Une altercation verbale survient entre un avocat et sa collaboratrice (sous contrat de collaboration lib\u00e9ral), suite \u00e0 son refus de s\u2019occuper de nouveaux dossiers. Celle-ci s\u2019est alors mise en arr\u00eat maladie, durant 14 jours, \u00e0 l\u2019issue duquel l\u2019avocat met fin \u00e0 la collaboration pour manquement grave aux r\u00e8gles professionnelles\u2026<\/p>\n

L’objet du litige<\/h3>\n

Trop tard, r\u00e9pond la collaboratrice : un manquement grave doit \u00eatre sanctionn\u00e9 imm\u00e9diatement, rappelle-t-elle. Or, l\u2019avocat a ici attendu 14 jours pour agir. De plus, 1h apr\u00e8s avoir \u00e9t\u00e9 mise en arr\u00eat maladie, il lui a envoy\u00e9 un SMS lui demandant de venir travailler, le cabinet ayant besoin de son investissement. Cela d\u00e9montre, selon la collaboratrice, que l\u2019avocat ne consid\u00e9rait pas, apr\u00e8s l\u2019altercation, qu\u2019elle avait commise une faute grave, d\u2019autant que son refus de prendre en charge de nouveaux dossiers \u00e9tait justifi\u00e9 par sa charge de travail d\u00e9j\u00e0 importante.<\/p>\n

Le verdict<\/h3>\n

Arguments qui vont convaincre le juge, pour qui l\u2019avocat est donc tenu d\u2019indemniser la collaboratrice.<\/p>\n
