Sans attendre les r\u00e9sultats de cette enqu\u00eate et de nouvelles dispositions l\u00e9gislatives, il est possible d\u2019agir contre les discriminations au travail.<\/p>\n<h2 style=\"text-align: justify\"><strong>Qu\u2019est-ce que la discrimination au travail ? <\/strong><\/h2>\n<p style=\"text-align: justify\">Un employeur doit traiter de fa\u00e7on \u00e9quivalente l\u2019ensemble de ses collaborateurs.<\/p>\n<p style=\"text-align: justify\">L\u2019<strong>embauche<\/strong>, <strong>la promotion<\/strong>, les <strong>augmentations de salaire<\/strong> et l\u2019acc\u00e8s \u00e0 la formation doivent \u00eatre motiv\u00e9s par les comp\u00e9tences professionnelles de chacun.<\/p>\n<p style=\"text-align: justify\">Il en va de m\u00eame pour les <strong>sanctions disciplinaires,<\/strong> <strong>les licenciements<\/strong> et les renouvellements de contrats.<\/p>\n<h3 style=\"text-align: justify\"><strong>Les motifs de discrimination interdits <\/strong><\/h3>\n<p style=\"text-align: justify\">La loi a recens\u00e9 plusieurs \u00e9l\u00e9ments qui ne peuvent pas \u00eatre utilis\u00e9s par une entreprise pour consid\u00e9rer ses salari\u00e9s diff\u00e9remment.<\/p>\n<p style=\"text-align: justify\">Ils sont en lien avec l\u2019<strong>origine des personnes<\/strong>, leur <strong>orientation sexuelle<\/strong>, leur situation familiale, leur apparence physique, leur \u00e9tat de sant\u00e9, leur <strong>handicap<\/strong>, leurs <strong>opinions politiques et religieuses<\/strong> et leur appartenance \u00e0 un syndicat.<\/p>\n<p style=\"text-align: justify\">Les employ\u00e9s ont le droit au <strong>respect de leur vie priv\u00e9e<\/strong> et elle ne peut pas faire l\u2019objet de questions lors d\u2019un entretien d\u2019embauche par exemple. Ainsi, une candidate n\u2019est pas tenue d\u2019informer les recruteurs qu\u2019elle est enceinte. La place ne pourra pas lui \u00eatre refus\u00e9e pour cette raison.<\/p>\n<p style=\"text-align: justify\">La liste des motifs de discrimination interdits est consultable sur le site du <a href=\"https:\/\/travail-emploi.gouv.fr\/droit-du-travail\/egalite-professionnelle-discrimination-et-harcelement\/article\/la-protection-contre-les-discriminations\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Minist\u00e8re du Travail<\/a>.<\/p>\n<h3 style=\"text-align: justify\"><strong>Les situations particuli\u00e8res<\/strong><\/h3>\n<p style=\"text-align: justify\">Il existe des exceptions, dict\u00e9es par les n\u00e9cessit\u00e9s des t\u00e2ches \u00e0 accomplir.<\/p>\n<p style=\"text-align: justify\">Dans les m\u00e9tiers artistiques, il est autoris\u00e9 de <strong>r\u00e9server des r\u00f4les selon les sexes<\/strong>.<\/p>\n<p style=\"text-align: justify\">Certains emplois peuvent \u00eatre inaccessibles aux salari\u00e9s en fonction de <strong>leur \u00e2ge<\/strong> ou pour des <strong>raisons de s\u00e9curit\u00e9<\/strong>. Les postes de nuit sont interdits aux mineurs, la loi ne les autorisant pas \u00e0 travailler entre 22 heures et 6 heures.<\/p>\n<h4 style=\"text-align: justify\"><strong>Les fonctionnaires<\/strong><\/h4>\n<p style=\"text-align: justify\">Le recrutement dans la fonction publique se fait sur <strong>crit\u00e8re de nationalit\u00e9<\/strong> sans que cela ne soit une discrimination. Seuls les citoyens fran\u00e7ais peuvent s\u2019engager dans l\u2019arm\u00e9e ou dans la police. Les autres secteurs sont r\u00e9serv\u00e9s aux Fran\u00e7ais, aux Suisses et aux ressortissants de l\u2019Espace \u00e9conomique europ\u00e9en.<\/p>\n<h2 style=\"text-align: justify\"><strong>Faire cesser les discriminations au travail <\/strong><\/h2>\n<p style=\"text-align: justify\">Les entreprises de plus de trois cents personnes et les soci\u00e9t\u00e9s sp\u00e9cialis\u00e9es dans les ressources humaines ont obligation de <strong>former \u00e0 la non-discrimination<\/strong> leur personnel charg\u00e9 du recrutement. Cette formation a lieu tous les cinq ans.<\/p>\n<h3 style=\"text-align: justify\"><strong>Alerter les repr\u00e9sentants du personnel<\/strong><\/h3>\n<p style=\"text-align: justify\">Si vous \u00eates victime ou t\u00e9moin de discrimination sur votre lieu de travail, vous pouvez contacter le <a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F34474\" target=\"_blank\" rel=\"nofollow noopener noreferrer\"><strong>Comit\u00e9 social et \u00e9conomique<\/strong><\/a> (CSE). Il saisit les employeurs pour porter \u00e0 leur connaissance la discrimination subie par un salari\u00e9 en raison de son sexe, son \u00e2ge, son origine ou tout autre motif. Il est ensuite mandat\u00e9 par la direction pour enqu\u00eater.<\/p>\n<p style=\"text-align: justify\">Si les faits sont av\u00e9r\u00e9s, l\u2019entreprise doit mettre fin \u00e0 la situation et prendre les mesures n\u00e9cessaires, y compris les <strong>sanctions disciplinaires<\/strong> \u00e0 l\u2019\u00e9gard de l\u2019auteur de discriminations.<\/p>\n<p style=\"text-align: justify\">Les salari\u00e9s qui ont d\u00e9nonc\u00e9 les faits ne peuvent pas \u00eatre sanctionn\u00e9s.<\/p>\n<p style=\"text-align: justify\">En l\u2019absence de CSE, vous pouvez contacter les <strong>d\u00e9l\u00e9gu\u00e9s syndicaux<\/strong> et l\u2019<strong>inspection du travail<\/strong>.<\/p>\n<h4 style=\"text-align: justify\"><strong>Dans la fonction publique<\/strong><\/h4>\n<p style=\"text-align: justify\">Depuis le 1er mai 2020, les agents de la fonction publique alertent via le <strong>dispositif de signalement<\/strong> des actes de violence, de discrimination, de harc\u00e8lement moral ou sexuel et des agissements sexistes.<\/p>\n<h3 style=\"text-align: justify\"><strong>\u00catre accompagn\u00e9<\/strong><\/h3>\n<p style=\"text-align: justify\">Le <strong>D\u00e9fenseur des droits<\/strong> assiste et conseille les victimes de discrimination tout au long de la proc\u00e9dure. En 2020, les in\u00e9galit\u00e9s professionnelles \u00e9taient le <a href=\"https:\/\/www.defenseurdesdroits.fr\/fr\/rapports\/2020\/06\/discriminations-et-origines-lurgence-dagir\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">premier motif de saisine du D\u00e9fenseur des droits<\/a>.<\/p>\n<p style=\"text-align: justify\">Les <strong>associations de lutte contre le racisme<\/strong>, l\u2019homophobie et les discriminations informent et accompagnent dans les d\u00e9marches.<\/p>\n<h2 style=\"text-align: justify\">Mener une action en justice<\/h2>\n<p style=\"text-align: justify\">Vous pouvez <strong>porter plainte au p\u00e9nal<\/strong> aupr\u00e8s du commissariat ou de la gendarmerie.<\/p>\n<p style=\"text-align: justify\">L\u2019auteur de discrimination est passible d\u2019une peine de trois ans d\u2019emprisonnement et d\u2019une amende de 45 000 euros.<\/p>\n<h3 style=\"text-align: justify\">Faire annuler la mesure et obtenir r\u00e9paration<\/h3>\n<p style=\"text-align: justify\">Salari\u00e9 du secteur priv\u00e9, vous pouvez <strong>saisir le conseil de prud\u2019hommes<\/strong> (CPH) pour annuler une sanction, un licenciement ou de toute autre mesure qui aurait \u00e9t\u00e9 prise en fonction de crit\u00e8res discriminatoires.<\/p>\n<p style=\"text-align: justify\">Vous pouvez aussi demander r\u00e9paration du pr\u00e9judice subi en <strong>sollicitant des dommages et int\u00e9r\u00eats<\/strong>.<\/p>\n<p style=\"text-align: justify\">Pour les agents de la fonction publique, il faut s\u2019adresser <strong>au tribunal administratif<\/strong>.<\/p>\n<h3 style=\"text-align: justify\">L\u2019action de groupe<\/h3>\n<p style=\"text-align: justify\">Si <strong>plusieurs salari\u00e9s d\u2019une m\u00eame soci\u00e9t\u00e9<\/strong> sont concern\u00e9s, la loi les autorise \u00e0 mener une action de groupe avec l\u2019aide d\u2019une organisation syndicale ou d\u2019une association.<\/p>\n<p style=\"text-align: justify\">Elle commence par une phase de discussion avec l\u2019employeur pour <strong>faire cesser les pratiques discriminantes<\/strong> et les ph\u00e9nom\u00e8nes de harc\u00e8lement qui peuvent en d\u00e9couler.<\/p>\n<p style=\"text-align: justify\">Si six mois apr\u00e8s la demande des plaignants les n\u00e9gociations n\u2019ont pas permis de faire cesser les discriminations, alors les plaignants peuvent <strong>saisir le tribunal judiciaire<\/strong> pour mettre fin aux discriminations et obtenir r\u00e9paration.<\/p>\n<h6 style=\"text-align: right\"><a href=\"https:\/\/fr.freepik.com\/photos-vecteurs-libre\/personnes\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Cr\u00e9dit Image<\/a><\/h6>\n","protected":false},"excerpt":{"rendered":"<p>En plein mois des fiert\u00e9s et suite au mouvement Black lives matter, le gouvernement a annonc\u00e9 sa volont\u00e9 de lutter contre les discriminations \u00e0 l\u2019embauche en organisant une campagne de testing &#8230; <\/p>\n","protected":false},"author":2,"featured_media":19146,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[46],"tags":[449,19,50],"class_list":["post-19144","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-droit-du-travail","tag-discrimination","tag-salarie","tag-travail"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.6 -
