{"id":18540,"date":"2020-06-30T08:55:00","date_gmt":"2020-06-30T08:55:00","guid":{"rendered":"https:\/\/avoloi.eu\/?p=18540"},"modified":"2020-06-30T08:55:00","modified_gmt":"2020-06-30T08:55:00","slug":"coproprietes-assemblees-dematerialisees-et-report-de-dates","status":"publish","type":"post","link":"https:\/\/avoloi.fr\/blog\/coproprietes-assemblees-dematerialisees-et-report-de-dates\/","title":{"rendered":"Copropri\u00e9t\u00e9s : assembl\u00e9es d\u00e9mat\u00e9rialis\u00e9es et report de dates"},"content":{"rendered":"<p style=\"text-align: justify\">Succ\u00e9dant \u00e0 une premi\u00e8re s\u00e9rie de mesures adopt\u00e9es au c\u0153ur de l\u2019\u00e9pid\u00e9mie de Covid-19, l\u2019ordonnance n\u00b0 2020-595 du 20 mai 2020 offre, momentan\u00e9ment, aux syndics de copropri\u00e9t\u00e9 la possibilit\u00e9 de tenir \u00e0 distance les assembl\u00e9es g\u00e9n\u00e9rales de copropri\u00e9taires et traite, dans l\u2019attente, le sort des contrats de syndic et des mandats de conseillers syndicaux arriv\u00e9s \u00e0 expiration.<\/p>\n<h3 style=\"text-align: justify\"><strong>Nouvelle date de report des assembl\u00e9es g\u00e9n\u00e9rales de copropri\u00e9taires<\/strong><\/h3>\n<p style=\"text-align: justify\">L\u2019assembl\u00e9e g\u00e9n\u00e9rale des copropri\u00e9taires se r\u00e9unit autant de fois que n\u00e9cessaire pour le bon fonctionnement de la copropri\u00e9t\u00e9. Elle doit, cependant, \u00eatre convoqu\u00e9e a minima une fois dans les six mois suivant la cl\u00f4ture de l&rsquo;exercice comptable. Mais pour cette ann\u00e9e 2020, la crise sanitaire li\u00e9e au Covid-19 est venue bouleverser le calendrier des assembl\u00e9es de nombreuses copropri\u00e9t\u00e9s.<\/p>\n<p style=\"text-align: justify\">En r\u00e9ponse au prolongement de l&rsquo;\u00e9tat d&rsquo;urgence sanitaire (jusqu&rsquo;au 10 juillet 2020), l\u2019ordonnance du 20 mai 2020 adapte, une nouvelle fois, les d\u00e9lais accord\u00e9s \u00e0 titre d\u00e9rogatoire pour la tenue de ces assembl\u00e9es. Les copropri\u00e9taires ont d\u00e9sormais <strong>jusqu\u2019au 31 janvier 2021<\/strong> pour se r\u00e9unir en assembl\u00e9e g\u00e9n\u00e9rale et satisfaire ainsi \u00e0 leur obligation l\u00e9gale.<\/p>\n<p style=\"text-align: justify\">Or, pour la plupart des copropri\u00e9t\u00e9s, c\u2019est \u00e0 l\u2019occasion de cette assembl\u00e9e que sont g\u00e9r\u00e9s les renouvellements de contrats de syndic et des mandats de conseillers syndicaux. En raison des restrictions li\u00e9es aux rassemblements de personnes, de nombreux contrats de syndic et mandats de membres du conseil syndical arrivent ou arriveront \u00e0 terme sans que la copropri\u00e9t\u00e9 ait pu tenir d\u2019assembl\u00e9e en vue de pourvoir \u00e0 leur renouvellement ou \u00e0 leur remplacement.<\/p>\n<p style=\"text-align: justify\">Pour pallier cette carence et assurer une certaine continuit\u00e9 dans la gestion des copropri\u00e9t\u00e9s, l\u2019ordonnance impose donc un <strong>renouvellement automatique<\/strong> applicable\u00a0:<\/p>\n<ul style=\"text-align: justify\">\n<li>aux <strong>contrats de syndic<\/strong> arriv\u00e9s \u00e0 expiration <strong>entre le 12 mars 2020 et le 23 juillet 2020<\/strong>, dont le sort n\u2019a pas \u00e9t\u00e9 r\u00e9gl\u00e9 par l\u2019assembl\u00e9e des copropri\u00e9taires avant la parution de l\u2019ordonnance au Journal Officiel. Le contrat de syndic est alors renouvel\u00e9 dans les m\u00eames conditions que le pr\u00e9c\u00e9dent, \u00e9tant pr\u00e9cis\u00e9 que la r\u00e9mun\u00e9ration est d\u00e9termin\u00e9e proportionnellement \u00e0 la dur\u00e9e du renouvellement\u00a0;<\/li>\n<li>aux <strong>mandats de membres du conseil syndical<\/strong> \u00e9chus au cours de cette m\u00eame p\u00e9riode, lorsque l\u2019assembl\u00e9e g\u00e9n\u00e9rale des copropri\u00e9taires comp\u00e9tente pour les octroyer n\u2019a pu, avant la publication de l&rsquo;ordonnance, proc\u00e9der \u00e0 leur reconduction ou \u00e0 leur remplacement.<\/li>\n<\/ul>\n<p style=\"text-align: justify\">Les contrats de syndic et mandats de conseillers syndicaux ainsi renouvel\u00e9s prendront fin lors de la prochaine r\u00e9union des copropri\u00e9taires organis\u00e9e sous forme d\u2019assembl\u00e9e g\u00e9n\u00e9rale, laquelle devra, en tout \u00e9tat de cause, intervenir le 31 janvier 2021 au plus tard.<\/p>\n<h3 style=\"text-align: justify\"><strong>Participer \u00e0 distance aux assembl\u00e9es g\u00e9n\u00e9rales de copropri\u00e9t\u00e9<\/strong><\/h3>\n<p style=\"text-align: justify\">Pour \u00e9viter la pr\u00e9sence physique des copropri\u00e9taires aux assembl\u00e9es g\u00e9n\u00e9rales durant la p\u00e9riode de crise sanitaire, l\u2019ordonnance du 20 mai 2020 facilite temporairement l\u2019organisation des assembl\u00e9es g\u00e9n\u00e9rales d\u00e9mat\u00e9rialis\u00e9es et des votes \u00e0 distance.<\/p>\n<p style=\"text-align: justify\">Normalement r\u00e9serv\u00e9e aux copropri\u00e9t\u00e9s dont l\u2019assembl\u00e9e g\u00e9n\u00e9rale a vot\u00e9 la mise en place et les modalit\u00e9s du dispositif en application du d\u00e9cret du 27 juin 2019, la possibilit\u00e9 de tenir des assembl\u00e9es \u00e0 distance est, <strong>\u00e0 compter du 1er\u00a0juin\u00a02020 et jusqu&rsquo;au 31\u00a0janvier\u00a02021<\/strong>, ouverte \u00e0 l\u2019ensemble des syndicats de copropri\u00e9taires.<\/p>\n<p style=\"text-align: justify\">Le syndic peut, d\u00e8s lors, proposer aux copropri\u00e9taires de participer aux assembl\u00e9es g\u00e9n\u00e9rales :<\/p>\n<ul style=\"text-align: justify\">\n<li>par <strong>visioconf\u00e9rence<\/strong>, <strong>audioconf\u00e9rence<\/strong> ou tout autre moyen de communication \u00e9lectronique qui permet d\u2019identifier les participants, de transmettre leurs voix et d\u2019assurer la retransmission continue et simultan\u00e9e des d\u00e9lib\u00e9rations. En cas de tenue d\u2019une assembl\u00e9e d\u00e9mat\u00e9rialis\u00e9e, les copropri\u00e9taires conservent la possibilit\u00e9 de voter par correspondance avant la r\u00e9union\u00a0;<\/li>\n<li>au moyen exclusif de <strong>votes par correspondance<\/strong> lorsque l\u2019organisation d\u2019une assembl\u00e9e par voie \u00e9lectronique ne peut \u00eatre envisag\u00e9e.<\/li>\n<\/ul>\n<p style=\"text-align: justify\">Les copropri\u00e9taires sont inform\u00e9s par la convocation du dispositif retenu pour la tenue de l\u2019assembl\u00e9e g\u00e9n\u00e9rale et des modalit\u00e9s de vote \u00e0 distance. Aucun lieu de r\u00e9union n\u2019est, de fait, mentionn\u00e9.<\/p>\n<p style=\"text-align: justify\">Lorsque les convocations ont d\u00e9j\u00e0 \u00e9t\u00e9 adress\u00e9es aux copropri\u00e9taires, le syndic conserve n\u00e9anmoins la facult\u00e9 d\u2019organiser une assembl\u00e9e g\u00e9n\u00e9rale \u00e0 distance. Il lui appartient, dans ce cas, de transmettre \u00e0 chaque copropri\u00e9taire les informations n\u00e9cessaires quinze jours au moins avant la date de l\u2019assembl\u00e9e.<\/p>\n<p style=\"text-align: justify\">L\u2019ordonnance admet \u00e9galement qu\u2019un mandataire puisse d\u00e9tenir plus de trois d\u00e9l\u00e9gations de vote de copropri\u00e9taires tant que la somme des voix mises ainsi \u00e0 sa disposition reste dans la limite de 15 % du nombre total de voix du syndicat des copropri\u00e9taires (contre 10 % en temps normal).<\/p>\n<p style=\"text-align: justify\">Enfin, \u00e9tabli par le syndic en cours de s\u00e9ance et sign\u00e9 \u00e0 l\u2019issue de la r\u00e9union lors d\u2019une assembl\u00e9e tenue en pr\u00e9sentiel, le proc\u00e8s-verbal de l\u2019assembl\u00e9e g\u00e9n\u00e9rale d\u00e9mat\u00e9rialis\u00e9e doit, quant \u00e0 lui, \u00eatre sign\u00e9 par le pr\u00e9sident de s\u00e9ance et, le cas \u00e9ch\u00e9ant, le ou les scrutateurs, dans un d\u00e9lai de huit jours \u00e0 compter de la date de l\u2019assembl\u00e9e.
