Un salari\u00e9 signe une rupture conventionnelle avec son employeur, concessionnaire d\u2019un r\u00e9seau autoroutier. La convention pr\u00e9voit qu\u2019il b\u00e9n\u00e9ficie des droits reconnus aux salari\u00e9s retrait\u00e9s de la soci\u00e9t\u00e9. Parmi ces droits, il y a celui de circuler gratuitement sur le r\u00e9seau autoroutier g\u00e9r\u00e9 par l\u2019ex-employeur\u2026<\/p>\n

L’objet du litige<\/h3>\n

\u2026 jusqu\u2019\u00e0 ce que ce dernier lui fasse simplement b\u00e9n\u00e9ficier d\u2019une r\u00e9duction de 30 % sur ces p\u00e9ages. Une situation qui ne satisfait pas l\u2019ex-salari\u00e9 qui exige de pouvoir \u00e0 nouveau circuler gratuitement sur l\u2019autoroute. \u00ab Non \u00bb, r\u00e9pond l\u2019ex-employeur qui lui rappelle que la rupture conventionnelle lui accorde les m\u00eames droits qu\u2019aux salari\u00e9s retrait\u00e9s\u2026 qui b\u00e9n\u00e9ficient d\u00e9sormais d\u2019une r\u00e9duction de 30 % sur les p\u00e9ages du r\u00e9seau, et non plus de leur gratuit\u00e9, \u00e0 la suite d\u2019une modification d\u2019un accord collectif.<\/p>\n

Le verdict<\/h3>\n

Et pour le juge, comme l\u2019ancien salari\u00e9 b\u00e9n\u00e9ficie des m\u00eames droits que les salari\u00e9s retrait\u00e9s, l\u2019ex-employeur respecte effectivement les termes de la rupture conventionnelle.<\/p>\n
