Mais, la caisse d\u2019assurance maladie refuse de lui verser les indemnit\u00e9s journali\u00e8res dues pour le mois de janvier\u2026<\/p>\n<h3>L&rsquo;objet du litige<\/h3>\n<p>La caisse lui rappelle alors que la prolongation d\u2019un arr\u00eat maladie doit \u00eatre r\u00e9dig\u00e9e par le m\u00e9decin prescripteur ou le m\u00e9decin traitant. Ce qui n\u2019est pas le cas ici, la salari\u00e9e ayant sollicit\u00e9 un autre m\u00e9decin. Exact, r\u00e9pond la salari\u00e9e : le chirurgien qui lui a prescrit l\u2019arr\u00eat ne pouvait pas la recevoir avant le 30 janvier et son m\u00e9decin traitant \u00e9tait en vacances. C\u2019est pourquoi elle a fait appel \u00e0 un autre m\u00e9decin.<\/p>\n<h3>Le verdict<\/h3>\n<p>A raison, pour le juge : lorsqu\u2019il est dans l\u2019impossibilit\u00e9 de se faire prolonger son arr\u00eat de travail par le m\u00e9decin prescripteur de l&rsquo;arr\u00eat initial ou par son m\u00e9decin traitant, un patient peut aller voir un autre m\u00e9decin.
