Sa protection est un point fondamental de l\u2019activit\u00e9 \u00e9conomique de l\u2019entreprise. Il se distingue de la marque puisqu\u2019il n\u2019est pas un titre de propri\u00e9t\u00e9 industrielle. Il n\u2019est pas non plus un nom commercial, car il n\u2019identifie pas n\u00e9cessairement la soci\u00e9t\u00e9.<\/p>\n<p style=\"text-align: justify;\">Toutefois, au m\u00eame titre que la marque ou le nom d\u2019une entreprise, le nom de domaine a une valeur commerciale \u00e9vidente et son utilisation repr\u00e9sente un enjeu majeur. Avant toute r\u00e9servation du nom de domaine, il convient de s\u2019assurer qu&rsquo;il est bien disponible afin d\u2019\u00e9viter un conflit avec une autre marque ou une d\u00e9nomination sociale proche. Toutefois, la seule r\u00e9servation du nom de domaine n\u2019est pas suffisante \u00e0 l\u2019acquisition d\u2019un droit dans le temps. Focus sur les outils permettant de prot\u00e9ger un nom de domaine.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Les conditions d\u2019opposabilit\u00e9 du nom de domaine<\/strong><\/h2>\n<p style=\"text-align: justify;\">Pour qu\u2019un nom de domaine conf\u00e8re \u00e0 son titulaire des droits opposables aux tiers, la <a href=\"https:\/\/avoloi.eu\/blog\/tag\/jurisprudence\/\">jurisprudence<\/a> exige une exploitation effective et un nom qui n\u2019est pas purement g\u00e9n\u00e9rique.<\/p>\n<h3 style=\"text-align: justify;\"><strong>Une exploitation effective du nom de domaine<\/strong><\/h3>\n<p style=\"text-align: justify;\">La r\u00e9servation de nom de domaine ne conf\u00e8re pas r\u00e9ellement de droit \u00e0 son titulaire. C&rsquo;est son exploitation effective qui lui permet d&rsquo;en revendiquer l&rsquo;opposabilit\u00e9. Selon les juges, l\u2019exploitation du nom de domaine est indispensable pour caract\u00e9riser son ant\u00e9riorit\u00e9 par rapport \u00e0 un autre et, ainsi, assurer sa protection. Par analogie \u00e0 <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000028748210\/2021-03-16\/\" target=\"_blank\" rel=\"nofollow noopener\">l\u2019article L. 711-4 du Code de la propri\u00e9t\u00e9 intellectuelle<\/a>, on prot\u00e8ge les droits ant\u00e9rieurs acquis sur un nom de domaine par un usage effectif et notoire sur le r\u00e9seau Internet.<\/p>\n<h3 style=\"text-align: justify;\"><strong>Un nom de domaine distinctif<\/strong><\/h3>\n<p style=\"text-align: justify;\">Le nom de domaine ne doit pas \u00eatre g\u00e9n\u00e9rique ou purement descriptif des produits ou services propos\u00e9s. Il doit permettre au site de se distinguer sur la toile. Cette caract\u00e9ristique n\u2019est pas une condition \u00e0 l\u2019enregistrement du nom de domaine. Elle ne fait donc pas obstacle \u00e0 son exploitation. Cependant, le caract\u00e8re distinctif influe sur sa protection. Pour pouvoir fonder une action sur le terrain de la responsabilit\u00e9 d\u00e9lictuelle de droit commun, il faut pouvoir justifier d\u2019une atteinte d\u00e9loyale. Le d\u00e9posant d\u2019un nom de domaine a donc tout int\u00e9r\u00eat \u00e0 choisir un terme distinctif au regard de l\u2019objet de son site s\u2019il veut pouvoir se d\u00e9fendre d\u2019un usage post\u00e9rieur identique ou similaire. En effet, un nom de domaine g\u00e9n\u00e9rique est inopposable aux tiers.<\/p>\n<h2 style=\"text-align: justify;\"><strong>La protection du nom de domaine<\/strong><\/h2>\n<p style=\"text-align: justify;\">S\u2019il n\u2019est pas prot\u00e9g\u00e9 comme une marque, le nom de domaine constitue toutefois pour les entreprises un identifiant distinctif sur le march\u00e9 auquel s\u2019attache la client\u00e8le. Plusieurs fondements permettent d\u2019en assurer la protection l\u00e9gitime.<\/p>\n<h3 style=\"text-align: justify;\"><strong>Action en concurrence d\u00e9loyale<\/strong><\/h3>\n<p style=\"text-align: justify;\">Fond\u00e9e sur la <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/id\/LEGISCTA000032021488\/\" target=\"_blank\" rel=\"nofollow noopener\">responsabilit\u00e9 extracontractuelle<\/a>, l\u2019action en concurrence d\u00e9loyale sanctionne l\u2019utilisation d\u2019un nom de domaine de nature \u00e0 cr\u00e9er la confusion dans l\u2019esprit du public. Cela suppose que la victime apporte la preuve d\u2019une faute, d\u2019un pr\u00e9judice et d\u2019un lien de causalit\u00e9 entre la faute et le dommage qui en r\u00e9sulte. Il faut alors caract\u00e9riser un risque de confusion dans l\u2019esprit du public, du fait de la nature des produits et services propos\u00e9s. L\u2019action a pour but de faire cesser l\u2019exploitation du signe litigieux et d\u2019obtenir l\u2019indemnisation du pr\u00e9judice subi.<\/p>\n<h3 style=\"text-align: justify;\"><strong>Pratique commerciale trompeuse<\/strong><\/h3>\n<p style=\"text-align: justify;\">Le nom de domaine peut aussi b\u00e9n\u00e9ficier du droit de la consommation et des dispositions relatives aux pratiques commerciales trompeuses. L\u2019<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032227297\/\" target=\"_blank\" rel=\"nofollow noopener\">article L. 121-2 du Code de la consommation<\/a> permet en effet de sanctionner une pratique commerciale trompeuse, cr\u00e9ant une confusion avec la marque ou le nom commercial d\u2019un concurrent. Dans cette hypoth\u00e8se, l\u2019action peut alors \u00eatre exerc\u00e9e par un consommateur isol\u00e9 ou une association de consommateurs victimes de la confusion.<\/p>\n<h3 style=\"text-align: justify;\"><strong>Contrefa\u00e7on et parasitisme<\/strong><\/h3>\n<p style=\"text-align: justify;\">Le droit de la propri\u00e9t\u00e9 intellectuelle permet \u00e9galement, par extension, de prot\u00e9ger le propri\u00e9taire d\u2019un nom de domaine d\u2019actions malintentionn\u00e9es. L\u2019action en contrefa\u00e7on sanctionne la reproduction ou l\u2019utilisation d\u2019un droit de propri\u00e9t\u00e9 intellectuelle sans autorisation. Ainsi, l\u2019enregistrement d&rsquo;un nom de domaine proche d\u2019une marque existante est de mauvaise foi lorsque son auteur a connaissance de la marque et donc de l&rsquo;int\u00e9r\u00eat de son propri\u00e9taire \u00e0 l\u2019utiliser en tant que nom de domaine. De m\u00eame, l\u2019action en parasitisme permet de sanctionner le fait de tirer profit du travail pr\u00e9alablement effectu\u00e9 par une entreprise et d\u2019usurper sa notori\u00e9t\u00e9.
