{"id":21124,"date":"2021-02-26T16:53:00","date_gmt":"2021-02-26T15:53:00","guid":{"rendered":"https:\/\/avoloi.eu\/?p=21124"},"modified":"2021-02-26T16:53:00","modified_gmt":"2021-02-26T15:53:00","slug":"dol-reparation-prejudice","status":"publish","type":"post","link":"https:\/\/avoloi.fr\/blog\/dol-reparation-prejudice\/","title":{"rendered":"L\u2019absence de dol n\u2019exclut pas la possibilit\u00e9 pour l\u2019acheteur de demander r\u00e9paration de son pr\u00e9judice"},"content":{"rendered":"<p style=\"text-align: justify;\">Par un arr\u00eat de la <a href=\"https:\/\/www.courdecassation.fr\/jurisprudence_2\/arrets_publies_2986\/troisieme_chambre_civile_3171\/2021_9999\/janvier_10000\/19_14_46336.html\" target=\"_blank\" rel=\"nofollow noopener\">Cour de cassation en date du 14 janvier 2021<\/a>, les juges ont r\u00e9affirm\u00e9 la possibilit\u00e9 pour l\u2019acheteur de demander r\u00e9paration de son pr\u00e9judice sur le fondement de la responsabilit\u00e9 extracontractuelle m\u00eame en l\u2019absence de <a href=\"https:\/\/avoloi.eu\/tag\/dol\/\">dol.<\/a><\/p>\n<h2 style=\"text-align: justify;\">Les faits d\u2019esp\u00e8ce<\/h2>\n<p style=\"text-align: justify;\">En l\u2019esp\u00e8ce, un couple d\u2019acheteurs a acquis un appartement afin de b\u00e9n\u00e9ficier d\u2019un avantage fiscal aupr\u00e8s d\u2019une soci\u00e9t\u00e9 de d\u00e9marchage. Cependant, six ann\u00e9es apr\u00e8s, logement a consid\u00e9rablement perdu de sa valeur. Cette baisse de valeur \u00e9tait assez importante pour compromettre la rentabilit\u00e9 de cet investissement.<\/p>\n<h2 style=\"text-align: justify;\">La proc\u00e9dure<\/h2>\n<p style=\"text-align: justify;\">Le couple a demand\u00e9 l\u2019annulation de la vente sur le fondement du dol. En effet, ils consid\u00e8rent que la soci\u00e9t\u00e9 de d\u00e9marchage, le vendeur, la banque et les soci\u00e9t\u00e9s d\u2019assurance, ont gard\u00e9 le silence de mani\u00e8re intentionnelle sur le manque d\u2019opportunit\u00e9 financi\u00e8re que repr\u00e9sentait ce projet immobilier. Par ailleurs, de mani\u00e8re subsidiaire, le couple a demand\u00e9 r\u00e9paration pour faute du d\u00e9marcheur dans son obligation d\u2019information et de conseil.<\/p>\n<p style=\"text-align: justify;\">Si la Cour d\u2019appel a rejet\u00e9 la demande en nullit\u00e9, les juges ont n\u00e9anmoins retenu la perte de chance pour les acheteurs d&rsquo;avoir pu n\u00e9gocier un investissement plus rentable ou de ne pas contracter. De ce fait, les juges ont condamn\u00e9 le d\u00e9marcheur \u00e0 r\u00e9parer le pr\u00e9judice subi par le couple d\u2019acheteurs en dommages-int\u00e9r\u00eats.<\/p>\n<p style=\"text-align: justify;\">La soci\u00e9t\u00e9 de d\u00e9marchage se pourvoit en cassation. En effet, le contrat ayant \u00e9t\u00e9 maintenu en raison du rejet de la demande en nullit\u00e9 pour dol, elle estime qu\u2019elle ne peut \u00eatre condamn\u00e9e pour manquement \u00e0 son devoir d\u2019information et de conseil. D\u2019autre part, elle consid\u00e8re que la Cour d\u2019appel a priv\u00e9 sa d\u00e9cision de base l\u00e9gale en ce qu\u2019il n\u2019est pas v\u00e9rifi\u00e9 que le couple d\u2019acheteurs aurait acquis le bien m\u00eame s\u2019il n\u2019y avait pas eu manquement au devoir d\u2019information et de conseil. Pour finir, elle argue du fait que la Cour d\u2019appel a viol\u00e9 l\u2019article 1382 du Code civil en ce qu\u2019elle n\u2019a pas v\u00e9rifi\u00e9, dans l\u2019\u00e9valuation de la perte de chance, si les acheteurs n\u2019avaient pas tir\u00e9 profit de la propri\u00e9t\u00e9 de leur <a href=\"https:\/\/avoloi.eu\/tag\/appartement\/\">appartement<\/a> m\u00eame d\u00e9pr\u00e9ci\u00e9 dans leur patrimoine.<\/p>\n<h2 style=\"text-align: justify;\">La probl\u00e9matique de droit<\/h2>\n<p style=\"text-align: justify;\">Un acheteur peut-il demander r\u00e9paration de son pr\u00e9judice sur le fondement de la responsabilit\u00e9 quasi-d\u00e9lictuelle m\u00eame en l\u2019absence de dol ?<\/p>\n<h2 style=\"text-align: justify;\">La solution de la Cour<\/h2>\n<p style=\"text-align: justify;\">La Cour de cassation rappelle que l\u2019acheteur peut demander r\u00e9paration de son pr\u00e9judice sur le fondement de la responsabilit\u00e9 quasi-d\u00e9lictuelle m\u00eame si sa demande en nullit\u00e9 a \u00e9t\u00e9 rejet\u00e9e sur le fondement de la responsabilit\u00e9 contractuelle. D\u2019autre part, la Cour d\u2019appel a souverainement appr\u00e9ci\u00e9 la valeur de la perte de chance \u00e0 hauteur de 17 000 euros, sans qu\u2019elle n\u2019e\u00fbt \u00e9t\u00e9 oblig\u00e9e de v\u00e9rifier quelle aurait \u00e9t\u00e9 la d\u00e9cision prise par le couple en cas de respect par la soci\u00e9t\u00e9 requ\u00e9rante de son devoir d\u2019information et de conseil. Par ces motifs, le pourvoi a \u00e9t\u00e9 rejet\u00e9.<\/p>\n<h2 style=\"text-align: justify;\">L\u2019analyse de l\u2019arr\u00eat<\/h2>\n<p style=\"text-align: justify;\">Pour rappel, l&rsquo;article 1137 du Code civil identifie le dol comme un vice de consentement au m\u00eame titre que l&rsquo;erreur et la violence. Les acqu\u00e9reurs invoquent plus pr\u00e9cis\u00e9ment la r\u00e9ticence dolosive, \u00e9tant entendue comme le silence qu&rsquo;aurait gard\u00e9 intentionnellement la soci\u00e9t\u00e9 de d\u00e9marchage sur le manque de rentabilit\u00e9 de cet investissement immobilier.<\/p>\n<p style=\"text-align: justify;\">En invoquant le dol, les acqu\u00e9reurs se sont plac\u00e9s \u00e0 titre principal sur le terrain de la responsabilit\u00e9 contractuelle. En effet, ils ont demand\u00e9 l&rsquo;annulation du contrat, mais les juges d&rsquo;appel n&rsquo;y ont pas fait droit. Par ailleurs, en invoquant la perte de chance qu&rsquo;ils auraient subi d&rsquo;effectuer un investissement plus rentable ou de ne pas contracter, ils se sont plac\u00e9s \u00e9galement sur le terrain de la responsabilit\u00e9 quasi-d\u00e9lictuelle : c&rsquo;est ce que permet l&rsquo;article 1178 alin\u00e9a 4 du Code civil.<\/p>\n<p style=\"text-align: justify;\">Par cons\u00e9quent, le pourvoi de la soci\u00e9t\u00e9 requ\u00e9rante appara\u00eet tout \u00e0 fait vain consid\u00e9rant que l&rsquo;article 1178 alin\u00e9a 4 du Code civil autorise les demandeurs \u00e0 agir \u00e0 la fois sur le terrain contractuel et celui extracontractuel.
