C\u2019est l\u2019histoire d\u2019un avocat dont le client conteste le montant des honoraires\u2026<\/i><\/b><\/h2>\n

Un client refuse de payer les honoraires r\u00e9clam\u00e9s par son avocat et fait appel au b\u00e2tonnier pour obtenir une baisse de ces honoraires. Au vu des diligences r\u00e9alis\u00e9es, le b\u00e2tonnier refuse et donne raison \u00e0 l\u2019avocat. D\u00e9cision que le client d\u00e9cide de contester devant le juge\u2026<\/p>\n

L’objet du litige<\/h3>\n

\u00ab Trop tard \u00bb, r\u00e9pond l\u2019avocat : \u00e0 compter de la saisine du b\u00e2tonnier (un 8 septembre), celui-ci a eu 4 mois pour prendre une d\u00e9cision (soit jusqu\u2019au 8 janvier). Ensuite, son client a eu 1 mois pour saisir le juge (donc jusqu\u2019au 8 f\u00e9vrier). Or, il ne l\u2019a fait que le 23 f\u00e9vrier\u2026 Son recours est donc irrecevable. \u00ab Faux ! \u00bb, conteste toutefois le client : le b\u00e2tonnier a notifi\u00e9 tardivement sa d\u00e9cision le 25 janvier ; ayant agi moins d\u2019un mois apr\u00e8s cette notification, il estime que son recours devant le juge est recevable.<\/p>\n

Le verdict<\/h3>\n

Ce que confirme le juge : parce que le client a effectivement agi dans le d\u00e9lai d\u2019un mois \u00e0 compter de la notification rendue tardivement par le b\u00e2tonnier, son recours est parfaitement valable.<\/p>\n
