{"id":21737,"date":"2021-06-17T11:14:00","date_gmt":"2021-06-17T09:14:00","guid":{"rendered":"https:\/\/avoloi.eu\/blog\/?p=21737"},"modified":"2021-06-17T11:14:00","modified_gmt":"2021-06-17T09:14:00","slug":"larret-du-jour-250-comment-devenir-avocat-sans-diplome-ou-pas","status":"publish","type":"post","link":"https:\/\/avoloi.fr\/blog\/larret-du-jour-250-comment-devenir-avocat-sans-diplome-ou-pas\/","title":{"rendered":"L&rsquo;arr\u00eat du jour #250 Comment devenir avocat sans dipl\u00f4me\u2026 ou pas !"},"content":{"rendered":"\n<p><\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">C\u2019est l\u2019histoire d\u2019une fonctionnaire europ\u00e9enne qui fait valoir son exp\u00e9rience pour devenir avocate\u2026<\/h3>\n\n\n\n<p>Une fonctionnaire fait valoir son exp\u00e9rience professionnelle au sein de la Commission europ\u00e9enne pour demander son inscription au barreau des avocats de Paris sans avoir \u00e0 suivre une formation initiale. \u00ab&nbsp;Non&nbsp;\u00bb, r\u00e9pond le b\u00e2tonnier qui la consid\u00e8re trop inexp\u00e9riment\u00e9e en droit fran\u00e7ais\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">L\u2019objet du litige<\/h3>\n\n\n\n<p>\u00ab&nbsp;Quelle inexp\u00e9rience&nbsp;?&nbsp;\u00bb, s\u2019indigne la fonctionnaire qui rappelle que le droit europ\u00e9en s\u2019applique en France, ce qui la rend parfaitement apte \u00e0 l\u2019exercice du droit national et justifie le bien-fond\u00e9 de sa demande. \u00ab&nbsp;Non&nbsp;\u00bb, persiste le b\u00e2tonnier pour qui la fonctionnaire europ\u00e9enne ne justifie d\u2019aucune pratique du droit fran\u00e7ais qui, m\u00eame s\u2019il comporte de nombreuses r\u00e8gles europ\u00e9ennes, ne se limite pas \u00e0 celles-ci et conserve une sp\u00e9cificit\u00e9 propre.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Le verdict<\/h3>\n\n\n\n<p>Sp\u00e9cificit\u00e9 nationale que confirme le juge, qui consid\u00e8re par cons\u00e9quent que faute de la ma\u00eetriser, la fonctionnaire ne peut pas b\u00e9n\u00e9ficier du dispositif d\u00e9rogatoire \u00e0 l\u2019exercice de la profession d\u2019avocat.
