{"id":20356,"date":"2020-11-16T11:32:38","date_gmt":"2020-11-16T10:32:38","guid":{"rendered":"https:\/\/avoloi.eu\/?p=20356"},"modified":"2020-11-16T11:32:38","modified_gmt":"2020-11-16T10:32:38","slug":"conge-proche-aidant","status":"publish","type":"post","link":"https:\/\/avoloi.fr\/blog\/conge-proche-aidant\/","title":{"rendered":"Aider un parent en situation de d\u00e9pendance gr\u00e2ce au cong\u00e9 de proche aidant"},"content":{"rendered":"<p style=\"text-align: justify\">Depuis le 1er octobre 2020, il est possible de prendre un cong\u00e9 indemnis\u00e9 pour s\u2019occuper d\u2019une personne malade, handicap\u00e9e ou en situation de d\u00e9pendance. Cette mesure concerne onze millions de Fran\u00e7ais qui viennent en aide \u00e0 un proche au quotidien.<\/p>\n<h2 style=\"text-align: justify\">Qu\u2019est-ce que le cong\u00e9 de proche aidant ?<\/h2>\n<p style=\"text-align: justify\">Le cong\u00e9 de proche aidant remplace le <strong>cong\u00e9 de soutien familial<\/strong> qui existait depuis 2017. Il peut \u00eatre pris par l\u2019ensemble des actifs :<\/p>\n<ul style=\"text-align: justify\">\n<li>les salari\u00e9s du secteur priv\u00e9 ;<\/li>\n<li>les agents du secteur public ;<\/li>\n<li>les travailleurs ind\u00e9pendants ;<\/li>\n<li>les demandeurs d\u2019emploi.<\/li>\n<\/ul>\n<p style=\"text-align: justify\">La personne aid\u00e9e doit \u00eatre <strong>en situation r\u00e9guli\u00e8re<\/strong> sur le territoire fran\u00e7ais. Elle doit \u00eatre porteuse d\u2019un handicap ou subir une perte d\u2019autonomie d\u2019une \u00ab gravit\u00e9 particuli\u00e8re \u00bb. Sont concern\u00e9es les personnes avec un taux d\u2019incapacit\u00e9 reconnu de plus de 80% ou les personnes \u00e2g\u00e9es b\u00e9n\u00e9ficiaires de l\u2019<a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F10009\" target=\"_blank\" rel=\"noopener noreferrer\">allocation personnalis\u00e9e d\u2019autonomie<\/a> (APA) et relevant des groupes iso-ressources (GIR) I, II ou III.<\/p>\n<p style=\"text-align: justify\">Le salari\u00e9 qui demande le cong\u00e9 peut avoir des <strong>liens familiaux<\/strong> avec la personne d\u00e9pendante. Il peut \u00eatre :<\/p>\n<ul style=\"text-align: justify\">\n<li>l\u2019\u00e9poux, le partenaire de pacte civil de solidarit\u00e9 (Pacs), le concubin ; l\u2019ascendant ou le descendant ;<\/li>\n<li>un membre de la famille jusqu\u2019au quatri\u00e8me degr\u00e9 (s\u0153ur, oncle, ni\u00e8ce, cousin\u2026) ;<\/li>\n<li>un collat\u00e9ral jusqu\u2019au quatri\u00e8me degr\u00e9 de la personne avec qui le demandeur vit en couple.<\/li>\n<\/ul>\n<p style=\"text-align: justify\">Le demandeur et le proche en perte d\u2019autonomie ne sont pas obligatoirement de la m\u00eame <a href=\"https:\/\/avoloi.eu\/tag\/famille\/\">famille<\/a>. Le cong\u00e9 peut aussi \u00eatre pris au profit d\u2019un enfant \u00e0 charge ou d\u2019une personne \u00e2g\u00e9e ou handicap\u00e9e avec qui le salari\u00e9 entretient des <strong>liens stables et \u00e9troits<\/strong>. Le soutien apport\u00e9 doit \u00eatre b\u00e9n\u00e9vole et r\u00e9gulier.<\/p>\n<h3 style=\"text-align: justify\">Une indemnisation temporaire<\/h3>\n<p style=\"text-align: justify\">En l\u2019absence d\u2019accord de branche plus favorable, le cong\u00e9 de proche aidant est limit\u00e9 \u00e0 <strong>trois mois renouvelables<\/strong>. Sa dur\u00e9e ne peut pas d\u00e9passer un an pour l\u2019ensemble d\u2019une carri\u00e8re professionnelle.<\/p>\n<p style=\"text-align: justify\">Pendant son cong\u00e9, le salari\u00e9 est indemnis\u00e9 par la caisse d\u2019allocations familiales (CAF). Il per\u00e7oit une <strong>allocation journali\u00e8re de proche aidant<\/strong> (AJPA). Son montant quotidien est de :<\/p>\n<ul style=\"text-align: justify\">\n<li>48,83 euros pour un aidant vivant en couple ;<\/li>\n<li>08 euros pour un aidant vivant seul.<\/li>\n<\/ul>\n<p style=\"text-align: justify\">Chaque mois ouvre droit \u00e0 <strong>vingt-deux jours<\/strong> d\u2019allocations maximum. Quand le cong\u00e9 est pris \u00e0 temps partiel, les indemnit\u00e9s peuvent \u00eatre fractionn\u00e9es.<\/p>\n<h2 style=\"text-align: justify\">Comment prendre un cong\u00e9 pour aider un proche ?<\/h2>\n<p style=\"text-align: justify\">Pour poser un cong\u00e9 de proche aidant, le salari\u00e9 adresse une demande \u00e9crite \u00e0 son <a href=\"https:\/\/avoloi.eu\/tag\/employeur\/\">employeur<\/a> au moins <strong>un mois avant la date de d\u00e9part<\/strong> souhait\u00e9e. Le d\u00e9lai ne s\u2019applique pas en cas :<\/p>\n<ul style=\"text-align: justify\">\n<li>d\u2019aggravation brutale de l\u2019\u00e9tat de sant\u00e9 de la personne d\u00e9pendante ;<\/li>\n<li>de situation de crise n\u00e9cessitant une action urgente ;<\/li>\n<li>de fin non programm\u00e9e d\u2019un h\u00e9bergement en \u00e9tablissement sp\u00e9cialis\u00e9.<\/li>\n<\/ul>\n<p style=\"text-align: justify\">Le salari\u00e9 joint \u00e0 sa demande :<\/p>\n<ul style=\"text-align: justify\">\n<li>une d\u00e9claration sur l\u2019honneur justifiant du lien entre lui et la personne aid\u00e9e ;<\/li>\n<li>une d\u00e9claration sur l\u2019honneur informant s\u2019il a d\u00e9j\u00e0 pris ou non un cong\u00e9 de proche aidant ;<\/li>\n<li>la copie d\u2019un document attestant du degr\u00e9 de d\u00e9pendance de la personne.<\/li>\n<\/ul>\n<p style=\"text-align: justify\">Les <strong>demandes de renouvellement<\/strong> doivent-\u00eatre adress\u00e9es au moins quinze jours avant la date de fin du cong\u00e9.<\/p>\n<p style=\"text-align: justify\">Le cong\u00e9 se termine de fa\u00e7on anticip\u00e9e en cas :<\/p>\n<ul style=\"text-align: justify\">\n<li>de d\u00e9c\u00e8s de la personne aid\u00e9e ;<\/li>\n<li>d\u2019entr\u00e9e en \u00e9tablissement de la personne aid\u00e9e ;<\/li>\n<li>de mise en place d\u2019un service d\u2019aide \u00e0 domicile ;<\/li>\n<li>de diminution trop importante des ressources du salari\u00e9 ;<\/li>\n<li>de cong\u00e9 pris par un autre membre de la famille.<\/li>\n<\/ul>\n<h3 style=\"text-align: justify\">Que faire en cas de refus de l\u2019employeur ?<\/h3>\n<p style=\"text-align: justify\">L\u2019entreprise n\u2019a <strong>pas le droit de refuser<\/strong> le cong\u00e9 du salari\u00e9 sauf si celui-ci ne remplit pas les conditions ou qu\u2019il ne respecte pas le pr\u00e9avis d\u2019un mois.<\/p>\n<p style=\"text-align: justify\">En cas de d\u00e9saccord, l\u2019employ\u00e9 saisit le conseil de prud\u2019homme (CPH), seul ou avec l\u2019assistance d\u2019un avocat.<\/p>\n<h2 style=\"text-align: justify\">Les droits et les devoirs du salari\u00e9 durant le cong\u00e9<\/h2>\n<p style=\"text-align: justify\">Pendant toute la dur\u00e9e du cong\u00e9, le salari\u00e9 n\u2019a <strong>pas le droit de travailler<\/strong>. Il peut n\u00e9anmoins \u00eatre d\u00e9clar\u00e9 par la personne d\u00e9pendante si elle per\u00e7oit l\u2019APA ou la prestation de compensation du handicap (PCH). L\u2019AJPA est imposable et soumise au pr\u00e9l\u00e8vement \u00e0 la source.<\/p>\n<p style=\"text-align: justify\">Le cong\u00e9 de proche aidant ouvre droit \u00e0 l\u2019assurance vieillesse des parents aux foyers (AVPF).<\/p>\n<p style=\"text-align: justify\">Sa dur\u00e9e est prise en compte dans le <strong>calcul de l\u2019anciennet\u00e9<\/strong> et de l\u2019avancement au sein de l\u2019entreprise.<\/p>\n<p style=\"text-align: justify\">\u00c0 son retour au travail, l\u2019employ\u00e9 <strong>conserve les avantages<\/strong> qu\u2019il avait acquis dans l\u2019entreprise. Il retrouve son poste ou un emploi identique.
