Il explique cette demande par la pr\u00e9sence, trop importante \u00e0 son go\u00fbt, d\u2019encombrants dans le jardin de son voisin, tous visibles depuis sa propri\u00e9t\u00e9\u2026<\/p>\n<h3>L&rsquo;objet du litige<\/h3>\n<p>Pour obtenir gain de cause, le propri\u00e9taire rappelle que les encombrants comprennent, entre autres, un WC usag\u00e9, un fauteuil, la carcasse d\u2019un r\u00e9frig\u00e9rateur, une banquette d\u00e9chir\u00e9e, une bouteille de gaz et un rouleau de grillage. Tous ces objets sont situ\u00e9s en divers endroits du jardin de son voisin et sont tous visibles de sa propri\u00e9t\u00e9. Pour lui, cette nuisance est caract\u00e9ristique d\u2019un trouble anormal du voisinage.<\/p>\n<h3>Le verdict<\/h3>\n<p>\u00ab Exact \u00bb confirme le juge ! La pr\u00e9sence nombreuse des encombrants et en divers endroits du jardin, tous visibles par le propri\u00e9taire depuis sa propri\u00e9t\u00e9, constitue effectivement un trouble anormal de voisinage.
