Une femme pr\u00e9sente divers troubles alt\u00e9rant ses facult\u00e9s et est plac\u00e9e sous tutelle. Ce qu\u2019elle conteste, la proc\u00e9dure m\u00e9dicale n\u2019ayant pas \u00e9t\u00e9 scrupuleusement respect\u00e9e, selon elle\u2026 Mais \u00e0 tort, selon le juge des tutelles \u2026<\/p>\n

L’objet du litige<\/h3>\n

\u2026 qui produit un certificat m\u00e9dical lequel atteste que la femme pr\u00e9sente des troubles cognitifs alt\u00e9rant son raisonnement, sa m\u00e9moire et son comportement, qu\u2019elle refuse de se soigner et qu\u2019elle a \u00e9galement une scl\u00e9rose en plaque la privant de toute autonomie. Pour lui, la tutelle est donc m\u00e9dicalement justifi\u00e9e. \u00ab Non \u00bb, persiste la femme qui rappelle que, pour placer une personne sous tutelle, il est n\u00e9cessaire d\u2019obtenir l\u2019avis d\u2019un m\u00e9decin express\u00e9ment r\u00e9f\u00e9renc\u00e9 sur une liste fix\u00e9e par le procureur de la R\u00e9publique, ce qui fait d\u00e9faut ici. Son placement sous tutelle est donc illicite\u2026<\/p>\n

Le verdict<\/h3>\n

\u00ab Exact \u00bb, confirme finalement le juge : m\u00eame si la tutelle est m\u00e9dicalement justifi\u00e9e, la proc\u00e9dure n\u2019a pas \u00e9t\u00e9 rigoureusement respect\u00e9e. La tutelle doit donc \u00eatre annul\u00e9e\u2026<\/p>\n
