Vers 1h du matin, des voisins se plaignent du bruit et appellent la police qui, sur place, ne peut que constater le tapage nocturne. Elle sanctionne donc, par une amende les jeunes pr\u00e9sents \u00e0 la soir\u00e9e\u2026 mais aussi le p\u00e8re, estimant qu\u2019il est complice\u2026<\/p>\n<h3>L&rsquo;objet du litige<\/h3>\n<p>\u00ab Et pourquoi ? \u00bb, s\u2019\u00e9tonne le p\u00e8re : n\u2019ayant pas lui-m\u00eame particip\u00e9 \u00e0 la f\u00eate, il n\u2019a commis aucun tapage nocturne et ne peut donc pas \u00eatre condamn\u00e9 pour complicit\u00e9. Ce que conteste la police : m\u00eame s\u2019il n\u2019a pas lui-m\u00eame fait de bruit, il \u00e9tait pr\u00e9sent \u00e0 son domicile, lors de la f\u00eate. Or, il a laiss\u00e9 des invit\u00e9s commettre sous son toit un tapage nocturne, alors qu\u2019il aurait d\u00fb user de son autorit\u00e9 de propri\u00e9taire et de p\u00e8re de famille pour mettre fin au tapage nocturne\u2026<\/p>\n<h3>Le verdict<\/h3>\n<p>\u00ab Exact \u00bb, confirme le juge : en n\u2019usant pas de son autorit\u00e9, le p\u00e8re a effectivement commis un acte de \u00ab complicit\u00e9 de tapage nocturne \u00bb.
