C\u2019est l\u2019histoire d\u2019un couple qui, d\u2019apr\u00e8s une association, a vendu trop de grenouilles rousses\u2026

Un couple est condamn\u00e9 pour avoir captur\u00e9 et vendu des grenouilles rousses (plus de 14 400) sans autorisation administrative, comme le pr\u00e9voit la Loi. Une association de protection du milieu aquatique r\u00e9clame alors des indemnit\u00e9s au couple\u2026<\/p>\n

L’objet du litige<\/h3>\n

\u2026 \u00e0 tort, pour le couple : il affirme que, pour avoir droit \u00e0 des indemnit\u00e9s, il faut que l\u2019association ait engag\u00e9 des actions sp\u00e9cifiques de restauration du milieu naturel apr\u00e8s la survenance du dommage all\u00e9gu\u00e9. Or, l\u2019association n\u2019a pas r\u00e9introduit de grenouilles rousses de remplacement. Elle n\u2019est donc pas fond\u00e9e \u00e0 r\u00e9clamer des indemnit\u00e9s. \u00ab Faux \u00bb conteste l\u2019association : elle estime qu\u2019elle a droit \u00e0 des indemnit\u00e9s pour le pr\u00e9judice moral qui lui a \u00e9t\u00e9 caus\u00e9, d\u00e8s lors qu\u2019il y a eu une atteinte \u00e0 son objet social : la protection de l\u2019\u00e9cosyst\u00e8me aquatique. Ce qui est le cas au regard du comportement du couple, estime l\u2019association.<\/p>\n

Le verdict<\/h3>\n

Un argument convaincant pour le juge qui accorde une indemnit\u00e9 au titre de son pr\u00e9judice moral \u00e0 l\u2019association.
