Un contrat est alors sign\u00e9 pour mettre noir sur blanc les droits et obligations de chacune des parties.<\/p>\n<h3>L&rsquo;objet du litige<\/h3>\n<p>9 ans plus tard, le propri\u00e9taire vend sa maison. L\u2019acqu\u00e9reur demande alors au voisin de rehausser le mur en se pr\u00e9valant du contrat que ce dernier a sign\u00e9 avec l\u2019ancien propri\u00e9taire. \u00ab Non \u00bb, r\u00e9pond le voisin : selon lui, seul l\u2019ancien propri\u00e9taire peut l\u2019obliger \u00e0 rehausser le mur. \u00ab Faux \u00bb, r\u00e9pond l\u2019acqu\u00e9reur : en achetant la propri\u00e9t\u00e9, les droits attach\u00e9s au contrat lui ont aussi \u00e9t\u00e9 transmis, ce qui lui permet de s\u2019en pr\u00e9valoir, estime-t-il&#8230;<\/p>\n<h3>Le verdict<\/h3>\n<p>A tort, lui r\u00e9pond le juge : faute de pr\u00e9ciser dans le contrat que les droits et obligations qui y sont attach\u00e9s sont transmis \u00e0 l\u2019acqu\u00e9reur, lui-m\u00eame ne peut pas s\u2019en pr\u00e9valoir.
