C\u2019est l\u2019histoire d\u2019un couple qui aurait d\u00fb \u00ab y regarder \u00e0 deux fois \u00bb\u2026<\/strong><\/strong><\/strong><\/h3>\n\n\n\n

Apr\u00e8s avoir achet\u00e9 une maison, un couple constate l\u2019apparition de fissures pouvant entrainer l\u2019effondrement d\u2019une partie de la maison. Il demande donc une indemnisation \u00e0 la vendeuse qui, selon lui, a cach\u00e9 la gravit\u00e9 des d\u00e9gradations\u2026<\/p>\n\n\n\n

L\u2019objet du litige<\/h3>\n\n\n\n

\u00ab Impossible de ne pas les voir ! \u00bb, conteste la vendeuse qui pr\u00e9cise que les travaux ayant permis de colmater les fissures ont \u00e9t\u00e9 grossi\u00e8rement r\u00e9alis\u00e9s (reprise d\u2019enduit de couleur diff\u00e9rente, pr\u00e9sence de silicone d\u00e9chir\u00e9 dans les fissures, d\u00e9crochement d\u2019un pilier, etc.), ce qui les rendait particuli\u00e8rement visibles\u2026 et l\u2019exon\u00e8re donc de sa responsabilit\u00e9 ! \u00ab Faux \u00bb, r\u00e9torque le couple qui estime que rien ne permettait de connaitre l\u2019ampleur des cons\u00e9quences que ces fissures pouvaient avoir sur la structure de la maison\u2026<\/p>\n\n\n\n

Le verdict<\/h3>\n\n\n\n

\u00ab Vrai ! \u00bb, r\u00e9plique le juge qui refuse donc la demande d\u2019indemnisation du couple :  les d\u00e9sordres constat\u00e9s sont en effet flagrants m\u00eame pour des non-professionnels du b\u00e2timent\u2026 qui ne pouvaient donc ignorer l\u2019importance des d\u00e9g\u00e2ts.<\/p>\n\n\n\n
