{"id":20231,"date":"2020-10-30T14:33:04","date_gmt":"2020-10-30T13:33:04","guid":{"rendered":"https:\/\/avoloi.eu\/?p=20231"},"modified":"2020-10-30T14:33:04","modified_gmt":"2020-10-30T13:33:04","slug":"phishing-remboursement","status":"publish","type":"post","link":"https:\/\/avoloi.fr\/blog\/phishing-remboursement\/","title":{"rendered":"Phishing : perte de la totalit\u00e9 du droit au remboursement de la victime en cas de n\u00e9gligence grave"},"content":{"rendered":"<p style=\"text-align: justify\">Par un arr\u00eat rendu en juillet 2020, la Cour de cassation maintient le courant actuel de sa jurisprudence tendant \u00e0 renforcer l\u2019obligation qui incombe au client d\u2019un \u00e9tablissement financier de pr\u00e9server la s\u00e9curit\u00e9 de ses donn\u00e9es bancaires et rejette, dans le cadre d\u2019une fraude par <em>phishing<\/em>, un possible partage de responsabilit\u00e9 entre la banque et son client voir une impossibilit\u00e9 d&rsquo;obtenir un remboursement.<\/p>\n<p style=\"text-align: justify\">Dans un contexte o\u00f9 les pratiques frauduleuses sont en constante augmentation, la d\u00e9cision de la Cour de cassation revient \u00e0 sanctionner s\u00e9v\u00e8rement l\u2019imprudence des clients des \u00e9tablissements financiers et incite \u00e0 redoubler d\u2019attention face \u00e0 la r\u00e9ception de courriers \u00e9lectroniques malveillants.<\/p>\n<h2 style=\"text-align: justify\">La responsabilit\u00e9 du payeur&nbsp;en cas de n\u00e9gligence grave<\/h2>\n<h3 style=\"text-align: justify\">En quoi consiste la pratique de Phishing<\/h3>\n<p style=\"text-align: justify\">Est victime de hame\u00e7onnage (ou <em>phishing<\/em> en anglais) l\u2019internaute qui transmet \u00e0 une personne malintentionn\u00e9e, g\u00e9n\u00e9ralement en r\u00e9ponse \u00e0 un courriel, des informations personnelles telles que des identifiants de connexion ou des donn\u00e9es bancaires, en pensant \u00e0 tort que la demande de renseignements \u00e9mane d\u2019un tiers de confiance (banque, prestataire de services, commerce en ligne, administration\u2026). Le but de cette escroquerie consiste, dans de nombreux cas, \u00e0 user des donn\u00e9es confidentielles de l\u2019internaute pour r\u00e9gler des achats \u00e0 distance ou proc\u00e9der au versement de sommes d\u2019argent sur des comptes situ\u00e9s le plus souvent \u00e0 l\u2019\u00e9tranger.<\/p>\n<p style=\"text-align: justify\">Or, tout paiement par carte bancaire, virement ou pr\u00e9l\u00e8vement ne peut \u00eatre effectu\u00e9 sans <strong>l\u2019autorisation du payeur<\/strong>. En l\u2019absence d\u2019une telle autorisation, le prestataire de services de paiement (ou plus simplement la banque), consid\u00e9r\u00e9 comme responsable de l\u2019op\u00e9ration de paiement r\u00e9alis\u00e9e \u00e0 l\u2019insu de son client, se trouve dans l\u2019obligation de rembourser le montant ind\u00fbment d\u00e9bit\u00e9 sur son compte.<\/p>\n<h3 style=\"text-align: justify\">La preuve de la n\u00e9gligence grave<\/h3>\n<p style=\"text-align: justify\">Toutefois, le prestataire de services de paiement ne peut \u00eatre tenu pour responsable du paiement contest\u00e9 par le payeur quand ce dernier, victime d\u2019une pratique de hame\u00e7onnage, a permis sa r\u00e9alisation en communiquant des informations confidentielles par <strong>n\u00e9gligence grave<\/strong>, et ce en d\u00e9pit de sa bonne foi. Il appartient alors \u00e0 l\u2019\u00e9tablissement bancaire, pour s\u2019exon\u00e9rer de tout remboursement, de d\u00e9montrer que son client a manqu\u00e9 \u00e0 son obligation de pr\u00e9server la s\u00e9curit\u00e9 de ses donn\u00e9es personnelles et a commis une faute par n\u00e9gligence grave en divulguant celles-ci.<\/p>\n<p style=\"text-align: justify\"><a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000042113135\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">L\u2019arr\u00eat du 1er juillet 2020 de la Cour de cassation<\/a> confirme qu\u2019en cas de n\u00e9gligence grave du payeur, celui-ci doit <strong>seul assumer la totalit\u00e9 des pertes<\/strong> occasionn\u00e9es par les op\u00e9rations de paiement non autoris\u00e9es. La responsabilit\u00e9 du pr\u00e9judice du client ne saurait, de fait, \u00eatre partag\u00e9e avec l\u2019\u00e9tablissement bancaire, lequel ne peut donc \u00eatre condamn\u00e9 au remboursement partiel des sommes d\u00e9tourn\u00e9es. La n\u00e9gligence grave du client, m\u00eame de bonne foi, suffit par cons\u00e9quent \u00e0 lui faire perdre l\u2019int\u00e9gralit\u00e9 de son droit au remboursement, sauf \u00e0 prouver l\u2019existence en parall\u00e8le d\u2019une faute de la banque.<\/p>\n<h2 style=\"text-align: justify\"><strong>Comment r\u00e9agir en cas de phishing&nbsp;?<\/strong><\/h2>\n<p style=\"text-align: justify\">En pr\u00e9sence d\u2019une tentative de hame\u00e7onnage, l\u2019attitude de l\u2019internaute est donc d\u00e9terminante pour \u00e9tablir la responsabilit\u00e9 de l\u2019\u00e9tablissement bancaire et obtenir le remboursement des sommes d\u00e9tourn\u00e9es ou bien celle du client qui devra alors supporter l\u2019int\u00e9gralit\u00e9 des pertes financi\u00e8res.<\/p>\n<p style=\"text-align: justify\">Quand le payeur reconna\u00eet avoir \u00e9t\u00e9 victime d\u2019une op\u00e9ration de hame\u00e7onnage, sa n\u00e9gligence grave engage sa responsabilit\u00e9 et exon\u00e8re celle de l\u2019\u00e9tablissement bancaire.<\/p>\n<h3>Caract\u00e9ristiques de la n\u00e9gligence<\/h3>\n<p style=\"text-align: justify\">La n\u00e9gligence grave peut ainsi \u00eatre caract\u00e9ris\u00e9e lorsque l\u2019internaute r\u00e9pond a\u0300 un courriel&nbsp;:<\/p>\n<ul style=\"text-align: justify\">\n<li>qui pr\u00e9sente de <strong>s\u00e9rieuses anomalies<\/strong> tant au niveau de sa forme que de son contenu (pr\u00e9sence de fautes d\u2019orthographe, erreurs de frappe, expressions inappropri\u00e9es, syntaxe approximative, demande suspecte ou irr\u00e9guli\u00e8re\u2026)&nbsp;;<\/li>\n<li>dont <strong>la provenance est douteuse<\/strong> (e-mail non personnalis\u00e9, inexactitude dans l\u2019adresse de l\u2019exp\u00e9diteur voire exp\u00e9diteur inconnu, num\u00e9ro de contrat indiqu\u00e9 erron\u00e9, discordance entre les informations \u00e9voqu\u00e9es et la r\u00e9alit\u00e9&#8230;)&nbsp;;<\/li>\n<li>en cliquant sur <strong>un lien propos\u00e9<\/strong> manifestement <strong>incoh\u00e9rent<\/strong> (adresse non fiable, mauvaise imitation du logo et\/ou des signes distinctifs de l\u2019entreprise ou de l\u2019organisme dont l\u2019identit\u00e9 a \u00e9t\u00e9 usurp\u00e9e\u2026).<\/li>\n<\/ul>\n<p style=\"text-align: justify\">A contrario, un utilisateur internet normalement attentif peut \u00eatre consid\u00e9r\u00e9 comme celui qui a pratiqu\u00e9 un examen consciencieux du message \u00e9lectronique re\u00e7u sans relever d\u2019indice d\u2019apparence douteuse lui laissant craindre d\u2019\u00eatre en pr\u00e9sence d\u2019un e-mail frauduleux.<\/p>\n<h3>Agir vite et bien en cas de phishing<\/h3>\n<p style=\"text-align: justify\">Selon les renseignements personnels qu\u2019il a malencontreusement communiqu\u00e9s, l\u2019internaute victime de <em>phishing<\/em> doit sans tarder faire opposition sur ses comptes bancaires afin d\u2019\u00e9viter ou limiter les d\u00e9bits frauduleux. Il doit \u00e9galement changer les mots de passe de tous les comptes concern\u00e9s par une possible utilisation malhonn\u00eate des donn\u00e9es transmises. La victime de l\u2019escroquerie a ensuite tout int\u00e9r\u00eat \u00e0 d\u00e9poser plainte au commissariat de police ou \u00e0 la gendarmerie. Il peut \u00e9galement signaler le contenu internet ill\u00e9gal sur diff\u00e9rents sites d\u00e9di\u00e9s \u00e0 la pr\u00e9vention de ce type d\u2019arnaques.<\/p>\n<h3>Obtenir un remboursement<\/h3>\n<p style=\"text-align: justify\">En cas de pr\u00e9judice financier, l\u2019internaute est en droit de formuler, id\u00e9alement par courrier recommand\u00e9, une demande de <a href=\"https:\/\/avoloi.eu\/tag\/remboursement\/\">remboursement<\/a> aupr\u00e8s de son \u00e9tablissement bancaire, \u00e0 charge pour ce dernier de prouver l\u2019\u00e9ventuelle imprudence de son client.
