C\u2019est l\u2019histoire d\u2019un avocat qui a jou\u00e9 la montre pour le compte d\u2019un client\u2026<\/i><\/b><\/h2>\n

Un avocat remporte un proc\u00e8s pour une ex-salari\u00e9e en litige avec son employeur. Ce dernier d\u00e9cide de faire appel et le notifie le jour m\u00eame \u00e0 l\u2019avocat de son ex-salari\u00e9e, 1 mois avant la fin du d\u00e9lai pr\u00e9vu par la proc\u00e9dure pour le faire\u2026<\/p>\n

L’objet du litige<\/h3>\n

Mais, l\u2019avocat revient vers l\u2019employeur 2 mois plus tard, pour lui expliquer qu\u2019il ne peut pas y avoir de proc\u00e8s en appel, puisqu\u2019il n\u2019a pas envoy\u00e9 sa notification dans le d\u00e9lai imparti. \u00ab Pourtant si \u00bb, s\u2019\u00e9tonne celui-ci, rappelant la notification qu\u2019il lui a envoy\u00e9e. \u00ab Sauf qu\u2019elle a \u00e9t\u00e9 envoy\u00e9e \u00e0 la mauvaise personne \u00bb, r\u00e9torque l\u2019avocat : il vient seulement de se voir confier la t\u00e2che de d\u00e9fendre sa cliente en appel. Il n\u2019\u00e9tait donc pas encore officiellement l\u2019avocat de sa cliente lorsqu\u2019il a re\u00e7u la notification en question.<\/p>\n

Le verdict<\/h3>\n

C\u2019est donc directement \u00e0 l\u2019ex-salari\u00e9e, qu\u2019il aurait fallu l\u2019envoyer. Et comme cela n\u2019a pas \u00e9t\u00e9 fait, l\u2019appel est irrecevable. Ce que confirme le juge : l\u2019avocat remporte donc une nouvelle fois un proc\u00e8s pour sa cliente.<\/p>\n
