie un commandement de quitter les lieux.<\/p>\n<p>Apr\u00e8s r\u00e9ception de la lettre, le locataire dispose d&rsquo;un d\u00e9lai de deux mois pour quitter les lieux, qui peut \u00eatre prolong\u00e9 \u00e0 trois mois par d\u00e9cision de justice.
