(Cour de cassation, civile, 3\u00e8me Chambre civile, 9 juillet 2020)"},"content":{"rendered":"<p style=\"text-align: justify;\">Dans un arr\u00eat rendu le 9 juillet 2020, la <a href=\"https:\/\/avoloi.eu\/tag\/cour-de-cassation\/\">Cour de cassation<\/a> rappelle qu\u2019il revient au locataire de d\u00e9montrer qu\u2019il n\u2019est pas responsable des d\u00e9gradations du logement en location.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Les faits d\u2019esp\u00e8ce<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u00c9tait en cause le refus par le bailleur de restituer au locataire le d\u00e9p\u00f4t de garantie en raison de d\u00e9gradations affectant le cr\u00e9pi de l\u2019un des murs du logement. En l\u2019esp\u00e8ce, l\u2019\u00e9tat des lieux d\u2019entr\u00e9e ne faisait aucune mention de l\u2019\u00e9tat des fa\u00e7ades du logement. De fait, cela laisse planer le doute sur l\u2019origine et l\u2019auteur de ces d\u00e9gradations.<\/p>\n<p style=\"text-align: justify;\">En contestation de ce refus, le locataire l\u2019assigne en restitution du d\u00e9p\u00f4t de garantie et en paiement de l\u2019indemnit\u00e9 de retard. En r\u00e9ponse, le bailleur a formul\u00e9 une demande reconventionnelle de paiement de la remise en \u00e9tat des fa\u00e7ades.<\/p>\n<h2 style=\"text-align: justify;\"><strong>La proc\u00e9dure<\/strong><\/h2>\n<p style=\"text-align: justify;\">Le tribunal d\u2019instance de Roanne condamne le bailleur \u00e0 la restitution du d\u00e9p\u00f4t de garantie ainsi qu\u2019au paiement de l\u2019indemnit\u00e9 de retard. En effet, les juges de premi\u00e8re instance constatent qu\u2019il n\u2019est pas possible de savoir si les d\u00e9gradations sont imputables au locataire ou au bailleur.<\/p>\n<p style=\"text-align: justify;\">Le bailleur fait grief au jugement du tribunal d\u2019instance de Roanne en se fondant sur <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032042341\/2016-10-01\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">l\u2019article 1353 du Code civil<\/a> relatif \u00e0 la charge de la preuve. D\u2019apr\u00e8s le requ\u00e9rant, il existe une pr\u00e9somption de bon \u00e9tat du logement en l\u2019absence d\u2019\u00e9tat des lieux. Sur la base de cette pr\u00e9somption, les d\u00e9gradations sont ainsi imputables au locataire. Il revient alors \u00e0 ce dernier de prouver qu\u2019il n\u2019a pas commis de faute.<\/p>\n<h2 style=\"text-align: justify;\"><strong>La probl\u00e9matique<\/strong><\/h2>\n<p style=\"text-align: justify;\">En mati\u00e8re de d\u00e9gradation de biens en <a href=\"https:\/\/avoloi.eu\/tag\/location\/\">location<\/a>, la charge de la preuve p\u00e8se-t-elle sur le locataire ou le bailleur ?<\/p>\n<h2 style=\"text-align: justify;\"><strong>La solution retenue par la Cour<\/strong><\/h2>\n<p style=\"text-align: justify;\">La Cour de cassation rappelle les termes de l\u2019article 7 c de la loi du 6 juillet 1989. Celui-ci pose une obligation pour le locataire de r\u00e9pondre des d\u00e9gradations et pertes survenant pendant la dur\u00e9e du contrat. Des exceptions existent en cas de :<\/p>\n<ul>\n<li style=\"text-align: justify;\">force majeure,<\/li>\n<li style=\"text-align: justify;\">faute du bailleur,<\/li>\n<li style=\"text-align: justify;\">ou fait d\u2019un tiers que ce locataire n\u2019a pas introduit dans le logement.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Le locataire est ainsi pr\u00e9sum\u00e9 responsable des d\u00e9gradations et des pertes qui sont survenus durant le bail. A charge pour ce dernier de d\u00e9montrer qu\u2019il n\u2019a pas commis de faute. Par ces motifs, la Cour rejoint la position du requ\u00e9rant et casse et annule l\u2019arr\u00eat attaqu\u00e9.<\/p>\n<h3 style=\"text-align: justify;\"><strong>Une pr\u00e9somption de faute du locataire en cas de d\u00e9gradation des lieux<\/strong><\/h3>\n<p style=\"text-align: justify;\">En vertu de l\u2019article 7 c de la <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/id\/LEGITEXT000006069108\/2020-10-16\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">loi du 6 juillet 1989<\/a>, le locataire est responsable des d\u00e9gradations et des pertes survenant pendant la dur\u00e9e du contrat. M\u00eame si dans les faits, il n\u2019est pas possible de conna\u00eetre l\u2019origine et l\u2019auteur des dommages intervenus dans le logement mis en location, faute de mention dans l\u2019\u00e9tat des lieux d\u2019entr\u00e9e, il incombe au locataire de r\u00e9pondre de ces d\u00e9gradations et pertes.<\/p>\n<p style=\"text-align: justify;\">Le locataire peut s\u2019exon\u00e9rer de sa responsabilit\u00e9 en d\u00e9montrant soit : la faute du bailleur, le cas de force majeure, ou le fait d\u2019un tiers qui n\u2019aurait pas \u00e9t\u00e9 introduit par le locataire dans le logement.<\/p>\n<p style=\"text-align: justify;\">En pratique, et pour \u00e9viter tout contentieux, le locataire doit donc faire preuve de vigilance lors de l\u2019\u00e9tat des lieux d\u2019entr\u00e9e en indiquant les d\u00e9gradations qui ne sont pas de son fait pour qu\u2019elles ne lui soient pas imput\u00e9es.<\/p>\n<h3 style=\"text-align: justify;\"><strong>La jouissance des lieux par le locataire, condition de l\u2019application de ce r\u00e9gime de responsabilit\u00e9<\/strong><\/h3>\n<p style=\"text-align: justify;\">Le locataire est pr\u00e9sum\u00e9 \u00eatre \u00e0 l\u2019origine des d\u00e9gradations des lieux parce qu\u2019il a la jouissance du bien. Il est donc responsable des dommages caus\u00e9s durant la dur\u00e9e du bail.<\/p>\n<p style=\"text-align: justify;\">A contrario, il ne peut \u00eatre consid\u00e9r\u00e9 comme responsable des dommages du logement mis en location apr\u00e8s son d\u00e9part.
