Or, en ce qui concerne les toitures, le r\u00e8glement du lotissement impose l\u2019utilisation de pans \u00ab rouge brique \u00bb r\u00e9alis\u00e9s en t\u00f4les, en tuiles ou en fausses tuiles : la toile blanche ne respecte aucune de ces conditions. Le voisin estime que la toile blanche doit donc \u00eatre retir\u00e9e et r\u00e9clame une indemnit\u00e9 pour le pr\u00e9judice subi.<\/p>\n<h3>Le verdict<\/h3>\n<p>\u00ab Non \u00bb r\u00e9pond le couple : d\u2019une part, il estime qu\u2019il n\u2019est pas possible de consid\u00e9rer que la toile blanche constitue une toiture ; d\u2019autre part, pour lui, la pr\u00e9sence de la toile blanche ne cause aucun pr\u00e9judice indemnisable pour le voisin.
