Elle se fait aupr\u00e8s de la <a href=\"https:\/\/avoloi.eu\/tag\/mairie\/\">mairie<\/a> de la commune o\u00f9 se situe le bien. Cette formalit\u00e9 administrative permet aux autorit\u00e9s de v\u00e9rifier que le projet respecte les r\u00e8gles d&rsquo;urbanisme.<\/p>\n<p>Extension, sur\u00e9l\u00e9vation, ravalement de fa\u00e7ade, construction d\u2019une piscine\u2026Comment r\u00e9aliser votre d\u00e9claration pr\u00e9alable dans ces situations ? Quelles sont les r\u00e8gles ?\u00a0<\/p>\n<h2 style=\"text-align: justify;\"><strong>Les cas de d\u00e9claration pr\u00e9alable de travaux obligatoire<\/strong><\/h2>\n<p style=\"text-align: justify;\">Les articles <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/id\/LEGISCTA000006188286\/2021-01-03\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">R 421-9 \u00e0 R 421-12 et R 421-17 du Code de l\u2019urbanisme<\/a> traitent de la d\u00e9claration pr\u00e9alable. Ils obligent \u00e0 cette formalit\u00e9 avant la r\u00e9alisation de certains de travaux de construction ou de r\u00e9novation d\u2019un bien immobilier. <br \/><br \/>Ainsi, une autorisation pr\u00e9alable est n\u00e9cessaire lorsque les travaux augmentent la surface de plancher de 5 m\u00b2 \u00e0 20 m\u00b2. Il en va de m\u00eame pour les travaux transformant l&rsquo;ext\u00e9rieur de la construction. C&rsquo;est donc le cas pour :\u00a0<\/p>\n<ul>\n<li style=\"text-align: justify;\">le percement d\u2019une nouvelle fen\u00eatre,<\/li>\n<li style=\"text-align: justify;\">la pose d&rsquo;un velux sur toit,<\/li>\n<li style=\"text-align: justify;\">le choix d\u2019une nouvelle couleur pour les volets,<\/li>\n<li style=\"text-align: justify;\">la pose d\u2019une v\u00e9randa &#8230;\u00a0<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Les travaux de ravalement sont \u00e9galement soumis \u00e0 cette d\u00e9claration pr\u00e9alable lorsqu\u2019ils sont effectu\u00e9s dans des secteurs prot\u00e9g\u00e9s, \u00e0 proximit\u00e9 d\u2019un monument historique par exemple. La d\u00e9claration pr\u00e9alable est \u00e9galement obligatoire pour la construction d&rsquo;un mur dont la hauteur est sup\u00e9rieure ou \u00e9gale \u00e0 2 m en partant du sol, ou pour la construction d&rsquo;une piscine. Enfin, cette d\u00e9claration est obligatoire dans le cas d\u2019un changement de destination du bien. Lorsqu&rsquo;il s&rsquo;agit par exemple de transformer un ancien atelier en habitation, la formalit\u00e9 est indispensable m\u00eame si ce changement ne n\u00e9cessite aucun de travaux. <br \/><br \/>La d\u00e9claration pr\u00e9alable doit \u00eatre distingu\u00e9e du permis de construire. Celui-ci devient obligatoire lorsque les travaux pr\u00e9voient la cr\u00e9ation d&rsquo;une surface minimum de 20 m\u00b2 et que la surface totale d\u00e9passe les 150 m\u00b2.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Le formalisme de la d\u00e9claration pr\u00e9alable de travaux<\/strong><\/h2>\n<p style=\"text-align: justify;\">La d\u00e9claration est d\u00e9pos\u00e9e en mairie en deux exemplaires ou bien par lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception. \u00c0 partir du 1er janvier 2022, <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/id\/JORFTEXT000037639478\/2019-10-28\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">une proc\u00e9dure d\u00e9mat\u00e9rialis\u00e9e<\/a> sera obligatoire pour les communes de plus de 3500 habitants. La d\u00e9claration pr\u00e9alable est faite sur les formulaires Cerfa 13703 pour les travaux r\u00e9alis\u00e9s sur une maison individuelle, ou Cerfa 13404 dans les autres cas. Le formulaire est assorti des pi\u00e8ces obligatoires d\u00e9taill\u00e9es ci-dessous. <br \/><br \/>Le plan de situation du terrain permet de localiser pr\u00e9cis\u00e9ment le lieu des travaux sur le territoire de la commune. Il peut notamment \u00eatre <a href=\"https:\/\/www.geoportail.gouv.fr\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">r\u00e9alis\u00e9 en ligne<\/a>. <br \/><br \/>Le plan de masse permet de pr\u00e9senter le projet de travaux dans sa totalit\u00e9 et de v\u00e9rifier qu&rsquo;il respecte les r\u00e8gles d&rsquo;implantations de hauteur. Il fait apparaitre les b\u00e2timents existants sur le terrain avec leurs dimensions et leur emplacement exact, les b\u00e2timents \u00e0 construire, les parties du terrain qu\u2019il est pr\u00e9vu de creuser pour r\u00e9aliser le projet, les arbres existants, l\u2019emplacement pr\u00e9vu pour le raccordement aux r\u00e9seaux ou l\u2019installation du syst\u00e8me d\u2019assainissement individuel.<br \/><br \/>Le plan en coupe du terrain et de la construction permet de compl\u00e9ter le plan de masse lorsque le terrain se trouve modifi\u00e9 par les travaux, comme dans le cas d\u2019une piscine par exemple. Les services de l\u2019urbanisme peuvent ainsi appr\u00e9cier l&rsquo;impact du projet sur le voisinage. Une repr\u00e9sentation de l\u2019aspect ext\u00e9rieur de la construction est exig\u00e9e lorsque le projet le modifie ; un photomontage est alors tr\u00e8s simplement admissible.<\/p>\n<h2 style=\"text-align: justify;\"><strong>La r\u00e9ponse des autorit\u00e9s<\/strong><\/h2>\n<p style=\"text-align: justify;\">Le dossier est instruit dans un d\u00e9lai d\u2019un mois \u00e0 compter de la date du d\u00e9p\u00f4t de la d\u00e9claration pr\u00e9alable, deux mois dans les secteurs sauvegard\u00e9s. La mairie rend sa d\u00e9cision par la lettre recommand\u00e9e. Une d\u00e9cision positive est valable pendant trois ans. Un d\u00e9lai suppl\u00e9mentaire peut \u00eatre demand\u00e9 lorsque les <a href=\"https:\/\/avoloi.eu\/tag\/travaux\/\">travaux<\/a> n\u2019ont pas commenc\u00e9 dans ce d\u00e9lai. \u00c0 compter de l\u2019accord de la mairie, il faut encore compter deux mois pour purger le recours des tiers. C\u2019est la raison pour laquelle la d\u00e9cision d\u2019autorisation de travaux doit \u00eatre affich\u00e9e d\u00e8s sa notification de la d\u00e9cision.
