Prot\u00e9g\u00e9 par l\u2019article 17 de la <a href=\"https:\/\/www.legifrance.gouv.fr\/contenu\/menu\/droit-national-en-vigueur\/constitution\/declaration-des-droits-de-l-homme-et-du-citoyen-de-1789\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">D\u00e9claration des Droits de l\u2019Homme et du Citoyen<\/a> du 26 ao\u00fbt 1789, le droit de propri\u00e9t\u00e9 est un droit \u00ab inviolable et sacr\u00e9 \u00bb dont \u00ab nul ne peut en \u00eatre priv\u00e9, si ce n\u2019est lorsque la n\u00e9cessit\u00e9 publique, l\u00e9galement constat\u00e9e, l\u2019exige \u00e9videmment et sous la condition d\u2019une juste et pr\u00e9alable indemnit\u00e9 \u00bb. Ce texte reconna\u00eet ainsi une limite au droit de propri\u00e9t\u00e9 justifi\u00e9 par l&rsquo;int\u00e9r\u00eat g\u00e9n\u00e9ral dans le cas de l&rsquo;expropriation. Cependant, d&rsquo;autres limites au caract\u00e8re absolu du droit de <a href=\"https:\/\/avoloi.eu\/tag\/propriete\/\">propri\u00e9t\u00e9<\/a> ont \u00e9t\u00e9 pos\u00e9es notamment par la doctrine et la jurisprudence. Celles-ci ont ainsi \u00e9labor\u00e9 un r\u00e9gime consacr\u00e9 aux troubles anormaux de voisinage, qui vise \u00e0 prot\u00e9ger des droits de propri\u00e9t\u00e9 qui se font concurrence.<\/p>\n<h2 style=\"text-align: justify;\"><strong>La reconnaissance du caract\u00e8re abusif de l\u2019usage du droit de propri\u00e9t\u00e9<\/strong><\/h2>\n<p style=\"text-align: justify;\">La doctrine relative aux troubles anormaux de voisinage s\u2019inscrit dans la lign\u00e9e de la jurisprudence consacr\u00e9e \u00e0 l\u2019usage abusif du droit de propri\u00e9t\u00e9. L\u2019usage abusif du droit de propri\u00e9t\u00e9 a \u00e9t\u00e9 reconnu dans l\u2019<a href=\"https:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?idTexte=JURITEXT000007070363\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">arr\u00eat Cl\u00e9ment-Bayard<\/a> rendu par la chambre des requ\u00eates le 3 ao\u00fbt 1915.<\/p>\n<p style=\"text-align: justify;\">En l\u2019esp\u00e8ce, le voisin de Cl\u00e9ment-Bayard d\u00e9nomm\u00e9 Coquerel avait install\u00e9 en bordure de terrain une cl\u00f4ture en bois surmont\u00e9e de tiges de fer pointues d\u2019une longueur de seize m\u00e8tres.<\/p>\n<p style=\"text-align: justify;\">Par la suite, le ballon dirigeable de Cl\u00e9ment-Bayard s\u2019est heurt\u00e9 \u00e0 ces tiges de fer et s\u2019est d\u00e9gonfl\u00e9. Les juges ont reconnu un abus de droit de la part de Coquerel qui s\u2019est vu condamn\u00e9 \u00e0 la r\u00e9paration du dommage caus\u00e9 par l\u2019installation de ces tiges. Ainsi, il a \u00e9t\u00e9 consid\u00e9r\u00e9 que la faute a \u00e9t\u00e9 commise dans l\u2019intention de nuire au propri\u00e9taire voisin.<\/p>\n<h2 style=\"text-align: justify;\"><strong>La reconnaissance du trouble anormal de voisinage<\/strong><\/h2>\n<p style=\"text-align: justify;\">La jurisprudence a ainsi reconnu depuis longtemps le caract\u00e8re potentiellement abusif de l\u2019usage du droit de propri\u00e9t\u00e9. Dans la continuit\u00e9, la doctrine a reconnu l\u2019existence de troubles anormaux de voisinage, dont la notion est plus large que celle de faute.<\/p>\n<p style=\"text-align: justify;\">Ainsi, le r\u00e9gime n\u2019est pas celui du r\u00e9gime g\u00e9n\u00e9ral de la responsabilit\u00e9 pour faute de l\u2019ex-article 1382 du Code Civil (d\u00e9sormais <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/id\/LEGIARTI000032041571\/2016-10-01\/#:~:text=Tout%20fait%20quelconque%20de%20l,est%20arriv%C3%A9%20%C3%A0%20le%20r%C3%A9parer.\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">article 1240 du Code Civil<\/a>). Le principe a \u00e9t\u00e9 pos\u00e9 par la deuxi\u00e8me chambre civile de la Cour de cassation dans un arr\u00eat en date du 19 novembre 1986 d\u2019apr\u00e8s lequel \u00ab nul ne doit causer \u00e0 autrui un trouble anormal de voisinage \u00bb. Ce trouble peut \u00eatre de toute nature : visuel, sonore, olfactif, voire m\u00eame esth\u00e9tique.<\/p>\n<h3>Les conditions \u00e0 remplir<\/h3>\n<p style=\"text-align: justify;\">Deux conditions doivent \u00eatre remplies pour que le caract\u00e8re anormal du trouble de voisinage soit reconnu.<\/p>\n<p style=\"text-align: justify;\">D\u2019une part, le trouble doit \u00eatre persistant ou r\u00e9current (2\u00e8 Civ., 5 f\u00e9vrier 2004) ; d\u2019autre part, le trouble doit \u00eatre grave dans les circonstances consid\u00e9r\u00e9es de temps ou de lieu (3\u00e8 Civ., 14 janvier 2004). La qualification de trouble anormal de voisinage rel\u00e8ve de l\u2019appr\u00e9ciation souveraine des juges. Ces derniers peuvent en outre imposer \u00e0 l\u2019auteur du trouble les mesures destin\u00e9es \u00e0 le faire cesser.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Le respect ou le non-respect de la r\u00e9glementation : des circonstances sans effet sur la qualification de trouble anormal de voisinage<\/strong><\/h2>\n<p style=\"text-align: justify;\">Peu importe que l\u2019auteur du trouble ait respect\u00e9 ou n\u2019ait pas respect\u00e9 la r\u00e9glementation en vigueur. Autrement dit, la circonstance que l\u2019auteur du trouble ne soit pas all\u00e9 \u00e0 l\u2019encontre de la r\u00e9glementation ne l\u2019exon\u00e8re pas de sa responsabilit\u00e9 en cas de qualification de trouble anormal de voisinage par les juges.<\/p>\n<p style=\"text-align: justify;\">Ainsi, un trouble anormal a pu \u00eatre reconnu du fait de la construction d\u2019un immeuble de grande hauteur ayant pour effet d\u2019emp\u00eacher la lumi\u00e8re d\u2019une villa voisine de passer (3\u00e8 Civ., 8 juillet 1972) ; autre exemple, il a \u00e9t\u00e9 reconnu que la vue directe et plongeante chez un voisin du fait d\u2019une construction \u00e0 \u00e9tage avait pour effet de priver la jouissance du droit de propri\u00e9t\u00e9 de ce <a href=\"https:\/\/avoloi.eu\/tag\/voisin\/\">voisin<\/a> (3\u00e8 Civ., 7 f\u00e9vrier 2007).<\/p>\n<p style=\"text-align: justify;\">A l\u2019inverse, le non-respect d\u2019une r\u00e9glementation n\u2019entra\u00eene pas n\u00e9cessairement la reconnaissance d\u2019un trouble anormal de voisinage.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le droit de propri\u00e9t\u00e9 est un droit \u00ab\u00a0inviolable et sacr\u00e9\u00a0\u00bb, cependant certaines limites existent &#8230; <\/p>\n","protected":false},"author":2,"featured_media":19436,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[26],"tags":[10,67,167,11],"class_list":["post-19435","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-droit-de-limmobilier","tag-propriete","tag-trouble-de-voisinage","tag-voisin","tag-voisinage"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.6 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Les troubles anormaux de voisinage - Le blog Avoloi<\/title>\n<meta name=\"description\" content=\"Troubles anormaux du voisinage : v\u00e9rifiez si le comportement g\u00eanant de votre voisin en constitue un.
