{"id":19156,"date":"2020-07-20T13:20:00","date_gmt":"2020-07-20T13:20:00","guid":{"rendered":"https:\/\/avoloi.eu\/?p=19156"},"modified":"2020-07-20T13:20:00","modified_gmt":"2020-07-20T13:20:00","slug":"quel-regime-est-applicable-aux-habitations-regies-par-le-droit-commun-mais-acquises-par-un-organisme-hlm","status":"publish","type":"post","link":"https:\/\/avoloi.fr\/blog\/quel-regime-est-applicable-aux-habitations-regies-par-le-droit-commun-mais-acquises-par-un-organisme-hlm\/","title":{"rendered":"Quel r\u00e9gime est applicable aux habitations r\u00e9gies par le droit commun mais acquises par un organisme HLM ?"},"content":{"rendered":"<p style=\"text-align: justify\">Par un <a href=\"https:\/\/www.courdecassation.fr\/jurisprudence_2\/troisieme_chambre_civile_572\/339_28_44905.html\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">arr\u00eat du 28 mai 2020<\/a>, la Cour de cassation souligne que, lorsqu&rsquo;un organisme HLM acquiert des appartements r\u00e9gis par le droit commun des baux d&rsquo;habitation, le r\u00e9gime de droit commun demeure applicable au contraire du r\u00e9gime propre aux HLM. En revanche, selon le principe en vertu duquel de nouveaux contrats naissent apr\u00e8s une reconduction, la reconduction d&rsquo;un bail de droit commun fait na\u00eetre un nouveau bail, entre le locataire et l&rsquo;organisme HLM, d\u00e9sormais r\u00e9gi par le r\u00e9gime propre aux HLM.<\/p>\n<h3 style=\"text-align: justify\"><strong>Les faits d\u2019esp\u00e8ce<\/strong><\/h3>\n<p style=\"text-align: justify\">Le 15 juillet 1981, les requ\u00e9rants deviennent locataires d\u2019un appartement r\u00e9gi par un bail de droit commun. Le 2 juillet 2001, l\u2019appartement est c\u00e9d\u00e9 \u00e0 une soci\u00e9t\u00e9 HLM qui l\u2019acquiert au moyen d\u2019un pr\u00eat locatif interm\u00e9diaire (PLI). Apr\u00e8s le d\u00e9c\u00e8s de l\u2019un des locataires, la soci\u00e9t\u00e9 HLM soumet la requ\u00e9rante \u00e0 plusieurs offres de relogement que celle-ci refuse. Le 18 mars 2015, la soci\u00e9t\u00e9 HLM r\u00e9alise une assignation en expulsion.<\/p>\n<h3 style=\"text-align: justify\"><strong>La proc\u00e9dure<\/strong><\/h3>\n<p style=\"text-align: justify\">Un appel est interjet\u00e9 devant la Cour d\u2019appel de Versailles, qui a rendu un arr\u00eat en date du 19 f\u00e9vrier 2019.<\/p>\n<p style=\"text-align: justify\">Elle y affirme que le bail est r\u00e9gi par la l\u00e9gislation sur les HLM. Selon la Cour, <a href=\"https:\/\/www.legifrance.gouv.fr\/affichTexteArticle.do?cidTexte=LEGITEXT000006069108&amp;idArticle=LEGIARTI000020459174\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">l\u2019article 40 de la loi du 6 juillet 1989<\/a> qui pr\u00e9voit l\u2019inapplicabilit\u00e9 des articles 10 et 15 de cette loi, relatives \u00e0 la dur\u00e9e du contrat de bail et au droit de pr\u00e9emption, est donc applicable au contrat de bail.<\/p>\n<p style=\"text-align: justify\">La requ\u00e9rante se pourvoit en cassation. Elle soutient que le bail est soumis \u00e0 la l\u00e9gislation de droit commun lorsque l\u2019immeuble, qui fait l\u2019objet \u00e0 l\u2019origine d\u2019un bail d\u2019habitation de droit commun, est c\u00e9d\u00e9 \u00e0 un organisme HLM. Selon la requ\u00e9rante, les articles 10 et 15 de la loi du 6 juillet 1989, dispositions de droit commun en mati\u00e8re de baux d&rsquo;habitation, sont, par cons\u00e9quent, applicables au bailleur.<\/p>\n<h3 style=\"text-align: justify\"><strong>La probl\u00e9matique<\/strong><\/h3>\n<p style=\"text-align: justify\">En cas de cession d\u2019un immeuble r\u00e9gi par le droit commun des baux d\u2019habitation \u00e0 un organisme d\u2019habitation \u00e0 loyer mod\u00e9r\u00e9, le contrat de bail est-il r\u00e9gi par le r\u00e9gime de droit commun ou par les dispositions propres aux organismes HLM ?<\/p>\n<h3 style=\"text-align: justify\"><strong>R\u00e9ponse de la Cour<\/strong><\/h3>\n<p style=\"text-align: justify\">En r\u00e9ponse au premier moyen tir\u00e9 de l\u2019inapplicabilit\u00e9 des dispositions de l\u2019article 40 de la loi du 6 juillet 1989, propres aux organismes HLM, la Cour rappelle qu\u2019en effet, le droit commun des baux d\u2019habitation, lors d\u2019une telle acquisition par un organisme HLM, demeure applicable au bail en cours. En revanche, en cas de reconduction, un nouveau contrat intervient, et ce dernier est d\u00e9sormais r\u00e9gi par les dispositions relatives aux HLM.<\/p>\n<p style=\"text-align: justify\">En l\u2019esp\u00e8ce, la Cour souligne que le bail \u00e9tait venu \u00e0 expiration le 14 juillet 2002, et que, par cons\u00e9quent, un nouveau bail est n\u00e9 \u00e0 compter du 15 juillet 2002, lequel \u00e9tait soumis aux dispositions relatives aux HLM, dont l\u2019article 40 de la loi du 6 juillet 1989.<\/p>\n<p style=\"text-align: justify\">Ainsi, la Cour rejette le pourvoi.<\/p>\n<h2 style=\"text-align: justify\"><strong>Analyse de l\u2019arr\u00eat<\/strong><\/h2>\n<h3 style=\"text-align: justify\"><strong>Que dit l\u2019article 40 I de la loi du 6 juillet 1989 ?<\/strong><\/h3>\n<p style=\"text-align: justify\">L\u2019article 40 I de la loi du 6 juillet 1989 est une disposition propre aux habitations \u00e0 loyer mod\u00e9r\u00e9, et par cons\u00e9quent, d\u00e9rogatoire au droit commun des baux d\u2019habitation. Elle dispose que les articles 10 et 15 notamment, ne sont applicables aux logements dont les organismes HLM en sont propri\u00e9taires et qui ne font pas l\u2019objet d\u2019une convention r\u00e9gie par l\u2019article L. 351-2 du code de la construction et de l\u2019habitation.<\/p>\n<p style=\"text-align: justify\">Les articles 10 et 15 de la loi du 6 juillet 1989 sont relatives aux cong\u00e9s d\u00e9livr\u00e9s par le bailleur ainsi qu\u2019au droit de pr\u00e9emption dont dispose le locataire \u00e0 cette occasion. En l\u2019esp\u00e8ce, la requ\u00e9rante semblait souhaiter vouloir b\u00e9n\u00e9ficier de ce droit de pr\u00e9emption, r\u00e9gi par les dispositions de droit commun et inapplicable aux HLM.<\/p>\n<p style=\"text-align: justify\">L\u2019article <a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000036432665&amp;cidTexte=LEGITEXT000006074096&amp;dateTexte=20180101\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">L. 351-2 du code de la construction et de l\u2019habitation<\/a> est relative aux conventions conclues par les organismes HLM avec l\u2019Etat. En l\u2019esp\u00e8ce, la soci\u00e9t\u00e9 HLM n\u2019a pas conclu de telle convention, puisqu\u2019elle a acquis l\u2019immeuble au moyen d\u2019un PLI.<\/p>\n<h3 style=\"text-align: justify\"><strong>Quand l\u2019article 40 I de la loi du 6 juillet 1989 devient-elle applicable ?<\/strong><\/h3>\n<p style=\"text-align: justify\">La probl\u00e9matique de cet arr\u00eat porte sur l\u2019application ou non de cette loi, et plus largement du r\u00e9gime propre aux logements \u00e0 loyer mod\u00e9r\u00e9 aux contrats de bail.<\/p>\n<p style=\"text-align: justify\">Par principe, <strong>les contrats de bail r\u00e9gis par le droit commun demeurent soumis au droit des baux d\u2019habitation en cas de cession de l\u2019immeuble \u00e0 un organisme HLM<\/strong>. Par cons\u00e9quent, l\u2019article 40 I de la loi du 6 juillet 1989 n\u2019est pas applicable, et les dispositions relatives \u00e0 la d\u00e9livrance des cong\u00e9s et au droit de pr\u00e9emption s\u2019appliquent au bailleur.<\/p>\n<p style=\"text-align: justify\">En revanche, selon les r\u00e8gles de droit commun des contrats, <strong>la reconduction fait na\u00eetre un nouveau contrat de bail.
