{"id":19261,"date":"2020-08-06T21:12:11","date_gmt":"2020-08-06T21:12:11","guid":{"rendered":"https:\/\/avoloi.eu\/?p=19261"},"modified":"2020-08-06T21:12:11","modified_gmt":"2020-08-06T21:12:11","slug":"le-pret-relais","status":"publish","type":"post","link":"https:\/\/avoloi.fr\/blog\/le-pret-relais\/","title":{"rendered":"L&rsquo;arr\u00eat du jour #211 Le pr\u00eat relais"},"content":{"rendered":"<hr>\n<h3>C\u2019est l\u2019histoire d\u2019un couple qui finance son achat immobilier par un pr\u00eat-relais\u2026<\/h3>\n<p>Un couple d\u00e9cide d\u2019investir dans sa nouvelle r\u00e9sidence principale et, pour cela, envisage la vente de sa maison et l\u2019achat d\u2019un terrain pour y b\u00e2tir sa future maison.&nbsp;Il finance cet investissement par&nbsp;un pr\u00eat-relais qui doit \u00eatre rapidement rembours\u00e9 par la vente de la 1\u00e8re&nbsp;maison. Sauf que cette vente tarde, ce qui le met en&nbsp;difficult\u00e9 pour payer les \u00e9ch\u00e9ances du pr\u00eat-relais\u2026<\/p>\n<h3>L\u2019objet du litige<\/h3>\n<div>Face aux impay\u00e9s, la banque r\u00e9clame le remboursement du pr\u00eat-relais. Mais, le couple refuse et se retourne contre la banque, estimant qu\u2019elle a commis une faute, mettant en cause sa responsabilit\u00e9, pour manquement \u00e0 son obligation de conseil, en n\u2019attirant pas suffisamment son attention sur le risque d&rsquo;endettement r\u00e9sultant de la charge constitu\u00e9e par le remboursement du pr\u00eat-relais.
