Elle demande que son mur soit repeint en blanc, aux frais de son voisin. Celui-ci refuse et explique avoir agi dans son int\u00e9r\u00eat\u2026<\/p>\n<h3>L&rsquo;objet du litige<\/h3>\n<p>Le voisin lui rappelle alors que le cahier des charges du lotissement comporte une obligation d\u2019entretien des murs qu\u2019elle ne respecte pas. Apr\u00e8s lui avoir propos\u00e9 \u00e0 plusieurs reprises, en vain, de repeindre son mur, il a fini par le faire, non pas en jaune, comme l\u2019affirme la propri\u00e9taire, mais en blanc cass\u00e9. Ce que nie la voisine, qui persiste \u00e0 dire que le mur est jaune, alors que le cahier des charges impose que les murs soient peints dans une teinte blanche. Elle persiste et r\u00e9clame que le mur soit repeint en blanc, aux frais de son voisin\u2026<\/p>\n<h3>Le verdict<\/h3>\n<p>\u2026\u00e0 tort pour le juge : le mur, repeint en blanc cass\u00e9, apporte une am\u00e9lioration visuelle pour la propri\u00e9taire qui n\u2019est, en outre, plus en infraction avec les r\u00e8gles du lotissement.
