Il est \u00e9galement possible de modifier un immeuble d\u2019habitation afin d\u2019y accueillir une activit\u00e9 \u00e9conomique. Toutefois, ces projets peuvent \u00eatre soumis \u00e0 autorisations administratives en raison du changement logique d\u2019usage ou de destination desdits locaux.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Quand demander une autorisation de changement d&rsquo;usage&nbsp;?<\/strong><\/h2>\n<h3>L&rsquo;usage d&rsquo;un bien : c&rsquo;est quoi ?<\/h3>\n<p style=\"text-align: justify;\">L&rsquo;usage du b\u00e2timent correspond \u00e0 la mani\u00e8re dont on emploie les locaux. Ils peuvent ainsi servir de <a href=\"https:\/\/avoloi.eu\/blog\/tag\/logement\/\">logements<\/a>, bureaux, commerces&#8230; La notion d\u2019usage est d\u00e9finie par <strong>le Code de la construction et de l&rsquo;habitation (CCH)<\/strong>. Il traite des r\u00e8gles li\u00e9es au changement d\u2019usage afin d\u2019assurer la protection des immeubles d\u2019habitation situ\u00e9s sur chaque commune. Cela permet aux communes de ma\u00eetriser l\u2019\u00e9quilibre entre les logements et les locaux utilis\u00e9s \u00e0 d\u2019autres fins sur leur territoire.<\/p>\n<h3>La demande de transformation<\/h3>\n<p style=\"text-align: justify;\">Il convient de r\u00e9aliser une demande de <strong>transformation d\u2019un local d\u2019habitation<\/strong> en un local destin\u00e9 \u00e0 un autre usage. Les projets de changement d\u2019usage concernant la transformation de locaux commerciaux ou professionnels en logements n\u2019exigent aucune autorisation pr\u00e9alable.<\/p>\n<h3>La demande d&rsquo;autorisation<\/h3>\n<p style=\"text-align: justify;\">En outre, le changement d&rsquo;usage entra\u00eene syst\u00e9matiquement une obligation de demande d\u2019autorisation lorsque :<\/p>\n<ul>\n<li style=\"text-align: justify;\">la commune dont d\u00e9pend le local d\u2019habitation d\u00e9nombre une population de plus de 200 000 habitants,<\/li>\n<li style=\"text-align: justify;\">ou lorsqu\u2019elle est situ\u00e9e dans le d\u00e9partement des Hauts-de-Seine (92),<\/li>\n<li style=\"text-align: justify;\">de la Seine-Saint-Denis (93),<\/li>\n<li style=\"text-align: justify;\">ou du Val-de-Marne (94), \u00e0 l\u2019exclusion des zones franches urbaines (ZFU).<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">N\u00e9anmoins, toute personne qui souhaite exercer son activit\u00e9 professionnelle dans les locaux de sa r\u00e9sidence principale n\u2019a pas \u00e0 solliciter d&rsquo;autorisation de changement d&rsquo;usage d\u00e8s lors qu\u2019elle s\u2019engage \u00e0 ne recevoir en ces lieux ni client\u00e8le ni marchandises.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Quand demander une autorisation de changement de destination&nbsp;?<\/strong><\/h2>\n<p style=\"text-align: justify;\">La destination du local fait r\u00e9f\u00e9rence aux objectifs qui ont motiv\u00e9 la conception du b\u00e2timent. Elle est donc li\u00e9e \u00e0 la construction en elle-m\u00eame et non \u00e0 son utilisation. La notion de destination ainsi que les r\u00e8gles attach\u00e9es au changement de destination sont abord\u00e9es par <strong>le Code de l\u2019urbanisme<\/strong>. Il existe cinq destinations possibles pour un b\u00e2timent dont :<\/p>\n<ul>\n<li style=\"text-align: justify;\">l\u2019habitation,<\/li>\n<li style=\"text-align: justify;\">le commerce et les activit\u00e9s de service,<\/li>\n<li style=\"text-align: justify;\">les autres activit\u00e9s des secteurs secondaire et tertiaire.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Tout changement de destination d\u2019un immeuble doit avant tout recevoir une autorisation d&rsquo;urbanisme. Cependant la forme de la demande d\u2019autorisation diff\u00e8re selon la nature des travaux. Il peut ainsi s\u2019agir d\u2019une simple d\u00e9claration pr\u00e9alable en cas d\u2019absence de travaux ou de travaux l\u00e9gers ou bien d\u2019un permis de construire pour des travaux de plus grande importance.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Comment effectuer ses demandes d\u2019autorisation&nbsp;?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Les sp\u00e9cificit\u00e9s Les autorisations de changement d\u2019usage et de changement de destination sont d\u00e9livr\u00e9es par la mairie de la commune dont d\u00e9pendent les locaux.<\/p>\n<p style=\"text-align: justify;\">L\u2019autorisation de <strong>changement d\u2019usage<\/strong> est accord\u00e9e au demandeur \u00e0 titre personnel et pour la dur\u00e9e d&rsquo;occupation du local par lui-m\u00eame. Ainsi au d\u00e9part de l\u2019occupant, le local retrouve son usage d\u2019habitation.<\/p>\n<p style=\"text-align: justify;\">Certaines communes conditionnent l\u2019autorisation de changement d\u2019usage \u00e0 une compensation. La transformation d\u2019un local d\u2019habitation en bureaux par exemple peut alors \u00eatre subordonn\u00e9e \u00e0 la transformation inverse de bureaux en logements.<\/p>\n<p style=\"text-align: justify;\">En revanche, les r\u00e8gles d&rsquo;urbanisme consid\u00e8rent le <strong>changement de destination<\/strong> affectant le local comme d\u00e9finitif. L\u2019octroi de l\u2019autorisation d\u00e9pend donc des projets d\u2019am\u00e9nagement du plan local d\u2019urbanisme (PLU) ou d\u2019un plan local d\u2019urbanisme intercommunal (PLUi) applicable sur la commune concern\u00e9e.<\/p>\n<p style=\"text-align: justify;\">Bien que la demande de changement d&rsquo;usage puisse \u00eatre induite par le d\u00e9p\u00f4t d\u2019une demande de permis de construire ou d\u2019une d\u00e9claration pr\u00e9alable, l\u2019accord donn\u00e9 pour un changement de destination n\u2019implique pas pour autant un accord sur le changement d\u2019usage. Il est donc imp\u00e9ratif de s\u2019assurer, lorsque celle-ci est exig\u00e9e, de l\u2019obtention de l\u2019autorisation de changement d\u2019usage avant de d\u00e9buter les travaux autoris\u00e9s dans le cadre du changement de destination.<\/p>\n<p style=\"text-align: justify;\">Concernant la r\u00e9gion \u00cele-de-France, la cr\u00e9ation par changement de destination du b\u00e2timent de locaux de travail d\u2019une surface sup\u00e9rieure \u00e0 1&nbsp;000&nbsp;m\u00b2 n\u00e9cessite en outre de requ\u00e9rir au pr\u00e9alable un <strong>agr\u00e9ment administratif<\/strong>.<\/p>\n<h3>Les diff\u00e9rents points de vigilance<\/h3>\n<p style=\"text-align: justify;\">Enfin, d\u2019autres d\u00e9marches peuvent \u00eatre n\u00e9cessaires suivant la situation du demandeur et du local concern\u00e9.
