C\u2019est l\u2019histoire d\u2019un arbitre agress\u00e9 par un joueur de football qu\u2019il a expuls\u00e9\u2026<\/i><\/b><\/h2>\n

Au cours d\u2019un match de football organis\u00e9 par une association sportive, un arbitre expulse un joueur membre de cette association. D\u00e8s la fin du match, le joueur expuls\u00e9 se pr\u00e9cipite sur le terrain et agresse l\u2019arbitre. L\u2019assureur de l\u2019arbitre indemnise alors son client, bless\u00e9, puis r\u00e9clame \u00e0 l\u2019association le remboursement des indemnit\u00e9s vers\u00e9es.<\/p>\n

L’objet du litige<\/h3>\n

Ce que refuse l\u2019association : elle constate que l\u2019agression a eu lieu une fois le match termin\u00e9 ; l\u2019agression n\u2019\u00e9tait donc pas en lien avec l\u2019expulsion. L\u2019association ne s\u2019estime alors plus responsable des agissements de son joueur au moment de l\u2019agression. Ce que conteste l\u2019assureur : pour lui, l\u2019agression d\u2019un arbitre commise dans une enceinte sportive par un joueur expuls\u00e9 au cours du match constitue, m\u00eame lorsqu\u2019elle se produit apr\u00e8s le match, une faute en lien avec le match lui-m\u00eame.<\/p>\n

Le verdict<\/h3>\n

Ce que confirme le juge : et parce que l\u2019association \u00e9tait encore en situation de responsabilit\u00e9 vis-\u00e0-vis de son joueur, elle doit rembourser l\u2019assureur.
