{"id":20538,"date":"2020-12-17T20:22:24","date_gmt":"2020-12-17T19:22:24","guid":{"rendered":"https:\/\/avoloi.eu\/?p=20538"},"modified":"2020-12-17T20:22:24","modified_gmt":"2020-12-17T19:22:24","slug":"larret-du-jour-230-le-turbo","status":"publish","type":"post","link":"https:\/\/avoloi.fr\/blog\/larret-du-jour-230-le-turbo\/","title":{"rendered":"L&rsquo;arr\u00eat du jour #230 Le turbo"},"content":{"rendered":"\n<hr class=\"wp-block-separator\" \/>\n\n\n\n<hr class=\"wp-block-separator\" \/>\n\n\n\n<h3 class=\"wp-block-heading\">C\u2019est l\u2019histoire d\u2019un particulier qui ach\u00e8te une voiture\u2026 qui tombe r\u00e9guli\u00e8rement en panne\u2026<\/h3>\n\n\n\n<p>Apr\u00e8s lui avoir achet\u00e9 un v\u00e9hicule 2 ans plus t\u00f4t, un particulier a d\u00fb demander \u00e0 son garagiste de changer, par 2 fois, le turbocompresseur de&nbsp;la voiture.&nbsp;Mais 2 ans plus tard, la pi\u00e8ce doit de nouveau \u00eatre chang\u00e9e\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">L\u2019objet du litige<\/h3>\n\n\n\n<p>C\u2019en est trop pour l\u2019acheteur pour qui le garagiste est fautif et doit lui rembourser le co\u00fbt de cette 3e&nbsp;r\u00e9paration :&nbsp;&nbsp;pour lui, parce que le&nbsp;garagiste a une&nbsp;obligation de r\u00e9sultat, il est pr\u00e9sum\u00e9 responsable des pannes li\u00e9es \u00e0 son intervention\u2026 Sauf qu\u2019une expertise du v\u00e9hicule&nbsp;conclut que sa propre&nbsp;intervention est \u00e9trang\u00e8re \u00e0 la nouvelle panne, d\u2019autant que celle-ci est apparue 2 ans apr\u00e8s et alors m\u00eame que le&nbsp;v\u00e9hicule a effectu\u00e9 40 000 kilom\u00e8tres&nbsp;suppl\u00e9mentaires depuis les premi\u00e8res r\u00e9parations, conteste le garagiste\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Le verdict<\/h3>\n\n\n\n<p>Ce que confirme le juge, qui donne donc raison au garagiste : rien ne prouve ici que la nouvelle panne est due \u00e0 un probl\u00e8me d\u00e9j\u00e0 existant au jour de son&nbsp;intervention, ou est li\u00e9e \u00e0 elle.
