Quelles sont les caract\u00e9ristiques des conventions d\u2019occupation du domaine public ? Quel est le r\u00e9gime des conventions d\u2019occupation du domaine public ?<\/p>\n<h2 style=\"text-align: justify;\">Les caract\u00e9ristiques des conventions d\u2019occupation du domaine public<\/h2>\n<p style=\"text-align: justify;\">Les conventions d\u2019occupation du domaine public sont des contrats conclus :\u00a0<\/p>\n<ul>\n<li style=\"text-align: justify;\">par \u00e9crit,<\/li>\n<li style=\"text-align: justify;\">pour une dur\u00e9e d\u00e9termin\u00e9e,<\/li>\n<li style=\"text-align: justify;\">dont l\u2019unique objet est l\u2019occupation du domaine public.<\/li>\n<\/ul>\n<p>En outre, il s\u2019agit d\u2019un contrat pr\u00e9caire et r\u00e9vocable en raison du caract\u00e8re inali\u00e9nable du domaine public, personnel et cessible.<\/p>\n<h3 style=\"text-align: justify;\">Un contrat conclu par \u00e9crit<\/h3>\n<p style=\"text-align: justify;\">L\u2019arr\u00eat Soci\u00e9t\u00e9 immobili\u00e8re du port de Boulogne (<a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000030755660\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">CE, 19 juin 2015, n\u00b0369558<\/a>) \u00e9nonce en ces termes : \u00ab une convention d&rsquo;occupation du domaine public ne peut \u00eatre tacite et doit rev\u00eatir un caract\u00e8re \u00e9crit. \u00bb Aucune autorisation tacite n\u2019est donc possible.<\/p>\n<h3 style=\"text-align: justify;\">Un contrat dont l\u2019objet est l\u2019occupation du domaine public<\/h3>\n<p style=\"text-align: justify;\">Une convention d\u2019occupation du domaine public a pour seul objet l\u2019occupation du domaine public.<\/p>\n<p style=\"text-align: justify;\">N\u00e9anmoins, un contrat peut avoir un objet mixte.<\/p>\n<p style=\"text-align: justify;\">D\u2019une part, un contrat ayant pour objet de r\u00e9pondre \u00e0 des besoins de personnes publiques moyennant contrepartie on\u00e9reuse, peut avoir pour effet de permettre une occupation du domaine public. Ces besoins peuvent \u00eatre en travaux, en services, en fournitures. Dans ce cas, c\u2019est cette derni\u00e8re qualification de march\u00e9 public qui est retenue. L\u2019arr\u00eat JC DECAUX du 4 novembre 2005 du Conseil d\u2019Etat (<a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000008217080\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">CE, 4 novembre 2005, n\u00b0247298<\/a>) l\u2019illustre. En l\u2019esp\u00e8ce, le contrat litigieux portait sur la fourniture de prestations de service en mati\u00e8re d\u2019information municipale, de propret\u00e9, et de protection des usagers des transports publics, ainsi que sur l\u2019occupation du domaine public. Or, la commune de Villetaneuse avait exon\u00e9r\u00e9 la soci\u00e9t\u00e9 des redevances domaniales. Elle lui permettait d\u2019exploiter une partie du mobilier urbain \u00e0 des fins publicitaires. Cette exon\u00e9ration est constitutive d\u2019un avantage on\u00e9reux en contrepartie des prestations de service fournies par la soci\u00e9t\u00e9.<\/p>\n<p style=\"text-align: justify;\">D\u2019autre part, un contrat peut \u00e0 la fois porter sur une activit\u00e9 de service public et engendrer une occupation du domaine public. Dans ce cas, c\u2019est la qualification de d\u00e9l\u00e9gation de service public qui doit \u00eatre retenue. Cette appr\u00e9ciation se fait au cas par cas. Ainsi, l\u2019arr\u00eat Association Jean Bouin (<a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000023162753\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">CE, 13 janvier 2010, nos 338272<\/a> et 338527) a pu consid\u00e9rer que l\u2019association n\u2019\u00e9tait pas charg\u00e9e d\u2019une mission de service public malgr\u00e9 son obligation d\u2019entretenir et d\u2019am\u00e9liorer les \u00e9quipements, de contribuer au d\u00e9veloppement du rugby aupr\u00e8s des enfants, etc.<\/p>\n<h3 style=\"text-align: justify;\">Un contrat pr\u00e9caire et r\u00e9vocable<\/h3>\n<p style=\"text-align: justify;\">Toute occupation du domaine public est temporaire en vertu de l\u2019<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000034448120\/2017-04-21\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">article L. 2122-2 du CGPPP<\/a>. Toutefois, le <a href=\"https:\/\/avoloi.eu\/tag\/conseil-detat\/\">Conseil d\u2019Etat<\/a> a affirm\u00e9 que le caract\u00e8re temporaire des autorisations domaniales n\u2019impose pas que celles-ci pr\u00e9cisent explicitement leur dur\u00e9e au motif que les autorisations domaniales sont pr\u00e9caires.<\/p>\n<p style=\"text-align: justify;\">Ces autorisations ne donnent donc aucun droit au renouvellement. Leur retrait peut donc \u00eatre d\u00e9cid\u00e9 \u00e0 tout moment par l\u2019exercice, par la puissance publique, de son pouvoir de r\u00e9siliation.<\/p>\n<h3 style=\"text-align: justify;\">Un contrat personnel et cessible<\/h3>\n<p style=\"text-align: justify;\">Avant 2015, et ce, en vertu de l\u2019arr\u00eat Munoz (CE, 10 mai 1989, MUNOZ, n\u00b073146), les titres domaniaux \u00e9taient personnels et incessibles. D\u00e9sormais, depuis l\u2019arr\u00eat Soci\u00e9t\u00e9 Prest&rsquo;air (<a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000031184155\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">CE, 18 septembre 2015, PREST\u2019AIR, n\u00b0 387315<\/a>), les titres domaniaux peuvent \u00eatre cessibles \u00e0 condition que le gestionnaire du domaine a donn\u00e9 son accord \u00e9crit.<\/p>\n<h2 style=\"text-align: justify;\">Le r\u00e9gime des conventions d\u2019occupation du domaine public<\/h2>\n<h3 style=\"text-align: justify;\">Une proc\u00e9dure pr\u00e9alable obligatoire<\/h3>\n<p style=\"text-align: justify;\">L\u2019arr\u00eat Promoimpresa (<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/FR\/TXT\/?uri=CELEX%3A62014CJ0458\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">CJUE, 14 juillet 2016, aff. C-458\/14<\/a>) de la Cour de Justice Europ\u00e9enne est \u00e0 l\u2019origine de l\u2019\u00e9volution du droit fran\u00e7ais en la mati\u00e8re. Depuis, l\u2019Ordonnance du 19 avril 2017 a introduit dans le CGPPP l\u2019article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000034444126\/2017-04-21\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">L. 2122-1-1<\/a>. Il dispose que l\u2019attribution de conventions domaniales doit \u00eatre soumise \u00e0 une proc\u00e9dure de s\u00e9lection et de publicit\u00e9 pr\u00e9alable, impartiale et transparente, lorsque l\u2019occupation a pour but une exploitation \u00e9conomique.<\/p>\n<p style=\"text-align: justify;\">En revanche, si l\u2019occupation est de courte dur\u00e9e ou si le nombre d\u2019utilisations n\u2019est pas limit\u00e9, l\u2019<a href=\"https:\/\/avoloi.eu\/tag\/administration\/\">administration<\/a> n\u2019est tenue qu\u2019\u00e0 une proc\u00e9dure de publicit\u00e9 pr\u00e9alable.<\/p>\n<h3 style=\"text-align: justify;\">Le contenu de l\u2019autorisation domaniale<\/h3>\n<h4 style=\"text-align: justify;\">&#8211; Les clauses non financi\u00e8res<\/h4>\n<p style=\"text-align: justify;\">Le gestionnaire du domaine public peut imposer \u00e0 l\u2019occupant des obligations qui rendront son activit\u00e9 compatible avec l\u2019affectation du domaine, le maintien de l\u2019ordre public, ou toute autre consid\u00e9ration d\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral.<\/p>\n<h4 style=\"text-align: justify;\">&#8211; Les clauses financi\u00e8res<\/h4>\n<p style=\"text-align: justify;\">En vertu de l\u2019article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/id\/LEGIARTI000034448136\/2017-04-21\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">L. 2125-1 du Code G\u00e9n\u00e9ral de la Propri\u00e9t\u00e9 des Personnes Publiques<\/a>, sauf quelques exceptions, toute occupation ou utilisation du domaine public d&rsquo;une personne publique mentionn\u00e9e \u00e0 l&rsquo;article L. 1 donne lieu au paiement d&rsquo;une redevance.\u00a0<\/p>\n<p style=\"text-align: justify;\">De plus, le gestionnaire du domaine public a la possibilit\u00e9 d\u2019accorder des subventions \u00e0 l\u2019occupant du domaine public s\u2019il estime que son activit\u00e9 concourt suffisamment \u00e0 la satisfaction de l\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral.<\/p>\n<p style=\"text-align: justify;\">Enfin, les titres domaniaux peuvent pr\u00e9voir les indemnit\u00e9s auxquelles l\u2019occupant aura droit en cas de retrait anticip\u00e9 pour motif d\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral de son titre en vertu de la jurisprudence Soci\u00e9t\u00e9 Jonathan Loisir de 2009 (<a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000020936263\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">CE, 31 juillet 2009, Soci\u00e9t\u00e9 Jonathan Loisir, n\u00b0 316534<\/a>).<\/p>\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>L\u2019occupation du domaine public n\u00e9cessite soit une autorisation administrative unilat\u00e9rale d\u2019occupation du domaine public soit une convention d\u2019occupation du domaine public.<\/p>\n","protected":false},"author":2,"featured_media":19529,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[297],"tags":[518,383,519,520,521],"class_list":["post-19525","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-droit-public-urbanisme","tag-autorisation-domaniale","tag-conseil-detat","tag-convention","tag-domaine-public","tag-occupation"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.6 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Les conventions d&#039;occupation du domaine public - Le blog Avoloi<\/title>\n<meta name=\"description\" content=\"Les conventions d&#039;occupation du domaine public sont r\u00e9gies par un certain nombre de r\u00e8gles.
