Civ. 1\u00e8re, 22 octobre 2020, n\u00b019-21.961).<\/p>\n<p style=\"text-align: justify;\">En effet, la r\u00e9alisation de travaux affectant les parties communes ou l\u2019aspect ext\u00e9rieur d\u2019un <a href=\"https:\/\/avoloi.eu\/tag\/immeuble\/\">immeuble<\/a> suppose deux conditions cumulatives :<\/p>\n<ul style=\"text-align: justify;\">\n<li>Une d\u00e9cision d&rsquo;autorisation de l\u2019assembl\u00e9e g\u00e9n\u00e9rale de copropri\u00e9t\u00e9 prise \u00e0 la majorit\u00e9 des voix de tous les copropri\u00e9taires ;<\/li>\n<li>La conformit\u00e9 des travaux \u00e0 la destination de l\u2019immeuble.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">A cet \u00e9gard, il appartient au juge de v\u00e9rifier si ces conditions sont remplies. Il pourra ensuite se prononcer sur la r\u00e9gularit\u00e9 de la d\u00e9cision attaqu\u00e9e.<\/p>\n<h2 style=\"text-align: justify;\">La situation d&rsquo;esp\u00e8ce<\/h2>\n<h3>Les faits<\/h3>\n<p style=\"text-align: justify;\">En l\u2019esp\u00e8ce, le syndicat de copropri\u00e9t\u00e9 a pris la d\u00e9cision d\u2019autoriser l\u2019un des copropri\u00e9taires de l\u2019immeuble \u00e0 effectuer des travaux. Ceux-ci consistaient \u00e0 remplacer les portes-fen\u00eatres du lot d\u2019un autre copropri\u00e9taire.<\/p>\n<p style=\"text-align: justify;\">Cette d\u00e9cision a \u00e9t\u00e9 contest\u00e9e par le copropri\u00e9taire du lot qui soutient que les travaux ne sont pas conformes \u00e0 la destination de l\u2019immeuble.<\/p>\n<h3 style=\"text-align: justify;\">La proc\u00e9dure<\/h3>\n<p style=\"text-align: justify;\">Dans un premier temps, en appel, la demande a \u00e9t\u00e9 rejet\u00e9e. En effet, il a \u00e9t\u00e9 consid\u00e9r\u00e9 que l\u2019assembl\u00e9e g\u00e9n\u00e9rale avait souverainement appr\u00e9ci\u00e9 si l\u2019autorisation d\u2019effectuer ces travaux \u00e9tait justifi\u00e9e par l\u2019int\u00e9r\u00eat collectif de la copropri\u00e9t\u00e9.<\/p>\n<p style=\"text-align: justify;\">Dans un second temps, le juge a consid\u00e9r\u00e9 qu&rsquo;il n\u2019appartenait pas \u00e0 la Cour d\u2019Appel de remettre en cause l\u2019appr\u00e9ciation effectu\u00e9e par l\u2019assembl\u00e9e g\u00e9n\u00e9rale.<\/p>\n<h3 style=\"text-align: justify;\">La solution retenue par la cour<\/h3>\n<p style=\"text-align: justify;\">Dans ces conditions, l&rsquo;arr\u00eat rendu par la Cour d\u2019appel a \u00e9t\u00e9 cass\u00e9 par les juges. En effet, ces derniers ont affirm\u00e9 que les motifs \u00e9tablis \u00e9taient impropres \u00e0 \u00e9tablir si les travaux autoris\u00e9s \u00e9taient conformes \u00e0 la destination de l\u2019immeuble.<\/p>\n<h2 style=\"text-align: justify;\">Ce qu&rsquo;il faut en retenir<\/h2>\n<h3>Les d\u00e9cisions de l&rsquo;assembl\u00e9e g\u00e9n\u00e9rale<\/h3>\n<p style=\"text-align: justify;\">C\u2019est en vertu de <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000039313590\/2020-06-01\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">l\u2019article 25, b) de la loi du 10 juillet 1965<\/a> que l\u2019assembl\u00e9e g\u00e9n\u00e9rale de copropri\u00e9t\u00e9 peut autoriser l\u2019un des copropri\u00e9taires \u00e0 effectuer des travaux affectant les parties communes ou l\u2019aspect ext\u00e9rieur d\u2019un immeuble \u00e0 ses frais. De plus, cette autorisation doit \u00eatre prise \u00e0 la majorit\u00e9 des voix de tous les copropri\u00e9taires. Enfin, ces travaux doivent \u00eatre conformes \u00e0 la destination de l\u2019immeuble.<\/p>\n<p style=\"text-align: justify;\">En effet, l\u2019article 9 de la loi susmentionn\u00e9e pose le principe selon lequel les co-propri\u00e9taires ne doivent pas porter atteinte \u00e0 la destination de l\u2019immeuble. Cette loi ne donne pas de d\u00e9finition pr\u00e9cise de cette notion. N\u00e9anmoins, si l&rsquo;on se r\u00e9f\u00e8re aux travaux parlementaires \u00e0 cette loi, la destination de l&rsquo;immeuble peut se d\u00e9finir comme l&rsquo;ensemble des conditions au regard desquelles le copropri\u00e9taire a achet\u00e9 son lot.<\/p>\n<p style=\"text-align: justify;\">Il s\u2019agit donc d\u2019une condition de la l\u00e9galit\u00e9 de la d\u00e9cision prise par l\u2019<a href=\"https:\/\/avoloi.eu\/tag\/assemblee-generale\/\">assembl\u00e9e g\u00e9n\u00e9rale<\/a>. Elle doit \u00eatre appr\u00e9ci\u00e9e de mani\u00e8re souveraine par les juges du fond. Ces derniers doivent s\u2019appuyer sur les actes et notamment sur le r\u00e8glement de copropri\u00e9t\u00e9. Ils prennent \u00e9galement en consid\u00e9ration les \u00e9l\u00e9ments de faits pour juger de la conformit\u00e9 ou non des travaux \u00e0 la destination de l\u2019immeuble (Cass. 3\u00e8me civ., 17-1-1996 n\u00b094-13.702).<\/p>\n<p style=\"text-align: justify;\">A d\u00e9faut de respecter la conformit\u00e9 des travaux \u00e0 la destination de l\u2019immeuble, la d\u00e9cision de l\u2019assembl\u00e9e g\u00e9n\u00e9rale doit \u00eatre prise \u00e0 l\u2019unanimit\u00e9 des copropri\u00e9taires.<\/p>\n<h3>Appr\u00e9ciation de la conformit\u00e9 \u00e0 la destination de l&rsquo;immeuble<\/h3>\n<p style=\"text-align: justify;\">L&rsquo;appr\u00e9ciation de la conformit\u00e9 \u00e0 la destination de l&rsquo;immeuble se fait au cas par cas. Ainsi, les travaux suivants \u00e9taient conformes \u00e0 la destination de l\u2019immeuble :<\/p>\n<ul style=\"text-align: justify;\">\n<li>L\u2019installation d&rsquo;un interphone (Cass. 3e civ., 11 f\u00e9vr. 1975)\u00a0;<\/li>\n<li>Le raccordement au tout-\u00e0-l&rsquo;\u00e9gout (CA Paris, 3 mars 1988)\u00a0;<\/li>\n<li>Les <a href=\"https:\/\/avoloi.eu\/tag\/travaux\/\">travaux<\/a> li\u00e9s aux canalisations communes d&rsquo;eau, de gaz et d&rsquo;\u00e9lectricit\u00e9 (CA Paris, 22 nov. 2000, n\u00b0 2000\/02240).<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">En revanche, les cas suivant sont non conformes \u00e0 la destination de l&rsquo;immeuble :<\/p>\n<ul>\n<li style=\"text-align: justify;\">L&rsquo;installation d&rsquo;une terrasse en vue de l&rsquo;exploitation d&rsquo;un bar-restaurant dans un immeuble \u00e0 usage d&rsquo;habitation ne comprenant qu&rsquo;un seul local commercial (Cass. 3e civ., 29 oct. 1974)\u00a0;<\/li>\n<li style=\"text-align: justify;\">L&rsquo;implantation d&rsquo;une climatisation sur le mur ext\u00e9rieur de l&rsquo;immeuble alt\u00e9rant l&rsquo;esth\u00e9tique de l&rsquo;immeuble (Cass. 3e civ., 18 f\u00e9vr. 2004).<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>La Cour de Cassation a rendu un arr\u00eat venant pr\u00e9ciser les conditions pr\u00e9alables \u00e0 la r\u00e9alisation de travaux &#8230;<\/p>\n","protected":false},"author":2,"featured_media":20527,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[26],"tags":[147,597,148,130,451,598,6,599,93],"class_list":["post-20526","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-droit-de-limmobilier","tag-assemblee-generale","tag-autorisation","tag-coproprietaires","tag-copropriete","tag-cour-de-cassation","tag-destination","tag-immobilier","tag-parties-communes","tag-travaux"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.6 -
