Un couple d\u00e9cide de divorcer, mais un litige survient au sujet du nom de famille : si madame souhaite conserver le nom de famille de son ex-\u00e9poux, ce dernier n\u2019est pas d\u2019accord. L\u2019ex-\u00e9pouse d\u00e9cide alors de l\u2019y contraindre et sollicite l\u2019autorisation du juge\u2026<\/p>\n

L’objet du litige<\/h3>\n

Demande qui doit \u00eatre rejet\u00e9e, selon son ex-mari : pour lui, son ex-femme ne justifie d\u2019aucun int\u00e9r\u00eat \u00e0 conserver son nom de famille car elle n\u2019exerce pas de profession et n\u2019a pas acquis une notori\u00e9t\u00e9 particuli\u00e8re avec. \u00ab J\u2019ai des int\u00e9r\u00eats \u00e0 le garder \u00bb, persiste son ex-femme : elle rappelle qu\u2019elle a pris le nom de son ex-mari et l\u2019a utilis\u00e9 durant leurs 34 ans de mariage et que les documents administratifs la mentionnent sous son nom marital. En cons\u00e9quence, elle doit pouvoir conserver le nom de son ex-mari.<\/p>\n

Le verdict<\/h3>\n

\u00ab Non \u00bb, r\u00e9pond tout de m\u00eame le juge : pour lui, les arguments avanc\u00e9s par l\u2019ex-\u00e9pouse ne sont pas suffisants pour justifier d\u2019un int\u00e9r\u00eat \u00e0 conserver le nom de son ex-mari. Elle doit, d\u00e8s lors, reprendre son nom de jeune fille.<\/p>\n
