Ce que conteste le client\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">L\u2019objet du litige<\/h3>\n\n\n\n<p>\u2026 \u00e0 tort, selon le b\u00e2tonnier : \u00e0 compter de l\u2019\u00e9tablissement de la derni\u00e8re facture de son avocat, le client a eu 5 ans pour faire appel \u00e0 lui. Or,&nbsp;il s\u2019est ici&nbsp;\u00e9coul\u00e9 plus de 5 ans. Le b\u00e2tonnier estime donc avoir eu raison de ne pas examiner la demande du client. \u00ab Faux \u00bb, persiste ce&nbsp;dernier : pour lui, le d\u00e9lai&nbsp;de 5 ans commence \u00e0 courir \u00e0 compter de la fin du mandat de l\u2019avocat, qui est ici survenue moins de 5 ans avant&nbsp;la saisine du b\u00e2tonnier : il a donc agi&nbsp;en temps voulu\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Le verdict<\/h3>\n\n\n\n<p>Ce que confirme le juge : le point de d\u00e9part de la prescription de 5 ans de l&rsquo;action en restitution d&rsquo;honoraires se situe bel et bien au jour de la fin du&nbsp;mandat de l&rsquo;avocat.
