A son d\u00e9c\u00e8s, il cr\u00e9e tout de m\u00eame des difficult\u00e9s\u2026<\/p>\n<h3>L&rsquo;objet du litige<\/h3>\n<p>&#8230; et r\u00e9clame, malgr\u00e9 tout, l\u2019attribution de l\u2019appartement : il rappelle que, de toutes fa\u00e7ons, tout h\u00e9ritier copropri\u00e9taire peut demander l&rsquo;attribution pr\u00e9f\u00e9rentielle de la propri\u00e9t\u00e9 de son logement, s&rsquo;il y avait sa r\u00e9sidence \u00e0 l&rsquo;\u00e9poque du d\u00e9c\u00e8s. Or, toutes ces conditions, il les remplit. \u00ab Peu importe \u00bb, r\u00e9pondent son fr\u00e8re et sa s\u0153ur : cette r\u00e8gle de l\u2019attribution pr\u00e9f\u00e9rentielle peut \u00eatre \u00e9cart\u00e9e par testament.
