L\u2019acqu\u00e9reur de la parcelle y construit une maison comportant un pr\u00e9au situ\u00e9 pr\u00e8s de la limite de propri\u00e9t\u00e9. Trop pr\u00e8s, au go\u00fbt du propri\u00e9taire, qui demande \u00e0 son nouveau voisin de le d\u00e9truire\u2026<\/p>\n<h3>L&rsquo;objet du litige<\/h3>\n<p>Il rappelle alors que le contrat de vente pr\u00e9voit qu\u2019aucune construction n\u2019est autoris\u00e9e \u00e0 moins de 3 m\u00e8tres de la limite de propri\u00e9t\u00e9. Distance non respect\u00e9e ici&#8230; \u00ab C\u2019est vrai \u00bb, conc\u00e8de le nouveau voisin, sauf que le contrat de vente interdit seulement les \u00ab constructions en dur habitables \u00bb. Et si le pr\u00e9au est une construction en dur, il n\u2019est pas habitable.
