C\u2019est l\u2019histoire d\u2019une locataire, victime de squatter, qui r\u00e9clame \u00e0 son propri\u00e9taire des dommages-int\u00e9r\u00eats\u2026<\/i><\/b><\/h3>\n

Suite \u00e0 la pr\u00e9sence de squatters dans le hall d\u2019entr\u00e9e de l\u2019immeuble dans lequel elle loue un logement, une locataire poursuit en justice son bailleur, estimant qu\u2019il n\u2019a pas respect\u00e9 son obligation de garantir une jouissance paisible du bien lou\u00e9 ainsi que de ses \u00ab\u00a0accessoires\u00a0\u00bb.<\/p>\n

L\u2019objet du litige<\/h3>\n

La locataire rappelle que le hall d\u2019entr\u00e9e est une partie commune de l\u2019immeuble \u00ab\u00a0accessoire\u00a0\u00bb au logement lou\u00e9. Par cons\u00e9quent, le trouble subi par la pr\u00e9sence des squatters doit \u00eatre r\u00e9par\u00e9 par son bailleur. Mais ce dernier estime ne rien devoir \u00e0 la locataire. Il conteste devoir garantir sa locataire contre les troubles que des tiers lui font subir. Ce qui est le cas ici puisque le trouble invoqu\u00e9 est cons\u00e9cutif \u00e0 la pr\u00e9sence de squatters avec lesquels il n\u2019avait aucun lien.<\/p>\n

Le verdict<\/h3>\n

Raisonnement que valide le juge\u00a0: le bailleur n\u2019avait aucun lien avec les squatters. D\u00e8s lors, il n\u2019est pas responsable du trouble de jouissance subi par sa locataire et n\u2019est donc pas tenu de lui verser des dommages-int\u00e9r\u00eats.<\/p>\n
