C\u2019est l\u2019histoire d\u2019un mari qui profite du week-end de la Saint-Valentin\u2026 sans son \u00e9pouse\u2026<\/h3>\n\n\n\n

Alors qu\u2019il est en instance de s\u00e9paration avec son \u00e9pouse, un mari d\u00e9cide de partir en week-end de la Saint-Valentin avec sa ma\u00eetresse. Escapade que son \u00e9pouse lui reproche, estimant qu\u2019il s\u2019agit d\u2019une faute grave justifiant un divorce \u00e0 ses torts exclusifs\u2026<\/p>\n\n\n\n

L\u2019objet du litige<\/h3>\n\n\n\n

Faute que nie son mari : pour que son escapade constitue une faute qui rende impossible le maintien de la vie commune, encore eut-il fallu que celle-ci existe encore. Or, ce week-end a eu lieu apr\u00e8s la rupture de la vie commune ! Il n\u2019a donc commis aucune faute\u2026 \u00ab Faux ! \u00bb, persiste son \u00e9pouse : si, dans les faits, ils ont mis fin \u00e0 leur couple, juridiquement, les obligations de vie commune perduraient puisque le juge charg\u00e9 de leur divorce ne les avait pas encore autoris\u00e9s \u00e0 r\u00e9sider s\u00e9par\u00e9ment\u2026<\/p>\n\n\n\n

Le verdict<\/h3>\n\n\n\n

Ce que confirme le juge : l\u2019obligation de vie commune \u00e9tant encore effective, le week-end de la Saint-Valentin en compagnie de sa ma\u00eetresse constitue bel et bien une faute de la part du mari, qui justifie un divorce \u00e0 ses torts exclusifs.<\/p>\n\n\n\n
