Outre la situation de confinement venue bouleverser temporairement les r\u00e8glementations en vigueur, des \u00e9volutions d\u00e9coulant de la loi d\u2019orientation des mobilit\u00e9s (LOM) sont entr\u00e9es en application depuis le d\u00e9but de l\u2019ann\u00e9e 2020. Voici venue l\u2019heure d\u2019un petit tour d\u2019horizon des nouvelles mesures phares.<\/p>\n<h2>Le t\u00e9l\u00e9phone au volant ou la suspension du permis de conduire<\/h2>\n<p>La loi d\u2019orientation des mobilit\u00e9s du 24 d\u00e9cembre 2019 est entr\u00e9e en vigueur le 27 d\u00e9cembre 2019. L\u2019article L224-1 du Code de la route a \u00e9t\u00e9 modifi\u00e9 par cette loi en ce qu\u2019il pr\u00e9voit d\u00e9sormais la consid\u00e9ration de l\u2019usage du t\u00e9l\u00e9phone lors de la commission d\u2019une infraction.<\/p>\n<p>En effet, d\u00e8s lors qu\u2019un conducteur a son t\u00e9l\u00e9phone tenu en main lors de la commission d\u2019une autre infraction dont la liste est fix\u00e9e par d\u00e9cret, ce dernier fera l\u2019objet d\u2019une r\u00e9tention imm\u00e9diate de son permis de conduire. A titre d\u2019exemple, l\u2019infraction simultan\u00e9e peut \u00eatre un exc\u00e8s de vitesse, un refus de priorit\u00e9 etc.<\/p>\n<p>Article L224-1 : <em>\u00ab\u00a0(\u2026) 7\u00b0 Lorsque le v\u00e9hicule est intercept\u00e9, lorsqu&rsquo;une infraction en mati\u00e8re d&rsquo;usage du t\u00e9l\u00e9phone tenu en main est \u00e9tablie simultan\u00e9ment avec une des infractions en mati\u00e8re de respect des r\u00e8gles de conduite des v\u00e9hicules, de vitesse, de croisement, de d\u00e9passement, d&rsquo;intersection et de priorit\u00e9s de passage dont la liste est fix\u00e9e par d\u00e9cret en Conseil d\u2019Etat (\u2026)\u00a0\u00bb.<\/em><\/p>\n<p>Les sanctions relatives \u00e0 cette nouvelle caract\u00e9risation de double infraction sont pr\u00e9vues par l\u2019article L224-2 du Code de la route. En vertu de cet article, suite \u00e0 la constatation de la double infraction, le contrevenant se verra remettre un avis de r\u00e9tention du permis de conduire de 72 heures maximum<br \/>\nCependant, le texte pr\u00e9voit la possibilit\u00e9 pour le pr\u00e9fet de prononcer une suspension administrative d\u2019une dur\u00e9e pouvant aller jusqu\u2019\u00e0 six mois.<\/p>\n<h2>Les d\u00e9rogations \u00e0 la limitation de vitesse de 80 km\/h<\/h2>\n<p>La limitation de vitesse \u00e0 80km\/h des routes \u00e0 double sens sans s\u00e9parateur central, au lieu de 90km\/h avait fait couler beaucoup d\u2019encre lors de son adoption puis son entr\u00e9e en vigueur le 1er juillet 2018. En effet, le d\u00e9bat avait beaucoup divis\u00e9 au sein de l\u2019opinion publique ; certains acteurs remettant en cause l\u2019impact effectif d\u2019une telle mesure sur la r\u00e9duction de la mortalit\u00e9 sur les routes, argument avanc\u00e9 par le gouvernement.<\/p>\n<p>Dans la loi d\u2019orientation des mobilit\u00e9s, il est mis en place un dispositif de d\u00e9rogation aux 80km\/h. Le l\u00e9gislateur renvoie la d\u00e9cision aux collectivit\u00e9s territoriales en introduisant l\u2019article L 3221-4-1 du Code g\u00e9n\u00e9ral des collectivit\u00e9s territoriales qui dispose que <em>\u00ab\u00a0Le pr\u00e9sident du conseil d\u00e9partemental ou, lorsqu&rsquo;il est l&rsquo;autorit\u00e9 d\u00e9tentrice du pouvoir de police de la circulation, le maire ou le pr\u00e9sident de l&rsquo;\u00e9tablissement public de coop\u00e9ration intercommunale peut fixer, pour les sections de routes hors agglom\u00e9ration relevant de sa comp\u00e9tence et ne comportant pas au moins deux voies affect\u00e9es \u00e0 un m\u00eame sens de circulation, une vitesse maximale autoris\u00e9e sup\u00e9rieure de 10 km\/ h \u00e0 celle pr\u00e9vue par le code de la route. Cette d\u00e9cision prend la forme d&rsquo;un arr\u00eat\u00e9 motiv\u00e9, pris apr\u00e8s avis de la commission d\u00e9partementale de la s\u00e9curit\u00e9 routi\u00e8re, sur la base d&rsquo;une \u00e9tude d&rsquo;accidentalit\u00e9 portant sur chacune des sections de route concern\u00e9es.\u00a0\u00bb<\/em><\/p>\n<p>Il convient de constater que les possibilit\u00e9s de d\u00e9rogation sont particuli\u00e8rement limit\u00e9es et soumises au pr\u00e9alable \u00e0 l\u2019avis d\u2019une commission d\u00e9partementale, ce qui limitera probablement le nombre de modifications effectives.<\/p>\n<h2>La confiscation du v\u00e9hicule<\/h2>\n<p>La loi d\u2019orientation des mobilit\u00e9s influe aussi sur le droit routier en ce qu\u2019elle \u00e9largit les cas d\u2019infractions qui pourront d\u00e9couler sur une confiscation du v\u00e9hicule avec lequel l\u2019infraction a \u00e9t\u00e9 commise.<br \/>\nCela concerne par exemple le d\u00e9lit de conduite en \u00e9tat d\u2019ivresse, le d\u00e9lit de conduite apr\u00e8s usage de stup\u00e9fiants ou encore le d\u00e9lit de refus de se soumettre aux v\u00e9rifications destin\u00e9es \u00e0 mesure l\u2019impr\u00e9gnation l\u2019alcoolique. Ces d\u00e9lits sont mentionn\u00e9s aux articles L234-1, L235-1 et L234-8 du Code de la route.<\/p>\n<p>Dans les situations que nous venons de mentionner, les forces de l\u2019ordre pourront mettre le v\u00e9hicule en fourri\u00e8re provisoirement. Cette mesure devra ensuite \u00eatre autoris\u00e9e par le procureur de la R\u00e9publique dans un d\u00e9lai de sept jours sous peine que le v\u00e9hicule soit restitu\u00e9 directement \u00e0 son propri\u00e9taire.<\/p>\n<p>L\u2019\u00e9largissement des possibilit\u00e9s de confiscation des v\u00e9hicules est pr\u00e9cis\u00e9 \u00e0 l\u2019article L 325-1-2 du Code de la route.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le droit routier est une mati\u00e8re \u00e9minemment li\u00e9e aux \u00e9volutions \u00e9conomiques et sociales.
