C\u2019est l\u2019histoire d\u2019un propri\u00e9taire \u00e0 qui la Mairie refuse qu\u2019il agrandisse son abri de jardin\u2026<\/i><\/b><\/h2>\n

Un propri\u00e9taire souhaite agrandir un abri de jardin par l\u2019adjonction d\u2019un appentis. Pour cela, il d\u00e9pose une d\u00e9claration pr\u00e9alable de travaux en Mairie. Au bout d\u2019un mois, n\u2019ayant pas re\u00e7u de r\u00e9ponse de la Mairie, il consid\u00e8re qu\u2019il b\u00e9n\u00e9ficie d\u2019une autorisation tacite et agrandit son abri de jardin.<\/p>\n

L’objet du litige<\/h3>\n

Quelques mois plus tard, la Mairie apprend que les travaux ont \u00e9t\u00e9 r\u00e9alis\u00e9s\u2026 et demande au propri\u00e9taire de d\u00e9truire l\u2019appentis ! Pour justifier cette demande de d\u00e9molition, elle se pr\u00e9vaut d\u2019une notification envoy\u00e9e par lettre recommand\u00e9e avec AR au propri\u00e9taire durant le d\u00e9lai d\u2019un mois qu\u2019elle avait pour s\u2019opposer \u00e0 la r\u00e9alisation des travaux. Le propri\u00e9taire r\u00e9pond alors qu\u2019il n\u2019a jamais re\u00e7u cette notification\u2026 et remarque que la Mairie l\u2019a envoy\u00e9e \u00e0 son ancienne adresse et non \u00e0 celle indiqu\u00e9e dans la d\u00e9claration pr\u00e9alable\u2026<\/p>\n

Le verdict<\/h3>\n

Et en raison de cette erreur, le juge consid\u00e8re que le propri\u00e9taire peut effectivement se pr\u00e9valoir d\u2019une autorisation tacite. Il n\u2019a pas \u00e0 d\u00e9molir son appentis.
